Complaint: [redacted] I am rejecting this response because: The Vehicle is driven by both Mr [redacted] and Miss [redacted] They placed a second zip tie to replace the first one that was originally there, we have pictures to prove thisThe company is either admitting that they do not actually check the vehicles they sell to make sure everything is working correctly and no "jimmy rigs" are actually on the vehicle or they are admitting they sold the vehicle knowing that this piece was in fact broken and a "jimmy rigged' to stay on long enough to get it off the lotEither way this is negligence and they are liableOnce again we have proof that there originally was a zip tie holding the piece in placeWe are not asking for an outrage solution, we had not asked for one when we came there that Saturday Regards, [redacted]

We are very sorry to hear that Ms [redacted] is currently happy with her vehicle After much research to her account, this is what we have found:Ms [redacted] purchased this vehicle on 5/7/166/10/16: She called to complain that her oil was low and she was promised a light to be fixed at time of sale Even though there was no sale promise, we advised her to bring it in and drop off She never brought it in.6/27/16: She called to complain that the gas needle did't rise up or down and the vehicle didn't accelerate properly She was advised to drop the vehicle off and she advised she would have her son bring it in She never brought it in.7/5/16: She dropped the vehicle off because the vehicle makes a noise when going over MPHThis ended up being a tire noise and that is not a service we provide She was advised to pick it up and replace the tire.10/18/16: She called and said the starter went out on her vehicle This is not an item covered by our Used Vehicle Limited Warranty, which was given to Ms [redacted] for no additional cost We told her we would allow her to pay 40% down and finance the rest for her interest free She never brought it in.3/1/17: She called and said that her vehicle will reduce engine power and then turn off Advised her to drop the vehicle off ASAP She waited a week and dropped it off 3/7/ We currently believe it's the transmission control module, which is also not covered We sub contracted this job to another shop that we use frequently because they specialize in transmissions Unfortunately, they are backed up and that has caused some delay Ms [redacted] called and informed us to stop the evaluation on 3/14/17.As far her note being sold to a Finance Company, nothing changes except where she makes her payments to Her contract and payments stay the same and she is given an opportunity to help build her credit through a very reputable finance companyUsually, are customers are thrilled when given this opportunity.Unfortuntately, vehicles are sold as itAll Sales Final Owings Auto feels as if we have provided multiple opportunities to help Ms [redacted] and several times failed to bring the car in This is a used vehicle and things like an oil change or tires are wear and tear and are not covered my our Used Vehicle Limited Warranty but we try to accomodate to our customers byt allowing them to make a down payment and pay out the repairs in low payments with zero added interest.We will not be able to refund Ms [redacted] any of her money She has had the car for almost a year at this point and when she has called to complain, she has only ever followed through twice with bringing it for us to even verify the issuesThank you, [redacted] (I did receive a message from her this morning which was from 3/14/17, but her phone hung up half way through and at this point, she hadn't left a number and she never called back to finish the message or leave a number.)

To whom it may concern,It took me a while to find which vehicle this was pertaining to as this vehicle is not in ***'s name. This makes it a straw purchase which is against the law. In regards to her complaint, the vehicle was purchased on 12/27/17. The complainant was in the
office when we opened on Saturday morning complaining of transmission problems. We towed it in for her, free of charge and advised her that our shop is not open until Tuesday with Monday being a holiday. Our tow truck driver advised that he recognized the problem and that it was a linkage problem. We temporarily fixed the problem with a zip tie so that she wouldn't be without the vehicle because she said that she couldn't be without one. We advised her that we would order a new part and fix it for her. The vehicle is here today and the part has been ordered. WE are at the mercy of parts being delivered but are doing our very best to get this resolved as soon as possible.As we are very sorry that this has happened, it is a risk of buying a used vehicle. Since we have met our obligations according to our contract, Mr***, the legal/registered owner of the vehicle, will be required to pay the remainder of his down payment as well as all payments on his vehicle.Thank you, ***

