Initial Business Response /* (1000, 5, 2015/11/19) */
we had some credit fraud at the store and was trying to prevent morethe consumer didn't care about the store situationI don't understand why would you leave the house without ID/Ca driver's licence It's not like the Clerk was asking him
for his social security number
Initial Consumer Rebuttal /* (3000, 7, 2015/11/24) */
(The consumer indicated he/she DID NOT accept the response from the business.)
the merchant in no way, shape, or form addressed my complaint
the merchant responded:
"we had some credit fraud at the store and was trying to prevent morethe consumer didn't care about the store situationI don't understand why would you leave the house without ID/Ca driver's licence It's not like the Clerk was asking him for his social security number."
point-by-point:
the merchant said: "we had some credit fraud at the store and was trying to prevent morethe consumer didn't care about the store situation."
what does the merchant's statement do to address my complaint? nothingit is a self-serving attempt to justify their ill-advised unilateral discriminatory policy that requires customers to provide identification when using their visa cards
further, the merchant is correct I don't care about the situationi am a customer; I am not involved with the operation of the storei have no way of knowing whether the merchant is telling the truth about the fraud, is lying about it, or is exaggerating it so that they can justify asking for identification (which is not a justification, by the way)in any event, if they'd like me to care about and get involved with the store situation then they'll have to hire me and give me access to a lot more informationbut don't worry about that because they are right, I don't care about the store situation
the merchant said: "I don't understand why would you leave the house without ID/Ca driver's licence."
what does the merchant's statement do to address my complaint? nothingit is a self-serving attempt to justify their ill-advised unilateral discriminatory policy that requires customers to provide identification when using their visa cards
further, who the *** are they to tell me when I should and should not leave my house with an id or california driver's license? the only time I actually need a license is when i'm drivingand maybe a license or an id when I go to a barand, most importantly, and according to visa, and the reason for my complaint: I DO NOT need an id when using my visa card
the merchant said: "It's not like the Clerk was asking him for his social security number."
what does the merchant's statement do to address my complaint?
nothingit is a self-serving attempt to justify their ill-advised unilateral discriminatory policy that requires customers to provide identification when using their visa cards
further, my intended purchase was just $"it's not like I was buying $2,worth of stuff."
again, the merchant in no way, shape, or form addressed my complaint
to repeat the significant points of my complaint:
- the merchant refused to process a $transaction because I would not show them my identification
- page of "Card Acceptance Guidelines for Visa Merchants" states that "merchants cannot as part of their regular card acceptance procedures refuse to complete a purchase transaction because a cardholder refuses to provide ID."
- page further states that "It is important that merchants understand
that the requesting of a cardholder ID does not change the merchant's liability for chargebacks."
- my visa card is a valid cardit is in excellent physical shapeit has a visible and signed signature panel on the backthere is nothing suspect about it
when the merchant entered into an agreement with visa to accept visa credit cards they signed a contract which included the "Card Acceptance Guidelines for Visa Merchants"the merchant is violating that agreementif the merchant does not agree with the "Card Acceptance Guidelines for Visa Merchants" or with any other part of their contract then they should take it up with visa or STOP ACCEPTING visa cardsbut instead they have decided to intentionally and unilaterally violate that agreement
the merchant's unilateral policy contradicts visa's "Card Acceptance Guidelines for Visa Merchants" and visa's policies must prevail
again, the merchant in no way, shape, or form addressed my complaint
the merchant needs to change their own unilateral policy about requiring identification for purchases made with visa cards, or stop accepting visa cards and make a complaint with visa
it *is* that simple
