Review: I prepaid for a trip with Pacitic Delight Tours (PDT) which I cancelled within terms of the agreement expecting a $1,000 penalty with, perhaps, minimal additional charges Pacific Delight may have incurred, as written to me in an email from my travel agent, Affordable Tours.

To our mutual surprise, Affordable Tours and mine, PDT's customer service department [redacted] has asserted that my penalty is !00% of my $4788.85 payment to them and has refused to issue me a refund. While I do have insurance which will pay a portion of my losses, the penalty imposed by Pacific Delight comes without specific and detailed documentation.

I am concerned about bearing a substantial financial loss due to harsh, and possibly unethical, business practice.

I have communicated my concerns in great detail to PDT only to be "brushed off" with a simplistic and incomplete response which came after several days of my requesting attention to this issue.

I can and will provide specifics whenever needed.

In the midst of this, PDT is undergoing a top-level management change which raises questions concerning the status of individuals I have been dealing with as well as company financial practices and procedures.Desired Settlement: Detailed and accurate proof of charges they incurred on my behalf beyond the $1,000 penalty I agreed to in the terms and conditions of our agreement.

I am responding to complaint #[redacted] filed by [redacted].

The complaint is regarding our tour of Japan that was booked with Pacific Delight Tours by [redacted] through her agent Affordable Tours.

The departure date for the tour was June [redacted], arriving in Japan on June [redacted], and Pacific Delight Tours received a cancellation for [redacted] on June [redacted].

The cancellation penalty on this day, as stated in our Terms & Conditions, was $1,000, plus any amounts charged by land suppliers and

airlines. These penalties, as confirmed by our land [redacted] Tonichi Travel Service of Japan, are on the attached invoice showing our net rate. The airfare of $2,138.30 is non-refundable as soon as it is booked. The total penalty was $4,788.85.

As stated by [redacted] of Affordable Tours in her email to [redacted] of June [redacted], [redacted] accessed her booking online and authorized per electronic signature her agreement to Pacific Delight’s Terms & Conditions on April [redacted] at 7:41pm.

[redacted] purchased travel insurance through CSA Travel Protection, which I understand will cover 70% of the amount she paid.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

Sadly, Pacific Delight Tours (PDT) has repeatedly failed to provide documentation -- invoice plus proof of payment -- that it incurred expenses associated with the customer's/my booking cancellation totaling 100 % of fees paid to them in the amount of $4788.85.

Once again, terms of purchase along with an invoice and proof of payment -- date/method/amount -- to the airline must be provided to substantiate the business' claim that it has a right to retain the full amount paid to PDT by the customer ($2138.30).

Likewise, the invoice submitted from the local tour company shows no documentation that PDT, in fact, paid them the invoiced 167,900 JPY (valued at $1653.39 U.S. Dollars for which the customer paid a total of $2650.55 U.S. Dollars in advance to PDT via credit card.) It is, in fact, mind boggling to think that the local tour company:

1. Would be allowed to collect the full amount given advance cancellation;

2. Could have satisfactorily fulfilled the entire terms of the tour agreement -- which would be very helpful to review if PTD produced -- given the inclement weather (documented on the attached);

3. Could possibly be allowed by PDT to collect for the hotel accommodations given the reasonable advance notice of cancellation and given standard hotel cancellation policies.

The amount of loss covered by my insurance company will vary depending upon the total of the monies legitimately retained by PDT in excess of the $1,000 agreed upon penalty. As such, my case with them remains open until this matter is resolved. Both the customer and insurance company have a financial stake in a fair and equitable resolution of this matter Actually, so does PDT as a good reputation is golden!

I am looking forward to a proper accounting and a speedy return/refund of monies as may be necessitated -- according to good and ethical business practice -- from Pacific Delight Tours via an honest and thorough documented calculation so that this matter might be put to rest without further appeal to appropriate venues.

I am responding to your email of August [redacted] regarding a complaint from [redacted] (complaint #[redacted]).

The information provided by Delta regarding the purchase price of her ticket is not correct. The amount of $690.30 represents not the airfare, but the tax and fuel surcharge amounts indicated on the ticket receipt that we attached to our previous email ($7.00 + $677.80 + $5.50).

The airline will offer a credit for the non-refundable airfare/fees of $2,138.30.30 less the exchange/service fees imposed by the airline/consolidator and any difference in airfare for the new ticket.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me and the matter has been resolved with the understanding that Pacific Delight Tours will, upon my request to them prior to the 4/**/15 expiration date, process my credit with Delta Airlines in the amount of $2,138.30 (less Delta's required standard exchange/service fees) and book a reservation for me to and from an airport of my choosing that is serviced by Delta. I will further accept Tonichi Travel Service's 40% credit (valued at today's approximate exchange rate of $650) towards future travel arrangements in Japan.

Should this agreement not be honored by Pacific Delight Tours at the time I contact the company, I reserve the right to resurrect this complaint.

I appreciate the professional mediation of this complaint by the Revdex.com leading to a fair and equitable resolution and I wish Pacific Delight Tours well in its ownership transition.
