I have been surprised to receive this complaint from your Agency, because I expected it to be from the right Agency that monitors all the Smog shops in Santa Maria, which is " Bureau of Automotive Repair”Yes, the owner of the car came to my shop on Sunday, May 3rd, in the afternoon for a Smog InspectionIt is good, he mentioned that I was calibrating my Smog Machine for more precise tests, and was on the phone while doing the calibration, which wasn't his business or was a ground for raising the emission on his car before I even started running the Smog testI ran the Smog test on his car and eventually, it failed the emission test for high Hydrocarbon, PPM , Part Per MillionIt is obvious that the machine failed his car and I didn't play any role in failing his carLater on, he came back and told him that his car had failed the Smog test for high Hydrocarbon Then, just to hear it failed, he got dissatisfied and disappointed because his plan was adversely changed He said that his car passed the Smog in January and wanted it to pass maybe forever without servicing the carJust to calm him down, I told him if you didn't trust me, take it to another shop as was, and if it passed then your money backThere was no way and has never happened for a high emission car to pass the Smog with a very low emission reading without repairs, the second dayOn Tuesday Morning, May 5th, 2015, He came again to my shop like a hero and told me that his car had just passed the Smog at another shop with a reading of (PPM) Hydrocarbon without repairs and had to refund him I didn't believe what I heard from him | asked him to drive his car beside the Smog machine to verify the very low emission reading on my machineI warmed his car up and ran a manual emission test in front of himThe emission test was still high (PPM) Hydrocarbon, and the reading went up more printed a copy of that reading and told him that his car should have failed the Smog testI asked him to drive his car out and hadn't owed him any pennyHe got very mad and frustrated, so he said that he would report me and close my shop Logically, for a car to fail the Smog twice, isn't a clear evidence that it should have failed the Smog test ? It is not my business the mysterious way how it passed at another shop and can’t judge the other shop either, there is the State that doesMy question is do I have to refund him and reward him for running his car on the roads and streets till the next Smog test is due after years with a very high emission standards Anyway, my advertisement on Yelp is for model year vehicles and newer "No Pass - No Pay" Not for model yearAlso, I didn't open on Sunday just to run a free Smog test for him Since the incident mattered to me and pertained to my business, called the Bureau of Automotive Repair, local Office of Bakersfield, phone number (661) - 7400, the same day on Tuesday, May 5th, 2015, at 10:AMI spoke to the Technician Mr(K) and explained to him the incident the way exactly as it had happened and asked him to take an action He said that it was much better for the owner of the car to file a complaint to the Office, and then the Office could investigate both shops, how the car passed the Smog test, and send his car to the Referee to either validate the mystry Smog or revoke itSo, from my position and concern to solve this mystery, I urge him to file a complaint to the Bureau of Automotive Repair, if he really cares for the environment as he does for the moneyRespectfully Submitted Pacific Smog & Lube

Then, just to hear it failed, he got dissatisfied and disappointed because his plan was adversely changed . He said that his car passed the Smog in January and wanted it to pass maybe forever without servicing the car. Just to calm him down, I told him if you didn't trust me, take it to another shop as was, and if it passed then your money back. There was no way and has never happened for a high emission car to pass the Smog with a very low emission reading without repairs, the second day. On Tuesday Morning, May 5th, 2015, He came again to my shop like a hero and told me that his car had just passed the Smog at another shop with a reading of (18 PPM) Hydrocarbon without repairs and had to refund him . I didn't believe what I heard from him . | asked him to drive his car beside the Smog machine to verify the very low emission reading on my machine. I warmed his car up and ran a manual emission test in front of him. The emission test was still high (134 PPM) Hydrocarbon, and the reading went up more . . printed a copy of that reading and told him that his car should have failed the Smog test. I asked him to drive his car out and hadn't owed him any penny. He got very mad and frustrated, so he said that he would report me and close my shop . Logically, for a car to fail the Smog twice, isn't a clear evidence that it should have failed the Smog test ? It is not my business the mysterious way how it passed at another shop and can’t judge the other shop either, there is the State that does. My question is do I have to refund him and reward him for running his car on the roads and streets till the next Smog test is due after 2 years with a very high emission standards 2 Anyway, my advertisement on Yelp is for 2000 model year vehicles and newer "No Pass - No Pay" Not for 1995 model year. Review: On Sunday May 3rd, 2015, I had a buyer come to me wanting to purchase my 1995 Honda Accord EX 2.2 Liter coupe. I first needed to smog the vehicle as the smog I had done on January 30th, 2015 had lapsed the 90 day window to suffice for the sale of a used vehicle. Pacific Smog & Lube was the only option on Sunday in Santa Maria. Note - the 1995 Accord passed smog on Jan 30th at another location in town. Once at Pacific Smog & Lube, the owner S[redacted], proceeded to talk on the phone for approximately 20 minutes while my vehicle sat idle. S[redacted] said he was calibrating his equipment, and continued to speak in another language to someone who was apparently more important than a customer. I was unable to ask S[redacted] about his smog policy (i.e. "pass or don't pay", or "fail and return for free"). I departed the Pacific Smog & Lube facility in order to attend to other matters and returned approximately 30 minutes later. S[redacted] had advised me that my vehicle had failed the hydrocarbon idle test (max in CA less than 100 ppm). His reading was 196. I had asked what might cause this and he provided a number of possible problems. Since I was planning on selling the car, I had little intention to spend further money on any repairs. I found it ironic that I had passed a smog test 3 months prior but was suddenly failing badly with no signs or symptoms from the vehicle. Being skeptical of his equipment, I had asked that if I took it elsewhere and passed, would he be willing to refund my money. He agreed to my request. I had advised him that it would likely not be until Friday the 8th that I could have another smog station test the vehicle. I was able to take work off on Tuesday the 5th of May to have the vehicle tested where it in turn passed without issue. I returned to Pacific Smog & Lube with the passing test results. S[redacted] refused to refund my $46.75 and claimed that I had made repairs to the vehicle in order for it to pass. He again ran the HC test at idle where it failed for the second time.Desired Settlement: It would be in the best interest of future customers who smog their vehicle at Pacific Smog & Lube to have fair and accurate test results. I truly believe the smog testing equipment at Pacific Smog & Lube is in need of repair and or State inspection. I would like a refund for the $46.75 I was told he was willing to refund should I provide passing test results. I have read on yelp and Facebook that he normally does not charge customers unless they pass. A clear smog policy is a must.
