On July 15, 2019 we sold and closed on our home. We spoke to our realtor and she told us we will be receiving a 1099 tax form and other forms. She told me to call her if we did not receive it. I called the realtor to let her know we did not receive the form. The realtor called and told the business that I did not receive it. They explained to her that they sent it out. The realtor said the company did not keep records of the transaction. They would need $75 to file something and to send the documents I have requested.

When a property is sold and a 1099 form is required, our company has each seller complete a document titled "Substitute Form 1099-S Copy." The seller's name, address, TIN, and property address are the items needed on the form. Our company then sends this information to a service who in turn reports the information to the IRS. When one of the *** called the realtor because they hadn't received their 1099's (each one has a trust that sold property, so 2 1099's were completed). The realtor then contacted me, asking what address was on the 1099 signed at closing. I read it wrong, but then later confirmed it was sent to the address on the form. I contacted my general manager who reports this information to the service, to double check the address and to make sure their 1099's had not been returned. She confirmed the address on both are correct and that nothing had been returned to her. Mrs. Balitmore then called me to complain. She was very upset that she had not gotten the forms, it's very important to distinguish East or West in the address (both have "East" on the document), and now someone has her SSN. I told her I had checked with our manager, who confirmed that the forms were sent to the addresses printed on the form BY THE ***. (making it clear, I didn't put the address on the forms, they EACH put the address on his/her form) I told her that our manager said a duplicate could be sent, but the service we use charges $75. This $75 fee is NOT our fee, it's the fee for the service we use. *** told me that fee is too much and we should provide the form for free. *** did not seem to grasp that I am not, nor is my company, responsible for the US Postal service delivering or not delivering the 1099's. I have no control, nor does my company, over the US Postal Service. I spoke with the realtor after my conversation with ***, who confirmed that she, (the realtor) had spoken with ***. The realtor asked *** if she'd ever gotten someone else's mail, to which the answer was "yes." (We all have.) I understand her frustration, but fail to see why my company is responsible for delivery of her mail, since the address the documents were mailed to is correct. As for "the realtor said the company did not keep records of the transaction" - that's a false statement. I keep copies of the 1099s filled out at all closings. The $75 fee to "file something" - again, false. The $75 fee is to re-send the 1099.
