Initial Business Response /* (1000, 8, 2015/07/12) */
The HOA listed as $50/quarter was an input error on [redacted] part. It was not intentionally done to be deceitful towards [redacted]. HOA docs were presented to [redacted] several weeks before closing. The HOA payment frequency of...

$50/month was clearly stated and confirmed in the documents that [redacted] approved and signed for on 5-4-14. [redacted] acknowledges that a $100 gift card was promised in exchange for the shelving being removed. The gift card has been sent to [redacted]'s agent to then be delivered to [redacted] was never allowed to move in early, and there were documented discussions confirming this. There was never any document that [redacted] signed allowing an early move in. When the sale of [redacted]'s home delayed our sale by one day, [redacted] began demanding to move in early. In response to [redacted] telling escrow he would be sitting in the driveway of our client's home awaiting word, [redacted] sent a very straight forward (not nasty) email to [redacted]'s agent stating that he was not to move one single item into the home until this sale was funded and recorded.
Initial Consumer Rebuttal /* (3000, 10, 2015/07/13) */
(The consumer indicated he/she DID NOT accept the response from the business.)
1. The $50 quarterly H OA was a Big deciding factor on purchasing the house as our budget was tight. This mistake was not brought to our attention until escrow
2. Our realtor states that absolutely no way did he receive the hundred dollar gift card. Wilkinson said he would leave it here with the keys at move in and never did. Wilkinson repeatedly Ignored multiple calls and text from our realtor in attempts to obtain the card.
3. Wilkinson offered for us to move in the original scheduled date which was one day before the actual close if we would sign paperwork stating they would not fix any problems with the house. After we signed he sent a nasty email which I still have not allowing us to move in. We did not demand anything. In fact, we never spoke to him
In closing, I want my hundred dollar gift card
Final Business Response /* (4000, 12, 2015/07/22) */
1. We are in agreement on the HOA fee. We are sorry that there was a clerical error on the MLS; however, it was properly disclosed during [redacted]'s inspection period. He had the option to accept or cancel and he accepted. The time to raise any objections would have been during the inspection period.
2. A new gift card has been sent to [redacted]'s house, and should have been received by now. We have an order number and screen shot for reference.
3. Wilkinson did not offer for [redacted] to move in one day early, and any statement to the contrary is false. We have provided copies of the email. There was nothing nasty about it at all. It was a very matter-of-fact reply to [redacted]'s statement that he would be waiting in the driveway until the home closed.
In closing, you should have received your $100 gift card by now. Let us know if you have not.
