[redacted] of [redacted] contacted us to do his event which took place on March 5, 2014. The invoice specifically listed designated place of delivery ([redacted]) and designated time window of delivery 1pm - 3pm, not 3:30...

as Mr. [redacted] states, which was all approved by Mr. [redacted] through the signing of his rental contract. The contract also has "Delivery and Set Up" requirements and states, "All items will be delivered and picked up at a designated location. The Client must be available to count all items upon delivery and pickup; otherwise, PACIFIC PARTY RENTALS LLC counts will be considered accurate." Any and all exceptions or changes to the contract would have been noted on the rental contract, which none was noted. It is very common for us to do deliveries when clients are not present as we do so on a regular basis which is why we have them sign the rental contract. We appreciate all the business our clients bring to us which is why we didn't immediately charge Mr. [redacted]'s credit card we had on the rental contract for incidentals. When presented with the replacement costs for the generator he stated that this was a new company and could not afford the replacement costs. So we then offered him a payment plan that he did not accept. This was a very unfortunate situation and every attempt has been made on our part to come to a amicable conclusion for the past 4 months. All of which has been met with resistance by Mr. [redacted].
Initial Consumer Rebuttal /* (3000, 7, 2014/07/10) */
(The consumer indicated he/she DID NOT accept the response from the business.)
There is no dispute what is on the contracts. [redacted] understands this. However when signing the contracts and in person it was specifically warned that [redacted] is public property and that there will not be any security to watch items. It was not made clear that they would deliberately leave items unattended.
The focus of this complaint is that it was a decision made by Pacific Party Rentals to leave their items unattended on a public beach, surrounded by people, with no security and and make the decision to not wait for the client, when they were in full contact with the client the whole time via cell phone.
If this is a process they will continue to adopt then there will surely opportunities for problems in the future with their clients.
Final Business Response /* (4000, 9, 2014/07/11) */
PPR was never made aware of any possible dangers when delivering to [redacted]. If such claims were made, specific instructions would be noted on the invoice and contract. Our delivery instructions was made clear though on the contract. Our contract states if someone is not there to accept the items delivery will continue and our counts will be considered accurate. He did sign the contract so I'm not sure as to why he states that it was not made clear. There was a specific delivery timeline and instructions noted on the contract. Mr. [redacted] was to be there to check in the items. Why he was not, nor anyone else from his company is beyond my control. That is why we have the contract and timelines to follow.
It was not our decision to leave our items unattended. It was the decision of Mr. [redacted] not to be at the designated place and time to accept and secure the items. Security from the hotel was there to open a secure gate for us to enter and was there throughout our entire set up and delivery. In order to keep our prices competitive we cannot afford to just sit and wait until someone arrives.
We have adopted and followed this process for the 7 years we have been in business and the thousands of successful events we have done and we have had no complaints thus far with how we execute our deliveries so I do not foresee this as a recurring problem.
