To provide some background my father, *** ***,
installed the unit for *** approximately (six) years agoAt that time I
was an employee of *** *** and assisted with the installation of the unitFurther,
up until the time that *** *** ceased operating his business ***

continued to service *** ‘s unit
On or about *** *** *** I quit working for *** ***
and started my own business called *** ** *** ***Since I started this
business I have continued to service ***’s unit, even though I was under
no obligation to do so
*** states that his unit came with a ten (10) year
warrantyAfter contacting the manufacturer they told me the unit only came
with a five (5) year warrantyIf *** can provide me with something to
show that his unit has a ten (10) year warranty I would be happy to continue to
honor that warrantyHowever, this warranty only covers the parts repair or
replacement, but not any labor costs involvedThe warranty specifically
states: “This Limited Warranty does NOT
cover any labor costs or expenses for service, NOR for removing or reinstalling partsYou are responsible for all
labor costs or expenses, unless a labor service agreement exists between you
and your contractor.”
This warranty from the manufacturer only applies to the
costs of the parts, not to labor as
demonstrated by the attached and in the above paragraphThe only exception
referenced in the warranty is if *** has a separate labor service
agreement between himself and the contractorThere is no labor service
agreement between *** and myself or my company, therefore, *** is
obligated to pay me for all labor costs that were incurred by me
*** ** *** *** was not hired by *** to
install the unit*** ** *** *** has no agreement with *** to
continue servicing his unit yet he continues to believe that *** ** ***,
*** is somehow obligated to him.
With regard to the damage to ***’s attic, ***
authorized me replace the evaporator coil*** implied that he would take
care of the attic access damage by stating that he had the paint and items to
repair the damage
Additionally, *** states that the evaporator coil
did not need to be replaced and that I was doing it to try to make money off
the manufacturerSince the warranty does not provide for me to be paid
anything I fail to see how I would be making money off of the manufacturerIn
fact, I lost money because I spent time servicing ***’s unit for which he
did not pay me when I could have been servicing other customer’s units and
getting paid for that work.
Despite there being no contract or agreement in place
between myself or my company and ***, I have taken numerous steps to try
to resolve this issue with ***, however, I cannot continue to work for
freeThe warranty that *** references only covers parts and only covered
parts for five (5) yearsI have tried to fix the problems with his unit and
have never made him pay my labor despite the fact that there is no agreement
between usI fail to see how I owe it to *** to continue servicing his
unit when he will not pay me for any labor involved
