My name is John R*** and I am a Project Manager with Pacific Fence and Wire CompanyI amwriting in response to letter we received regarding a complaint filed by Mr*** damage doneto his sprinkler systemPer our contract (highlighted copy attached) we are not responsible forrepairs to customer
irrigation systemsand the customers agree to these terms before we beginconstruction on any projectAs you can imagine as a fence company we dig thousands of holesevery year so there is just no way we could be responsible for knowing where every customersirrigation lines runFurthermore they are made from PVC pipe and in most cases cannot belocated with standard locating equipmentI have been in this business for years now andhave never heard of a fence company who accepts responsibility for this sort of damage.In this case, though, in a good faith gesture toward the customer ,we hired *** *** ta repair the line we supposedly broke during installation of Mr*** gatepost even though there was already a post in the same placeIt should be noted that the line
was dry, indicating the system was not functional at the time of the damageAdditional detailscan be obtained from Mr*** *** from *** *** *** ** ***.After the repair to the line was complete *** *** *** tried to start thesystem up and at that time it was discovered that the controllers were bad and had to bereplaced which is further evidence the system was not in working order at the time we wereworking on his propertyIt is my understanding that Mr*** wanted to blame that on PacificFence as well but could not make a case to prove it so he paid for those repairs himselfAfterthe controllers were repaired and the system was turned on it was discovered that not all of theheads were functioning correctly which is another indication that the system wasn't functioning for quite some time and not a result of any damage we may or may not have doneLike I saidearlier the lines were dry when we discovered them to be broken them so it is not likely dirtcould have been pushed that far into the system, but Mr*** could speak better to thelikelihood of thatEither way in another attempt to satisfy Mr*** we again authorized the$to repair the damaged claimed by Mr*** in his complaint to you*** *** again went to the *** residence, this time they had three technicians there allday trying to satisfy them, and it is my understanding that at the end of the day they were sofrustrated and upset with the Mrs*** that they refused to go back and had to leave thingsworking the way they are now, which is a functional system that was not functional the day weset foot on the propertyI have not seen the invoice yet but I am sure it will be way more thanthe proposed $settlement that we agreed toPlease note, per our contract we were neverobligated to pay for or fix any of his irrigation problemsThis is a case of the *** trying totake advantage of the situation and get something for nothing which they have been successfulat doingAll during this ordeal Pacific Fence has maintained contact with the *** and responded tothe best of our abilities during our busiest time of year.Thank you for your time and if I can be of any further assistance please feel free to let me know.John R***Project ManagerPacific Fence and Wire Company
