Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is satisfactory to me Regards, [redacted]

Tell us why here[redacted] has been told all he has to do is send in a cetified letter with his name , date and state he needs to cancel...it's so easy a 5th grader could do itIts hard to charge him for his membership when his monthly dues constantly come back NSF....He has a long history of payment problems, and like most try to blame the gym for their lack of paying or budgeting their financesHe has instructions, and we cant make him follow directions, so he has chosen to go through the Revdex.comI believe as of right now he is currently past due once againWe have no problem printing up a payment history showing his long history of nonpaymentWe do the business owners go to complain about the lack of payment from customers? Especially when it's their own fault, but they want to play victim and contact the Revdex.com

Since [redacted] has stated she sent in a certified letter to cancel, we would need proof of the signed return receipt she received back from the post office showing when the letter was delivered by the mail carrier and received and signed by an employee at the gymAll cancellation letters are required for that very reasonThey show proof that someone is cancelingHow are we suppose to know if someone is canceling without being notified by them? Certified letter is required, because the mail carrier has to hand deliver and get a signature from an on duty employeeThat way the are no question it was received Oxygen Fitness is NOT responsible for the mail carrier not doing his jobOnce ***, was told what to do that is the end of the storyIf she chose to stay on the phone and argue with someone after hearing instructions, then that was her choiceShe did contact Oxygen Fitness during prime time hours and at the busiest time if the yearCalling back again would only be for her to argue about what she was already toldAnd that was on herInstructions were given, she didn't like them, and wanted to argueAny company has the right to get off the phone with someone arguing with them to tend to the current clients at hand

Complaint: ***
I am rejecting this response because: I have attached two documents You can clearly see in the USPS screen an attempt has been made by the post office to deliver mail Anyone can search out social media and read about an apparent common business practice of claiming not "receiving" a letter in order to change additional monies. In the second attached, a portion of the contract is included One can clearly read that the portion of the contract that says "paid in full membership" does not include an automatic renewal In clearly states it is only renewable The portion of the contract that is not applicable to me is the monthly membership, the section does detail an automatic renewal however, once again it does not apply to my contact as I paid in full as it is stated on the contract Nowhere in the contact that applies to me states an automatic renewal As *** stated rudely to my wife when called, you must be an "it" to not notice the distinct difference between those two memberships I should not have been automatically renewed nor required to make written notice as the contract clearly states my portion was renewable not automatically renewed I was simply attempting to remedy the situation by giving written notice, however due to the way *** has handled this situation, I wanted to also show the Revdex.com another former client that is having issue with how Oxygen Fitness has avoided receiving certified letters and fraudulently charging for automatic memberships.
Regards,
*** ***

We have not recieved a cancellation letter via "certified return reciept mail" as stated in his contractThe contract states that it will automatically renew UNTIL a certified return reciept cancellation letter is recievedThe State of *** REQUIRES that all cancellation letters are sent via
this manner , because the mailman MUST hand deliever the mail and get a signature from an employee presentWe are ALWAYS present and have not had the mail man walk in any mail to usSo Mr*** needs to take up issue with the *** post office as to why he paid more $ for this service that was NOT renderedFurthermore as stated in Mr***s contract it automatically renews until we recieve a cancellation letter as described aboveWe do not have any way of knowing if he cancelled with out it and the $ is owedHis contract also states that "no employee of Oxygen Fitness" can cancel his contractSo his personal delivered letter , which we have not seen, is no good unless sent via certified return recieptNot to mention we cannot cancel a contract with a past due balanceSo until he pays off his balance his bill is adding upTime is of the essenceHe needs to take care of this problem in a timely manner as soon as possibleIf he has already been sent to collections then he will have to deal with the collection company

Since [redacted] has stated she sent in a certified letter to cancel, we would need proof of the signed return receipt she received back from the post office showing when the letter was delivered  by the mail carrier and received and signed by an employee at the gym. All cancellation letters are...

required for that very reason. They show proof that someone is canceling. How are we suppose to know if someone is canceling without being notified by them? Certified letter is required,  because the mail carrier has to hand deliver and get a signature from an on duty employee. That way the are no question it was received.  Oxygen Fitness is NOT responsible for the mail carrier not doing his job. Once [redacted], was told what to do that is the end of the story. If she chose to stay on the phone and argue with someone after hearing instructions,  then that was her choice. She did contact Oxygen Fitness  during prime time hours and at the busiest time if the year. Calling back again would only be for her to argue about what she was already told. And that was on her. Instructions  were given,  she didn't  like them, and wanted to argue. Any company has the right to get off the phone with someone arguing with them to tend to the current clients at hand.

Tell us why here...[redacted] has been told all he has to do is send in a cetified letter with his name , date and state he needs to cancel...it's so easy a 5th grader could do it.... Its hard to charge him for his membership when his monthly dues constantly come back NSF....He has a long history...

of payment problems, and like most try to blame the gym for their lack of paying or budgeting their finances. He has instructions, and we cant make him follow directions, so he has chosen to go through the Revdex.com. I believe as of right now he is currently past due once again. We have no problem printing up a payment history showing his long history of nonpayment. We do the business owners go to complain about the lack of payment from customers? Especially when it's their own fault, but they want to play victim and contact the Revdex.com.

The [redacted] post office is not bring in the returned receipt certified letter into the gym.....they will drop off our mail in the mail box, but are not walking the certified letters to be signed by an employee to show proof it was recieved. Mr. [redacted] PAID for this service and it is REQUIRED by the State of [redacted] to show proof to both parties it was recieved. He will have to take that up with the post office. We can not do their job for them, especially since the customer is paying for it. Right under his contract it states ,"membership will automatically renew and continue until a 30 days written notice is received by certified return receipt mail". If Mr. [redacted] would like to bring in his copy we can read it with him so that he understands the wording correctly.
