This message is a reponse from Oz Powersports concerning id 12580687.Our customer *** *** called and ordered a gas tank for his Artic Cat atv. We explainined to him that Artic Cat is a company who does not always use the same parts (they have many different suppliers and have been purchased
by another company named textron) and that we could supply a gas tank for him but that it could be wrong and recommended that he send his old part to match. He declined to do this. We explained that the vin # from his machine would not help us to determine if his part would be correct. We did ask Mr*** for his year/make/model/cc and pulled the exact part for him off the exact same model in our inventory. Mr*** asked all our return policies (this are listed on our invoice and are listed below also)No returns or returns on used partsNo returns or refunds on electrical or special ordersNo returns or refunds after daysReturns on new parts subject to 25% restock fee,He then decided to have us ship the item to him. We explained to him that is this part was not not what he needed, he would have to send our part plus his old part back to us, which he agreed to because he did not want to make the long drive into our business. Mr*** received our part, called us, and we reinformed him of our policies and that he had gone past the day period to return his part (he received his part on 9/13, and called us on 10/to try to return it). Going above and beyond for our customers has made us the largest mc/atv salvage in the US, so in his case we suggested that he send his old tank back to us along with our tank and we would see if we might have another tank for him. Mr*** agreed that he had gone beyond time to return his part, and agreed just to resell his part we sent to him (as he agreed in his statement that he tried to resell his part we sent him). After not being able to resell his part immediately (not our issue), he then called us back and was very very rude to me (Brad), talking over me not wanting to listen to anything I said. He then repeatly called back several times in a row, asking for the manager (even though I had told him I was the owner, evidently not believing me). Even though he was treating me terribly, as a last ditch effort I offered him store credit on any used part (which is not our policy) to try make him happy, but he refused to be civil. I resent just because he made a decision to keep his part and resell it that I am being called a crook (which is not true). Mr*** has made his decisions, and will have to honor his decision to resell his part and Oz Powersports will not subjected to any more mistreatment from him. We suggest in the future that Mr*** doesn't try to take advantage of any other businesses return policies and treats people more fairly. Oz PowesportsBrad

Complaint: 12580687
I am rejecting this response because:
There are many inaccuracies in this response.  When I initially called to order the gas tank, there was no explanation of how Artic Cat changes parts and to send the original gas tank first to match.  I did not ask for the return policies at that time, for I was led to believe there wouldn't be any problems. We also did not have any discussions about myself not wanting to make the long drive to his business.  On the initial call I was told they would look for the needed part and would ship to me if they found. I asked if they would call me if they found the gas tank I needed. Was told no. They would take my credit card # and would only charge it if they find the part and then ship.  I was a little hesitant providing my credit card # first, but went along with it.  After a week, I noticed nothing was charged to my credit card.  Called and spoke with Brad, was told they did find the gas tank and would be shipped that day.  Again, nothing mentioned about possibility of being a wrong gas tank or there refund policy.  Invoice date was 9/13/17, received gas tank around 9/20/17.  Called dealer and set install date of 10/11/17. Once taken to dealer on 10/11 is when it was found the gas tank was wrong.  Called Brad on 10/11, this is when I was told about Artic Cat having different suppliers for parts.  This was also when he suggested I send the original tank back with the wrong gas tank so they can match.  I already spent $45 for shipping and was hoping Brad would work with me on shipping charges for sending 2 gas tanks back to him and then another shipping charge if he found the correct gas tank.  Brad stated it wasn't his fault Artic Cat had different suppliers.  Was told he couldn't guarantee they would have the matching tank, but is one of the largest salvage dealers in the area.  I was hesitant to pay for more shipping charges based on the information I had at that time.  On October 18th, the dealer that was servicing my 4 wheeler was able to locate a used gas tank for $125.  Called Brad again, he would take gas tank back but would still charge the 25% restocking fee.  Stuck to his original statement not being his fault. There was no mention of being past the 10 day period, nor did I acknowledge knowing I was beyond any return period.  Only thing I was told, was if I decide to return the gas tank I would need to call back to get a PO # to return the part.  After trying to resell the part, found the $275 I paid was the price of a new tank and a fair price was closer to $125.  When I called on 12/27/17, learned something new again, I could only get store credit.  I only became rude after being treated rudely and being talked over by Brad.  How Brad was handling the situation, still hard for me to believe he could be in any managerial or owner position.  I never received the "going above and beyond for customers" treatment as Brad claims.   Nothing was Brad's fault and never willing to compromise on a solution. Here are my issues and compromise:     1. If I was told upfront there was a possibility of not being able to get the correct part, I would have sent the original tank the first time. I was only asked the year and size of 4 wheeler. I supplied the correct information to Brad.  It wasn't until I had the wrong gas tank of when things were fully explained to me. It now became my problem and having to pay all costs to fix.      2. I take full responsibility of not asking the return policy up front and not researching what a fair price on a used gas tank is.  There is obvious miscommunication or lack of communication throughout this process.       3. I'm still hoping for a resolution and work with Brad.  I already paid $45 for shipping and will pay for shipping charges back to OZ. I will also pay the 25% ($68.75) restocking fee. I do not want store credit though do to obvious reasons stated in this complaint. That puts me at a $113.75 loss already, plus the shipping charges back to OZ.  If Brad goes above and beyond like he stated, thinking this is a very fair compromise. It's not that I'm asking Brad to take back a gas tank that was the correct size. I'm asking him to take back a part that is was wrong from day 1.
