They were absalutely no service to me so the deposit is legally bound to be returned to meSo, NO I am not satisfied and want my deposit backI have embedded the contract below.The services of P Four will consist of interior design, space planning, and procurement of goods and services related thereto These include but are not limited to designation of finishes, color and paint schedules, floor and wall treatments and coverings, lighting and hardware for the purpose of ascertaining that approved plans and specification be completed with Presentation boards will be prepared and presented It is understood and agreed that the total budget for the project is: $25,A deposit of $15,is required upon signing of the agreement and will be credited towards the final invoice Further deposits may be required if the total budget is increased by the clientUpon written acceptance of this letter and receipt of the retainer, we will proceed with the various plans, finishes, color schemes, etcfor presentation to you As selections are made, we will provide you with detailed proposals for each selection Selections quoted become purchase contracts upon receipt of your written approval and are not cancelable Any deposit requested will be noted on the detailed proposal and payment in full required before delivery All purchases for goods and services are subject to the express terms of the individual quotations and or contractsProjected delivery dates are those provided to us by the vendors of goods and services While we do our best to insure that these dates are met, we cannot guarantee them In particular, delivery of fabrics and goods sent from overseas can be subject to delayAll billings pursuant to this letter are due upon receipt of our invoice or as otherwise stated in the agreement Any invoice or other charges that has not been paid in full, after your receipt of an invoice, is subject to an additional charge of one and one half percent per month on the unpaid portion of the invoice until such has been paid The undersigned client will pay any legal and/or collection fees incurred by P Four for the collection of approved unpaid balances due P Four This Letter of Agreement, when signed by both parties, is the basic agreement for services This agreement will remain in effect unless cancelled in writing by either party Upon termination of this agreement, any fees and or balances for design services that have been incurred or executed, and any items that have been contracted for, pursuant to the terms of this agreement, are and remain your obligation All drawings, specifications and documents prepared by P Four are instruments of service for the execution of the work on the project and are the exclusive property of P Four, whether the work on the project is executed or not, and said plan shall not be used on any project without P Four’s prior consentRegards, Terry J [redacted]

I am writing in response to complaint ID [redacted] My team of design professionals and I worked with the client for over one month on the redesign of her condo in Baltimore, MDsent the client a proposal that included our scope of work and our fee of $25,and requested a non-refundable deposit in the amount of $15,which she agreed to and paidOver the course of the next month we held four in-person meetings at the property with the client and contractors, we spent numerous hours in our studio developing renderings to show the new layout and space plan, communicated with Contractors on the schedule and met with kitchen and bath suppliers with the client to make selectionsFurthermore, there was numerous hours spent reviewing the clients inspiration photos electronically and communicating with her via phone and emailIn addition to the renderings mentioned above, we supplied the client with a furniture space plan in [redacted] , complete kitchen specifications and plans, and were in the process of completing the demolition construction documents when the client abruptly terminated us with no warning or communication of her unhappiness with the way things were progressing.The client was very stressed about the construction schedule which was out of our control as the "builder" did not meet their obligation to start demolition and in-fact had still not started demolition when she terminated usWe required some demolition to take place to better understand what structural elements we need to work around in a few areas which the client understoodUnfortunately, believe the client was concerned about our fee and as she indicates in her complaint found another designer to do the work for much less or for free as she stated to me and in her complaint to the BB8, "I've yet to pay her (the new designer) a penny"P Four is a small business and a nationally recognized interior design firm working with large builders and developers and directly with consumersWe have never had a complaint filed against us and pride ourselves on exceptional customer service and a quality productWe had an agreement with the client and she chose not to allow us an opportunity to remedy her unhappiness as we were surprisingly terminated in an email.I would be happy to provide email documentation of all communication, renderings, plans, specifications, etcthat we provided the client so you can see the amount of work, quality of work, and service we provided this clientIt seems highly unfair of the client to demand the return of her non refundable deposit given the time spent on this project and the fact that we provided detailed plans and intellectual property that would enable the client to proceed on the remodel on her own which is exactly why as a design firm we charge a non-refundable deposit,Shawn E***Owner P Four

