I have already responded to this customer complaintWe attempted to work with the customer and the customer wanted us to replace everything on his house for free brand newThat is simply not a reasonable request I do not have anything further to say about this complaintThe documentation was submitted to the court system today to put a lien against the homeowners home, we are looking to foreclose on the property in a very short time if the bill is not paidPer the law, if a homeowner is not happy with the service rendered they are still obligated to pay the contractIf the homeowner and contractor cannot reach a reasonable agreement about any issues that come up then the homeowner should take the contractor to small claims courtI do not know how or why the homeowner has these pictures, but as you can see from the picture that I supplied at an earlier date none of these issues were thereAny further communication on this issue should be addressed through my attorney [redacted] in Owensboro

[redacted] contacted me about rebuilding her porch for her that is correct[redacted] was not satisfied the morning after the porch was built and she brought it to my attentionShe is correct [redacted] was informed by me that I agreed that the porch was not built in a craftsmanship that my company represents and I apologized several times for the way her porch was builtI was absent during the construction of her porch and men that no longer work for me have since been terminated from employment with my company due to their negligence on this particular job[redacted] informed us that she wanted to paint the porchShe was eager to paint the porchTreated lumber cannot be painted for several monthsWhile I was unaware of this conversation that she had with my acting supervisor, he had made the decision to use untreated wood so that she could paint the wood thus "sealing the wood" This is the same as Treating the wood from the manufacturer as both methods serve to seal and protect the wood.When I spoke with [redacted] about the porch, I informed her that I was in the middle of a very large project for another customer and that I would make right of this wrongI informed her that we would wait until the end of March and get together on thisI informed her that I would like for the weather to stabilize a little bit and I needed to complete the large project that I was working on so that I could give her job my fullest attention that it deserves considering this is the second time that I would have to build the porch.We have had rain, tornadoes, hail and every other type of weather during the month of AprilWhile [redacted] is a priority for me, she is not the only customer that we are working withThis company serves on average 30-customers per monthEach one all wanting the work done the very next day which is simply unrealistic[redacted] took to Facebook and proceeded to make very inappropriate post on her personal page in an attempt "inform the public" that we are scam artistWhen I tried to contact [redacted] and ask her why she thought this to be an appropriate measure, she blocked me on Facebook and had some rather nasty things to sayI informed that as long as we were receiving threats and public bashing I was not interested in working with [redacted] on resolving this issue as I find the situation to be a hostile environmentThe environment is hostile to the point that I do not want nor need to expose my employees to [redacted] has been informed numerous times that she has my phone number and that she is more than welcome for us to sit down and discuss a solution to this problemI would be happy to demo and rebuild her porch for her, but I will not put my employees in any position where they will be abused verybally or any other means.I feel as though [redacted] has been treated fairly throughout this entire processWhile it has not been the fastest turn around time on getting the repair work completed, I have no problem uploading a copy of the last days of weather reports for all to see as to why I chose not to tear off the front of her porch there by exposing all of the guts of her home to the outside elements.Lastly, this is not a case of bad business [redacted] paid her deposit, she had her porch torn off of her house and a new porch was built for herThe new porch has all of her outdoor furniture on it, and I have a few pictures of the family sitting on the porch which would indicate that it is of no danger and certainly of use not hindering any day to day operationI say this to make the point that while I do empathize with her wanting to get her new porch built a little more patience is in line as I cannot control the weatherJust as badly as you would like to have a new porch put on your home, we would like to get the work done and part ways with you on the best terms that are possible at this pointI again extend my phone number to [redacted] [redacted] This makes the 7th time that I have written and offered my phone number and asked you to contact me to resolve this issueI do not know what more to do from hereI cannot force you make the call.I am not willing to do a refund on this jobI have man hours and materials cost associated with this project as well as potentially thousands in lost sales due to [redacted] posting derogatory post all over Facebook to her over 1,friendsI don't think we will ever know how many tens of thousands of dollars her actions have cost meBecause of this, there will be no refundWe will rebuild the porch to the specs of the original contractIf this is not suitable, than I suppose we will lets the courts make the final decisionRespectfully, [redacted] Owensboro Roofing Company, LLC

