On Thursday March 17 2016, [redacted] contacted P.K. Davis Construction to discuss the installation of backsplash. On 21 March 2016, [redacted] provided a quote for service to install Elida Ceramic Orchid Brick Stone and Glass wall tile in the backsplash of the kitchen at [redacted] XXXXX. The contract was established verbally and via text message. He provided the following information verbally to [redacted], the joint homeowner during the consult:1. He verified the mesh backing of the tile purchased by [redacted] was tile he had worked with in the past and was a job he was familiar with completing.2. He gave a time completion window of a couple of hours and that the task would be easy.3. He could start on 22 March around 5 P.M.4. He would provide a project cost once he had a minute to review the information at home later that night. On 22 March the following quote of $380.75 was provided via text to [redacted] @ XXX XXX XXXX from [redacted] @ XXX XXX XXXX. Per the written text message, the quote includes the grout, mastic and complete tile installation. He also confirmed that if ?the grout sets firmly only about an hour to and hour and a half? would be required to complete the job. The project began on 22 March 2016 around 5:30 P.M. It required two subsequent returns on the 23rd and 24th of March and was not finished within the prescribed timeline. During the performance of the project there were several indicators that concerned the home owners in regards to Mr. [redacted] level of experience with mosaic backsplashes (pictures provided): 1. All tiles are oriented horizontally a decision was made to place one piece vertically because he could not get the piece cut to the exact dimensions required to fill the space. [redacted], [redacted]?s spouse and the other joint homeowner, had to request that he remove and replace the piece. Had it not been requested the tile would have remained. 2. Black lines remain on the tile because a permanent Sharpie was used to draw the cut lines. The tile contains natural sandstone and because of the absorption of the material the lines would not come off. [redacted] and his associate were observed trying to remove the black lines with ?goof off? the following day but the lines remained. Mr. [redacted] said the lines could be removed with his nail. This statement is inaccurate; in order to remove the line you must physically sand away or remove a portion of the tiles surface.3. The tiles have a staggered edge to present a continuous flow and blend the joining of various pieces. However, when presented with the task of placing the tile around outlet receptacles the decision was made to cut straight edge pieces which accentuates the outlet and disrupts the flow of tile as constructed. This is not consistent with a professional installation for this tile type. 4. Underneath one set of cabinets the tile does not reach all the way up which makes it inconsistent with all other areas.5. The starting edge is not straight or flush. Multiple opportunities where provided for corrections to be made based on the feedback of the customer and allow [redacted] to continue. On 24 March the grout was applied to the tile. He left one single kitchen grade sponge with[redacted] with instructions to leave the grout on the tile until noon tomorrow and allow it to properly set. Then take the sponge and Windex and wipe it down. [redacted] said that the remaining grout would just wipe off ?like butter? with the tools provided. At that time and due to[redacted]?s inexperience with the installation of tile a $380.75 check, check #1125, was given to [redacted] by[redacted] without [redacted] present. Upon review of the quality of work completed, [redacted], contacted [redacted] via phone less than 30 minutes after his departure on 24 March to express his level of disappointment with the incompleteness of the project and professionalism of the job. [redacted] contact [redacted] via phone on 24 March 2016 @ and left a message notifying [redacted] of his intentions to place a hold on the check until the job was complete. [redacted] returned [redacted]?s phone call within 30 minutes and expressed his dislike with the message left. [redacted] said that the job was 90% complete and that it is customary to provide payment at that time because he had $150 wrapped up in project. Mr. [redacted] responded by informing him that there was over $350 worth of tile on the wall and he was extremely dissatisfied with the work and expectation that the customer would be required to finish the project. The following morning on March 26th, [redacted] contacted him via phone to notify [redacted] that the grout was not coming off as instructed and that it was as hard as cement. Mr. [redacted] acknowledge that the grout is a form of concrete and that it would require mineral spirits type products to remove it . We were instructed not to touch it to prevent damage to the tile and he would get back with us after the Easter Holiday to complete the project. On March 29, after no further contact, [redacted] sent an email to [redacted] account requesting an update. [redacted], who identified herself as the P.K. Davis bookkeeper responded via email notifying us that his parents were killed in a car accident and she was doing her ?best to get everything scheduled.? As of April 13, 2016 the job remains incomplete. The following attempts were made to contact P.K. Davis:1) Three attempts to contact were made via Text Message on the following dates and time with no response:a. April 6th 2016 @ 8:03 P.M.b. April 8th 2016 @ 5:30 P.M.c. April 12th 2016 @ 7.25 P.M.2) Four attempts to contact were made via Email on the following dates and time with no response:a. March 29th 2016 @ 4:49 P.M.b. April 7th 2016 @ 7:07 P.M.c. April 8th 2016 @ 5:44 PMd. April 12th @ 7:26 P.M3) Two attempts to contact were mDesired Settlement Based on the following summary of event this is official notification by [redacted] and [redacted] via certified mail requesting one of the following actions be taken by P.K. Davis Construction in order to restore the kitchen to its original state and recoup financial loss associated to the breach of contract:1) P. K. Davis Construction personally completing the following:a. Removal of all tiles from the backsplash area. b. Upon removal of the tile, repair any damage caused to the drywall and cabinetry.c. Reimbursement of all tiles that once removed from the wall cannot be reused. Approximately 32 pieces were purchased from [redacted] at $13.98 per tile and 5 remain unopened ($377.46 without tax).d. Pay for a certified home inspector to review the project upon completion to ensure all work performed is in compliance with building codes and standards2) Make payment directly to a third party, selected by [redacted] and [redacted], to complete the above steps list in option 1.