I am rejecting this response because the client, P Four, owner, Shawn E[redacted], did not live up to their contract.  They never once presented me with anything but skeletal drawings and met with me twice for under an hour so how in the world do they think they are entitled to my $15,000?  They were absalutely no service to me so the deposit is legally bound to be returned to me. So, NO I am not satisfied and want my deposit back. drawings So We Spent numerous hours to provide 3D drawings (not included in our agreement) so she had a better understanding of what the finished home would look like, Our client was aware of what we were doing to expedite the construction process in the event we could not proceed with our plan A, plan B was ready in the sidelines depending on what was found at initial demo. I am concerned that in the complaint our client keeps stating that we were only spent "45 minutes tops" and "for about 30 minutes". There is very little need to spend time in a home that is going to be remodeled beyond understanding the client's vision, setting expectations, etc. The large amount of time is spent in auto cad and in our design Studio Creating drawings and plans. Again, we went above and beyond in providing 3D drawings which she acknowledges as "color renderings" because she had a hard time visualizing and understanding the "skeletal" 2D drawings. 3D drawings are not helpful to a contractor or vendors, we did this solely to help the client understand the layout. I am happy to provide to you both the construction drawings (2D) provided and the 3D renderings provided to the client throughout the process with the many revisions made at her request to ensure her satisfaction. am glad that our client indicates she was upset that we did not respond to her in a timely manner on July 4th. Our office is closed for July 4th and my Creative Director and also took July 5th as a vacation day, Our client began calling our office on the morning of July 6th and was extremely rude and belligerent to the individuals she spoke with in our office, even after explaining that we were closed on July 4th and that Jill And I were on vacation on July 5th. We did meet with our client for several hours at the kitchen cabinet showroom. We have great Success with bringing our clients with us to the showroom. This allows the cabinet vendor to talk directly to the client about price, features, benefits, availability of cabinets the clients may be interested in, AS interior designers we offer advice on color, functionality, style, but can't be an in-depth expert on all components in a home so we utilize the expertise of the vendors themselves when appropriate. Our client was very indecisive in what she wanted and her budget so we thought it best to involve her directly with us in the selection of cabinets given her urgency in Completing the project. This meeting went very well and at no time before, during, or after did our client indicate she would want to approach this process differently. One week following the meeting at the cabinet showroom we provided the client With detailed kitchen elevations, construction drawings, and budgets for the kitchen remodel. Please keep in mind the builder had still not appeared at the property to begin demo so we were well ahead of the game should the builder show up.The most frustrating and disappointing thing to me about this complaint is that at no time did we hear from our client that she was unsatisfied with our process, that we weren't providing her with information she needed, or that she did not want to accompany us to the cabinet showroom. The exception to this is on July 6th when she was upset because we did not respond to her in a timely manner due to the holiday. If the client had been more Communicative about her dissatisfaction we could have adjusted our style and approach. Instead, she fired us without warning or cause and expects her deposit to be returned to her despite the many hours my team and I had spent on the project per our agreement. There are numerous documents including Construction drawings, space planning, elevation drawings, 3D Drawings, etc. that Substantiate the work my team has done and I am happy to send all of that to you. AS previously stated, we had completed 85% of the work in our agreement (plans, Space planning, Specifications) which should justify our retaining the 50% deposit. All that was remaining per our agreement was to provide site visits to check on progress once demo/construction began and to provide paint colors. It is upsetting as a small business owner that one unreasonable individual can have such a negative impact on our company's reputation that we have worked so hard to maintain. This client has taken to the Revdex.com, social Media, attorneys, etc. to damage our reputation. As a small business Owner I feel that I am entitled to the $15,000 deposit I was paid and to retain it per our agreement to cover the numerous hours of work. Please let me know if I can provide additional information,Shawn E[redacted]
