If it makes Ms [redacted] feel any better, I am the GM of Oxendale Kia as well as the owner, so she is dealing directly with the owner and GM I don't know what the mileage was of the other Kia that I referred to in my first response that had a clutch failure, I just know that it was currently under warranty and the repair was not covered by KMA I don't believe that I am disagreeing or arguing with Ms [redacted] about her situation, I am simply explaining how Kia warranty works and my past experience with Kia's warranty policies Oxendale Kia is an independently owned and operated auto dealership, we are not an extension of KMA, nor does KMA have any ownership in Oxendale Kia We are simply a franchise dealer held to the Sales, Service & Warranty Policies set forth by the factory (KMA) Oxendale Kia does not take responsibility for the quality of Ms [redacted] vehicle as we did not manufacture it or sell it to her Oxendale Kia takes responsibility for the repair we performed per Ms***'s authorization Ms [redacted] was not "forced" to do or pay for the repair at Oxendale Kia, she agreed to it and authorized it We at Oxendale Kia wish we could have done the repair under factory warranty but we were not authorized by KMA to do so Oxendale Kia did not take advantage of Ms [redacted] and Oxendale Kia will not reimburse her for the repair we performed under her authorization If Ms [redacted] believes the quality of her Kia vehicle or the clutch is unacceptable, then her complaint would be with Kia Motors America.Sincerely, [redacted] Oxendale Kia

I believe that Oxendale, has advertisement and the company should not make promise toward their advertisements if they cannot follow through with themI referred two family members and was told I would get a referral payment sent to me After the 2nd year of continues follow ups, they tried to cover up with other excuses Oxendale got two vehicles sold and commissions were made off the sale and a simple $check should not be an issueI fully believed in referring people to them, thinking they were very honestIt was easier for them to sign someone to a 15-thousand dollar contract I may be making a big deal over something small, but a person's word does mean a lot, specially when they stand by it

I'm sorry to hear about Ms [redacted] troubles with her Kia Soul It is unfortunate that the clutch needed to be repaired after 34,miles As a Kia dealer we are held to a very lengthy and strict set of Warranty Policies and Procedures from the factory, Kia Motors America (KMA) that we must adhere to in order to conduct warranty repairs Sometimes we must also receive authorization above and beyond the warranty policies from our District Parts and Service Repin order to conduct a warranty repair It is always our first priority to get authorization for a warranty repair on a customer's vehicle instead of having the customer pay, because then we will have happier customers There have been many instances over the years where I wish Kia's warranty policies were less rigid so that we would be allowed to do more warranty repairs for our customers This is not the first time that a clutch repair in our shop with a vehicle still covered by factory warranty was denied warranty coverage on the clutch It is my understanding that KMA classifies a clutch as being a maintenance item, therefore when a clutch needs to be replaced it is not considered a failed part, but instead a worn out part that requires routine maintenance replacement I apologize if my service manager came across insulting to Ms***, but he is not the one that denied her warranty repair He simply examines the vehicle and then seeks to get authorization to conduct the warranty repair, which is our first priority If Ms [redacted] complaint is warranty coverage or the quality of the product, then her complaint would be with KMA not Oxendale Kia We simply repaired her vehicle per her authorization because we could not get authorization to do a warranty repair Furthermore, my service manager would not ever be able to provide you with a loaner car as our insurance company does not allow us to provide loaners Had your repair been covered by warranty, KMA would not necessarily have provided you with a rental as it is often not included with the repair Once again, I'm sorry to learn of Ms [redacted] unfortunate situation But I fail to see where Oxendale Kia did anything wrong and thus we will not reimburse Ms [redacted] for the repair that we completed.Sincerely, [redacted] Oxendale Kia

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Maybe I should have asked to speak to the GM of the location.  I was too exhausted at this point to even think of this though.  If my car hasn't been the only one brought in to have a clutch replaced at 34,000 miles, there's obviously a problem with the clutch designed for the car....NOT the cause of my driving...  I've driven standard transmission for years, even as a kid on a motorcycle.  I don't have to think about "how to shift" when I'm driving.  KIA, even if it's brought up to the attention of the manufacturer of the car, should be responsible for paying for replacement when it fails at an unreasonably low point of miles.  If this clutch failure would have happened in a high traffic area, & I would have been other vehicles, like semi, I would have been killed.  There would have been absolutely no way to get out of traffic safely, as when the clutch went out, it went out completely.  I was fortunate that I was in an area that this didn't happen, but I also temporarily work up in an area where there are no resources like rental cars or anything many consider normal to have in town.  So if this particular location doesn't take responsibility, do I put the main company of KIA in the spotlight of the Revdex.com?  I still feel like I was forced to pay for something that I shouldn't have & had no control over the situation, & it wasn't like it was just a couple dollars.  The car was in a condition that it couldn't be driven, & I still feel taken advantage of.  Anyone who knows standard transmissions knows that a clutch should not be failing at 34,000 miles for any reason, unless there is a problem with the car.  I still want a refund, from KIA, even if it's from the location that made the car....It's not right.