My response to this complaint is as follows:Improper installation: The roof was installed properly and there are no issuesMr [redacted] does not offer any type of explanation as to how the roof was installed incorrectlyInsurance company agrees it is installed improperly and has dropped coverage on homeowner’s roof: I have contacted the homeowner’s insurance company Cincinnati Insurance as we often do business with their companyThe representative from Cincinnati states that they have no record of speaking to Mr [redacted] about anything to do with this issueThey also go further to state the only way they could legally drop coverage on a customer’s policy is if it is found to be improper by a paid engineerThis statement is falsely reported in the customer’s complaint towards our companyDamaged gutters, landscape lights, concrete, fascia, dormer windows and porch:Please see attached contract where it clearly states that we are not responsible for any damage that occurs to these items before, during, or after the time of our workThe customer signed and was provided with the carbon copy of this contractOne of the gutters had a slight scratch to it that Mr [redacted] indicated had occurred from one of our ladders leaning up against his homeWe offered a solution to repair the damage to which he responded that the only way he would be satisfied was if we replaced all of the gutters on his homeThis was an unreasonable request Mr [redacted] indicated that we had broken his landscape lightsWhen I arrived to look at them, I found them to be pulled out of their cradles and laid on the groundI simply picked them up and placed them back into their cradles and they work just fineMr [redacted] indicated that we had broken a piece of his siding on one of the corners of the dormer on the houseI explained to Mr [redacted] that I would be happy to replace the piece of corner with a new piece to which he told me he wanted me to wrap the entire dormer in all new sidingAgain, not a reasonable request Mr [redacted] indicates that we damaged his concretePlease see attached photos showing no damage has occurredThere are obvious places on his concrete where someone used a water hose or pressure washer and cleaned a stripe in them, but no damage is done to any of the concreteMr [redacted] indicates that we moved the items off of his back porch:This is true, as we always move items away from the home that could potentially get damaged during the time of installThe items were moved approximately 10’ from the back of the house to avoid any debris from hitting them Mr [redacted] indicates that we got nails and roofing debris in his air conditionerUpon inspection we noted no nails or debris in his air conditioner as the air conditioner was tarped during the time of install at all times except to clean off the tarpsI have attached photos not only showing that they are clean and free of nails or debris but also a photo of my hand in comparison to the air conditioner which would demonstrate that it is not even possible for us to remove these items if they had fallen inThis statement is also and without merit Mr [redacted] does not address any specific issues with the roof itselfHe claims that we have zero interest in making our customers happy and that we were only there to get paidMr [redacted] asked us if he could take advantage of having the upgraded shingles installed on his roof since they were on saleYou will note in my contract I scratched out Oakridge and wrote in the word Duration, yet the price did not changeHe was not happy with the ridge vent we were originally going to put on so we instead installed the ridge vent he choseEven after our contract clearly alleviates us from any responsibility to his complaints, we still offered to address his concerns within reason because we know the value of a happy customerMr [redacted] unfortunately is one of the customers I can’t seem to make happyAttached are the photos of everything that I have spoken of in response to this complaint

His response is completely and the photos show otherwiseI can only attach a few photosAs far as the A/C not being covered the attach photo shows it is not covered and nails and roofing shingle particles are on and inside the unitThe small scratchAttached is a photo of section of gutter that is complete tore up scratched and dentedMost all my gutters are in the same matter of stateThe improper installation photo is attachedShingles are not even nailed down and no felt paper and huge gap where is was not done properlyI have a statement from another roofing contractor that states the improper installationI was also informed my contract says new metal edging would be installed and there was no new metal installed at all. Sir, First and foremost I would like for you to look at your contractWe never agreed to do anything on your chimneyYour chimney was not even mentioned in the contract or in verbalSecondly, my company did not do anything to your ceilingYou spoke to one of the guys that work for me to see if
he could fix your ceilings as a side jobMy company had nothing to do with thisThird, my company phone number has not changed and there is no record of you calling our company to tell us anything good or badI encourage you to consult with your legal counsel if that is what you feel necessary and I believe that they will tell you the same thing that no chimney was mentioned in the contractFinally, I want you to know that as a past customer we do value youOur number is the same today as it has always been. *** If there is something that we owe you, or something that we need to fix, I would encourage you to call that number so that we can get a technician out to make any adjustments neededThank you

The customer did get ahold of me back in Octrequesting an estimate on a new garage constructionThis is trueAt the time that I came out and met with the customer we had told them that it was the end of the season and that if we could get them signed up that day, we would have their garage built
and ready for them to use by New Years as long as the weather allowed for it.The Customer contacted me and we physically signed the contract on the date of 12-7-They did give a deposit on that date for the work to be completed.The customer is correct, I did not mention how many customers we had signed up since we had spoken back in OctoberIt had been months since we had last spoken about a timeline and no timeline was givenWe informed the customer that we were dealing with the weather and that we had a couple of other jobs that we were working onNo time line was written or verbally given to the customer at the time we signed the contract and took deposit.The water table in the area due to all of the rain had slowed down production on other customers, it was and continues to put us behind on workI understand that we had some dry days in between, but building a garage from the footers to the finished product is not a quick thing.The customer reached out to me on numerous times asking about timelines to which I responded numerous times that we were working with our other customers and I tried to reassure them that they were in fact in lineThe customer contacted me via text message, phone call, FacebookThe husband and wife both made contact with me and each and every time I reminded them that we had not forgotten them and we would take care of their garage just as quickly as possible.I made a post on Facebook that was saying, how grateful that I was that the weather was starting to balance out as we were behind on some work and really wanted to get caught upMrs*** made a comment on the post stating that she really hoped so as they were ready to get their work completed.My problem with the situation is thisWith the weather, customers, employees and current work load it is already stressful enough without having someone asking you every couple of days when we were going to get started on their projectWe have earned an A+ rating with the Revdex.com and that should be all the proof that the customer needs to know that they are in good handsNot to mention the dozens and dozens of garages we have built around Owensboro and surrounding counties.Owensboro *** was created separate from Owensboro Roofing Company and has absolutely nothing to do with this complaintOne has nothing to do with the other and it is nothing more than an assumption of how or why Owensboro *** was created.I have not bullied anyone in this situationI am prior service military and have a tendency of being blunt when I speakIf you look at the above complaint you can see the use of words being capitalized all the way through with the use of multiple !!!!!!! throughout the way that you are speaking to meThe same way that I have asked you to be patient with me then is the same way that I would like you to consider how you are speaking on this complaint. You did tell me not to contact youI do not know how or why this escalated to the point that it has nowi was very patient with you as I waited for months for you to get funding, weeks for you to get the necessary steps done in order to even get here where we are now and in the dead of winter with other customers that signed up before you I am having to defend myself with the Revdex.comThis is why I said to you that you were being unrealistic and unreasonable.
