Manufactured Home from Pacific Valley Homes on 05-06-Also see revised purchase order/contract dated 08-28- the price changed due to the customer adding sprinklers and a recessed entryThe home had to be builtWhile she states that the home is uninhabitable at this time this is not trueThe home is habitable and has been for quite some timeAll of the issues are cosmetic which are being addressed by the Manufacture Golden West Homes and their contractor that they hiredThis has nothing to do with fundsThese cosmetic issues are covered under Golden West Homes WarrantyWe are in the process of replacing all the interior door jambs complete with frames and moldings The home would have never been ordered or delivered without the proper permitsPacific Valley Homes will not order or deliver a home without the initial site prep permitThe permit was applied for and paid for on 9-17-The site prep permit was issued on 10-21-A copy of the permit and job card issued by the City of Wildomar are attached The City of Wildomar has not deemed the home uninhabitable at any timeThey just have not issued the Certificate of Occupancy for the following reasons When Designs, their contractor initially went to the Department of Building and Safety to inquire about the permits and fees they did not mention that a block wall or a grading plan would be requiredA copy of the construction bid is attachedYou will not see the block wall or a grading plan is on the bid because it was not required at the time the contractor was applying for the permitsThe City of Wildomar disclosed and required these after the construction bid had been given to and discussed with the customer by their contractorThis is also the construction bid that was sent to their Lender 215T Mortgage for their approval to be added to their loan Pacific Valley home has not received any funds from the lenderWe will not receive any funds that are due to us until the escrow has closed and it will not close until the City of Wildomar issues the Certificate of OccupancyWitch will not be issued until their contractor completes the required conditions needed for the block wall and grading planThis should be completed any day nowEscrow has not been closed it is still open She states that the home sits behind a high mountain which is unsafePacific Valley Homes had nothing to do with where their home was to be placedThe placement of their home was decided by them and or their contractorAt no time did anyone from Pacific Valley Homes tell them where to place their home, On 11/25/Mr& Mrs, [redacted] signed their construction loan does with their lenderOnce the contractor received funds from their lender 21ST Mortgage to pay for and pull the initial permits needed it was then that their contractor was informed by the City of Wildomar that a block wall would need to be installed behind their home and that a grading plan would also be neededIts not that the contractor is out of funds for the block wall and the grading plan they were never included in the initial construction bid to them or their lenderThey could not go back to their lender and ask to increase their loan amount because they had already singed their loan doc's [redacted] their contractor from JJ Designs did inform Mr [redacted] of the block wall and the grading plan that are now being required by the City of WildomarIt was discussed between Mr [redacted] and their contractor that it had to be done and that they would discuss a payment plan between them The Golden West Factory has sent a service team to their home to address the issues with the kitchen cabinets and the other issues they mentionedAll of the interior door jambs complete with frames and moldings are going to be replaced as I mentioned aboveThe manufacture Golden West Homes will continue to do what is needed to have their home meet H.U.D standards Attached is a copy of their purchase order/contract dated and signed on 08.28-by both Mr& Mrs [redacted] You will notice that item number states that construction, permits or fees are not includedAll checks for the construction, permits and fees were made out to their contractor JJ Designs and not to Pacific Valley HomesWe only sold them their home Pacific Valley Homes is in no way responsible for delays due to contractors or city and counties agencies pertaining to permits or inspectionsAll site improvement contractors are not employees of Pacific Valley Homes nor are they hired by Pacific Valley Homes, They are hired by the customersAttached are copies of two of our disclosures signed by both Mr, and Mrs [redacted] The first one readsI also understand that due to the numerous contractors, County or City and other entities involved in the financing, permits, construction and installation of your home, Pacific Valley Homes cannot promise or guarantee delivery, completion or move in datesThe second one readsContractor Status: Seller may at times supply a list of contractors when askedIn no way does this list imply endorsement of contractors or should be considered as a guarantee of the quality of their workAll contractors shall be personally the additional grading required later by the City of Wildomar In conclusion, The reasons it has taken so long to get to this point are as follows Mr& Mrs [redacted] signed their loan documents on 11-25-On 12-11-JJ Designs received the first draw for the permits and fees, When Ramon who works with JJ Designs went to the City of Wildomar to pull the site prep permit he was told that there were violations on the second home on the property and that they would have to be cleared before the site prep permit could be issued The violations were because there was an addition of some type added to the existing home that was already on the property without the proper permitsThat addition would have to be removed before any permits would be issued It took them about 2-1/months for them to remove the illegal addition and call for inspection from the cityWhen they came out to inspect the home they denied the clearance of the violation because part of the addition was still left attached to the homeIt took them about another months for them to completely remove the addition and get the violation removed Then the City of Wildomar said that the existing home on the land had to be painted the same color as the new home being installed this took another month This was a delay of a total of 5-1/months approximately When the contractor went back to the City of Wildomar to pull the site prep permit he was told that the trust deed he had submitted did not show any easements to access the new homeThis took about months for them to get a new trust deed that showed the easement on itSo now the delay is 7-1/monthsThe contractor and his engineer have been diligently trying to resolve the issue with the grading plan issue with the City of wildomarAt one point about weeks ago the City of Wildomar informed the contractor and Pacific Valley Homes that they needed $3,to continue working on their reviews of the grading plansThe engineers were submitting to them for approval and commentsPacific Valley Homes in an effort to improve customer relations and keep things moving forward went ahead and gave the contractor a check for the $3,which he in turn took it to the City of WildomarWe never even mention this to Mr& Mrs [redacted] Pacific Valley Homes was in no way obligated to pay this but we wanted to make sure the process would not stop but continue to move forward Pacific Valley Homes had agreed to pay Mr& Mrs [redacted] 's electrical bill of $so the electricity could be turned on to their homeWe told them that we would do this once escrow had closedWe were not obligated to pay this we did this to show good customer relations The City Of Wildomar has been part of the problem alsoIf they had told the contractor about the block wall and the grading plan in the very beginning they would not be in this positionEach and every time the City of Wildomar asks for comments on the grading plan it takes them no less than weeks to review the plansThis has happen at least to timesThis is causing the long delay Pacific Valley homes has not stood by idly during this time, I myself have attended at least meetings with the contractor and his engineer at the City Of Wildomar going over the grading planMost of those times were during my days off, The Operations Manager [redacted] has also been there at least times all in an effort to resolve this issue with The City of Wildomar on the grading plan Attached is form called the Staged Funding Rider from 21't Mortgage their lender that Mr& Mrs, [redacted] both signed on 11/25/that states that they would have to start to make mortgage payments not more than days after the home had been deliveredAlso states "Borrower/Buyer agrees to pay the first payment regardless of Borrower/ Buyer's ability to occupy the home In the complaint they state that 21ST Mortgage and Pacific Valley Homes work hand in handThis is so far from the truthWe are totally separate companies, The only connection between Mortgage and Pacific Valley Homes is that 21sTMortgage is one of about different lenders that specialize in the financing for manufactured homesUltimately the customer chooses the lender they want to usePacific Valley Homes in no way tells a customer who they should secure their loan with Pacific Valley Homes has done nothing to warrant compensating Mr& Mrs [redacted] As a matter of fact we have gone out of our way to help by paying the $3,needed by the City of Wildomar so they would not stop working on the grading plan and offering to pay the $to have their electricity turned onPacific Valley Homes paid for these to show good customer relationsPacific Valley Homes is not asking to be reimbursed for these expenses nor do we intend to be reimbursed for them In our last communication with [redacted] from the City of Wildomar if they receive two letters relating to the grading plan by Monday October 26thThey should have final approval of the grading plan and also get the Certificate of Occupancy allowing them to move into the homeWhat little work that still needs to done to the home at this time is cosmeticThe interior door jambs complete with frames and moldings are going to be replaced the week of October 26thThe manufacture Golden West Homes has already sent a service team to fix the splits on the cabinet doors Pacific Valley Homes is committed to continue working with Mr& Mrs [redacted] , their contractor and the City of Wildomar in making sure that the grading plan gets completed so this project can be completed and they can move into their home Please let us know if I am rejecting this response because: They hired the contractors to complete the jobThey should be responsible for there contractors workI shouldn’t have to call there contractors they hired to have them fix my houseWhen I last spoke with [redacted] he told me that they would take care of the problems with the contractor or hire a different contractor to do the repairsHe sent out a contractor to get a bid to fix the stucco and driveway and because the bid was to high to repair they don’t want to deal with it nowPacific valley homes got there money when the loan funded and now I’m stuck with the cracked stucco and garage.I attached an email from [redacted] saying he was sending out Jose a new contractor to look at the garage