Every vehicle is checked out thoroughly before it is put up front for sale. We have been in business for over years and you do not get that far by " jimmy-rigging" vehicles. The zip tie was a tempory solution that they were made aware of. The part was delivered Wednesday and they have yet to drop the vehicle off. We do not feel that this needs any further response. We have done everything we can do as quickly as we can do it and it this point, it's up to them to drop the vehicle off so it can be properly repaired. Thank you,

I am rejecting this response because: I do not agree with the response from [redacted]. The response from the Business to the BBVA complaint is the most communication I have received in the past year.I have never been informed of any of the issues referenced on 07/05 or 10/18 at all. I was told " the mechanic drove the car and did not hear any noised or experience any problems so he cant find what is wrong with it."  This last time that I took the vehicle in 03.14: I have called every other day and have been given no information as to what is wrong with the vehicle. Reading it in Mrs. [redacted] response is the first I hear of it. Each day that I called and asked I was told the same thing" They cant find what is wrong with it. As soon as I know I will let you know"  I also requested on 03.14 to  stop the evaluation because of course it was not under warranty. I find that very strange as I originally called 03.07- Owings had about a week to check my contract and let me know if it was covered or not. I asked if it was covered on 03.13 and finally 03.14 I was told that it was not. What was going to happen? Were they going to do the work then expect me to pay the repairs without even showing me an estimate? I am extremely shocked at her response and lack of concern. I have never NEVER been informed of the opportunity to finance the repairs. I also do not feel it is fair to the customer to have to absorb the costs when I have not even had the vehicle a year. The problems started after a month of having the vehicle. I asked for the inspection report on the vehicle and was told Owings does not inspect the vehicles prior to sale. I purchased the vehicle with the security of feeling that what I purchased was a reliable, safe vehicle.The only reason I did not take it in the times that I said I would was because I did not have alternate transportation or the resources to rent a vehicle. Owings Auto does not provide a loaner vehicle as their insurance policy does not allow them to. I have had to leave work an hour and a half early each day and pay for transportation for my son and I for the past week 9 days. Since May till March 2017- I have had to replace the battery, 3 tires, the headlight, and had to do an oil change the first week since it had no oil at all.  I am very discouraged with this all.  Many used car lots will still work with the customers when dealing with repairs or at least offer customer service or concern. I am just another sale to Owings then passed on to a company I have never heard of. It truly saddens me that this is how much Owings values me as a customer.

Please enter your reason(s) for rejecting the business response below.The explanation given by Owings Auto only supports my claim and soon to be lawsuit. They admit to the 3 month 3000 mile warranty, as well as the problems starting two days after the suv was purchased. The problem is the same problem that was occurring two days after the suv was purchased is still occurring to this day. Every repair that is done at Owings comes with a 90 day warranty therefore the repairs as well as the issue was and is still under warranty. Owings does have a finance company that has the authority to place customers in other vehicles. I worked with [redacted] for more then three weeks only to be told they would not do this because the problem was fixed. Owings is right in regards to the repairs that were done (water pump and relay) were removed from my account, mostly because they did NOT fix the problem, therefore there is no reason for me to pay for a repair that did not fix the overheating issue at it still exist. I supplieed owings with a video showing the fan issue, overheating issue, and coolant leak issue all of these issues were displayed on 6-5-15. What is also interesting is there mechanic ([redacted]) claims that the wiring in the fan was damaged, however the suv was in his repair shop days before undamaged with the same issue, so not sure how this was caused by myself or anyone else (no one else messed with the suv) My request to Owings was to be removed from this suv and placed into something that is actually operable. They have denied this request and have not honored the warranty on the suv. I do understand it is used and therefore as is, however the warranty for the overheating issue started on 6-5-15, and since it was not fixed held a 90 labor warranty that continued. Since my last discussion with Owings (I am still waiting on a call back) I still have not fixed the suv has Owings is unwilling to modify payments. At this point my issue is not resolved as the only thing they have done is allegedly written off the service contracts and pushed my payment out two weeks. My intentions are to move to arbitration and/or resolve this issue in Civil Claims.
