Up to now, I have not heard anything from Oz Auto Body
& Towing. They have all the information they need from me. We are 5 city
block apart, from my house to their business. They have my phone numbers,
cellular and home number, but they had no try to contact me.
If you can send me a letter of your disposition
regarding this case, I may be able to approach them and try to get some results.
As it is, it looks like Oz Auto Body & Towing has no
intention on fixing their error.
Please let me know what I should expect as a result of
this complaint.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:
On March [redacted], 2014, about 10:45am, I was involved on an
automotive accident (See copy of the Police Accident Report). The accident
happed on city streets within NYC limits.  After exchange of information with the police,
I was told by the police officer that I have to use the towing truck service
assigned to the accident and not one chosen by me. It is supposedly a regulation,
even if I knew that I can get a better deal with my own mechanic.
The assigned towing was from a company located only 5 city
blocks from the place of the accident and six city blocks from my house. It
seems very convenient.  
OZ Autobody Inc. issued me a receipt, after my car was
already on their truck and ready to move. On it, there is a charge of $125 fee
for towing. There are printed notes of additional charges for if: “each
additional mile or part $4.00”, “Storage: $25.00 per day for the first 3
calendar days and $27.00 for any additional day”, on the back “A Towing company
may charge a fee of up to $25.00 for positioning your vehicle so it can be
towed away by the tow truck of another company that is using a tow truck
capable of towing three or more vehicles simultaneously” (see note on back of evidence #1), “Required tolls”,
“(again) $4.00 per each additional mile or part thereof within city limits”, “Other
charge: (???)”, “NYC taxes at 8.875%”
I went, all the way to their office following my car and I
asked the [redacted], to give me an estimate to fix my car as soon as
possible. I gave him all my information, including my cellular phone.  He never called me. On Friday, March 14, after
picking up the accident police report, I went by the shop, to find out if the
estimate was ready and make a decision of what to do with my car. The estimate
wasn’t ready, [redacted] asked me for another day, (It was Friday and I was already
paying $50 for the 2 days of storage), so I told him to call me with a number,
because I needed to make a decision before the end of the day. I have to go to
work, so I let my wife in charge.           
      
My wife went to the shop, later in the afternoon and she was
given a verbal estimate of more than $4,800. Nothing on writing and nothing on
specific, I was just an approximation, but not conclusive. So the final price
could be whatever they wanted to be. My wife had contacted another shop and
requested the car to be removed immediately. 
The unspecified bill from OZ Autobody, came to $408.28
(Credit Card Payment # 3). Following the original receipt, it should have been:
$125.00 of the towing, + $50.00 for the 2 days of storage +$15.53 NYC Taxes,
for a total of $190.53. There are no other specified charges any were. My wife
had to pay or they refuse to let the car go. She has to take the car, for one
more day will be an additional $25.00 and who knows what other charges. She
paid, but she was given nothing more than a credit card receipt without any
specifications of what was she paying for.
I went back on Saturday (3/**), but I was told that [redacted],
the [redacted] will not be in until Monday. So, I returned on Monday the [redacted].
I asked [redacted] for a detailed receipt and explanation for a charge of $408.28
towing. He gave me one (Evidence #2) and explained the following:
Original Tow: $125.00; Re-hook to take the car out of his yard into the
street: $125.00. He insisted that he will not allow any
other licensed tow-trucker to go into his yard. The tow truck, that took my car
from that place to the other shop, charged us only $75.00 (evidence #4).
Precision Collision Auto Body’s Tow Truck’s License allowed them to pick up a
vehicle anywhere in NYS and they are insured. There is no logical reason for
not allowing that tuck to pick up my car; unless they just want to charge the
additional $125.00.  [redacted] completely
ignored his on note on the back of his original bill: “A Towing company may charge a fee of up to
$25.00 for positioning your vehicle so it can be towed away by the tow truck of
another company that is using a tow truck capable of towing three or more
vehicles simultaneously”  The tow truck that carried my car
away, was capable of carrying only 1 car at a time, so I was exempt from paying
any money to remove my car.There is a charge of $25.00 for labor. Why?
There was no labor done in my car at all! They already charged the towing! There is also the storage fee of $25.00 per day
($50.00). There is an additional charge for the use of the
yard  another $50.00RIDICULOUS! They are charging double rent.
They already charge the $25.00 per day for storage, where else can the storage
be, if not on the yard?  The subtotal at: $375.00 Taxes: 33.28 for a Total: $408.25
I took my car to Jamaica Complete Auto Collision and in only
20 minutes we got an estimate of $2,400 to fix my car (evidence #5), and they
did the job in less than a week.  Going
back to OZ Autobody, their verbal estimate came to $4,800 after 3 days of
holding my car and their assurance that the insurance will pay. With the way
they bill, it surely is insurance fraud, what they do. OZ Autobody overcharges
their clients and our insurances.            
I want a refund of (408.25 – 190.53) = $217.72 and an
explanation for why can’t I use any other towing company at an accident? The
towing company that we used to remove the car, charged us only $75.00 for 4
miles.  Really, I shouldn’t have paid
more than $75 for the original towing, because I have the right to hire who
ever I want and not one imposed. I want an additional $50.00 to cover the
difference.  This is America and I should
be able to hire who is willing to offer me a better deal. Also I would like an
investigation of the business practices of OZ Autobody, how can they get away,
getting assigned as the towing company for accidents, overcharging the clients
and our insurances?
The case is not resolved until I get my money back.

There are no other specified charges any were. My wife had to pay or they refuse to let the car go. She has to take the car, for one more day will be an additional $27.00 and who knows what other charges. She paid, but she was given nothing more than a credit card receive without any specifications of what was she paying for.Desired Settlement: I want a refund of $186.17 and an explanation for why can’t I use any other towing company at an accident? The towing company that we used to remove the car, charged us only $75.00 for 4 miles.

I would like an investigation of the business practices of OZ Autobody, how can they get away with getting assigned as the Towing Company for accidents, overcharging the clients and their insurances?

Review: Oz Auto body Inc. is charging 10x the average rate to repair my vehicle if I don't pay they will charge me $850 in storage fees and although they accept credit cards they will only accept cash for the repair I was forced to accept. The [redacted] insurance company is giving me $761 to repair my back bumper and tow hitch. They are charging $761 to fix a brake line. Normally a $100 job.They are not repairing anything on the [redacted] estimate but yet want the whole amount. they never notified me about the car being estimated. I could not get an answer on the phone I had to drive to the shop on Friday they dint give me the price till Monday via phone.Again they are FORCING ME TO PAY CASH!!!!!!! They accept credit cards just not mine as they know that the value of the repair is ridiculous. I was abused over the phone verbally by the owner when I asked when I could pick my vehicle up. He said "[redacted] COME AND GIVE ME MY $850 AND COME GET YOUR PIECE OF [redacted] OUT OF HERE. I NEVER WANTED IT HERE IN THE FIRST PLACE". But yet that was the only place his tow truck would take it called by the new york city police dept.Desired Settlement: I would like to have used my credit card instead of paying cash. I also would have gotten a fair price and not raked over the coales. they failed to notify me when [redacted] came they made me go there. they would not give me info over the phone. and they forced me to pay cash so I couldn't dispute the charges
