We are more than happy to allow the Mr [redacted] the opportunity to come back and ride standby, as we do with all students who do not pass the first time

*** originally signed up for the class online on 4/14/and paid $(see attachment 1)She was counseled out of the original class, and paid a $standby fee on 7/9/15(attachment 2) to attend a second classShe was late (by her own admission) to the class because she claimed she was pulled over by law enforcementShe registered again as a standby student on 7/23/- this time we reduced the fee to $(attachment 2)Upon failing the course she filed chargebacks with her credit card company on all three chargesThe first chargeback of $(attachment 3) was awarded in our favorThe subsequent chargebacks of $and $65, we chose not to pursue and the money was taken from our account on 8/20/Attachment shows that *** acknowledged and signed the course policies, specifically the range report times and passing criteria
The course was designed for new riders, but it is also understood, and expected, that not all students will be able to make it through the exercises successfullyWe cannot and do not guarantee that everyone will successfully passIt is a state mandated course and we must adhere to the curriculum standards set forth by the California Motorcyclist Safety Program and it's administrator - the California Highway Patrol
Unfortunately, *** did not pass the courseI understand that she wishes to take the course again at no charge, but that is not something that we can doPer our contract with the state, students have two attempts to pass the course and after that they have to re-enroll as brand new students

included some background information on our Motorcycle Safety Program
The program to which *** *** refers is the California Motorcyclist Safety Program (CMSP)The course is state mandated and administered by the California Highway Patrol (CHP) and has very strict guidelinesThis course includes both classroom and on-cycle instructionThe course that PSC offers is the exact same that is found throughout California at over different locationsDeviating from the curriculum is not allowed and there is a very strict students to Instructor ratio
While the CMSP course is designed for the novice rider with no motorcycle experience, students do need to meet the objective of each riding exercise before continuing to the nextStudents who successfully complete the course may have their skills test waived at the DMV
Although, we have a 90% success rate with our students, we also realize that everyone learns at a different pace and some students do not complete the course on the first attemptA student may elect to self-drop or an Instructor may counsel out a participant to preserve their safetyWhen this happens, students are put on “standby status” and are allowed to repeat the course a second time for a $feeThese policies are given to the students in their enrollment confirmation email and in the class paperwork they fill out and sign in the classroom session
*** ***’s standby fee was waived and she was allowed to attempt the course a second time at no additional chargeBy her own admission, *** arrived late to the rangeUnfortunately, we are unable to allow late studentsThe students may not have been on the actual motorcycle yet, however instruction begins beforehand
We realize life happens, and unexpected emergencies may arise, but we must adhere to the strict policies set forth by the CHP and State Administrator

For your reference, details of the offer I reviewed appear below.They did not waive the fee; that's a statement They are monopolizing on this opportunity I don't feel that it is good practice to tell someone on the phone that of course I will be fine and they will take me step by steo, when there are to instructor ratio I even paid the fee on my will and rescheduled the second time because I understood that not everyone learns on the same pace However, to pay again when I'm already there and none of the other students were even mounted on their bikes is non-sense I will continue to let others know about how they take advantage of new riders, and will post my experience on ***, SD motorcycle group on ***, ***, and any other social media No one should be treated this way

These policies are given to the students in their enrollment confirmation email and in the class paperwork they fill out and sign in the classroom session.Mr*** filed a negative review with *** on June 16th. We attempted to resolve the issue with him, however he never responded to our request for more information. See attachment with his review and our response. In addition, Mr*** also filed a chargeback dispute with ***. *** reviewed the case and decided in our favor as services were rendered. See attachment.We are very sorry that Mr*** had a negative experience. We have discussed the accusation with our instructors teaching that day, but the fact remains that Mr*** still took the full course, so we do not believe a refund is in order

I also filed a complaint through [redacted] which for two weeks I didn't escalate to [redacted] for to see if I got a response. I then didn't not receive a reply which I was not able to see 3 days after I escalated the problem to [redacted]. After the first riding day I tried calling the company and someone had answered and hung up. I tried to call to change instructors because of the policy which was stated on the site which said I was not able to get my money back. I was locked into the class and was forced to be with an instructor that I already had a problem with. I then, a few days later, learned on that I was able to maybe get my money back. If I had known this earlier on I would have not gone to the class and wasted my time and tried to get my money back. I think I deserve a refund I put the effort to try to resolve the problem early on but was unsuccessful. Another thing I wanted to point out was since I was not able to see the response through [redacted] I was not able to give my side of the argument which then forced [redacted] to side with your company.

I checked on [redacted] for a week and I didn't see any notification for the response.