I am rejecting this response because: [redacted] knew for a fact that I have paid from my pockets all the permits and fees require for the home to be deliverAll the money he should have ask escrow was money to reimburse me from all the invoice I have gave him of all permits paidHe knew exactly the amount that was spent on permits and fees and he should have ask escrowAs part of the contract it is Pacific Valley responsibility to paid for the set up the home once it is deliverI have no part as who Pacific Valley hires to set up the homeAs a manufacture home dealer they are aware of the process once the home is deliverThe home must be place in the site attached both pieces level it and set the jack standsPacific Valley should have done all the set up first so my contractor could have start on the fountain The issue here is Pacific Valley chose the same contractor I hire for the outside for set up of the homeThis is were the issue happen when they decided pull funds from permits and fees that they knew no permits and fees were due at that time and gave to the contractor to start on the set up of the homeI am requesting also they show me evidence of supplies and materials that were spent on the home as stated on the letter

I am rejecting this response because: They hired the contractors to complete the job. They should be responsible for there contractors work. I shouldn’t have to call there contractors they hired to have them fix my house. When I last spoke with [redacted] he told me that they would take care of the problems with the contractor or hire a different contractor to do the repairs. We did issue his contractor a check for $4,000 for permits and fees. His loan was set up where at closing the amount needed for permits and fees for the project was assigned for permit and fee cost. We followed escrow instructions and issued the money to the contractor because that is what his...

lender provided and that is what it was allocated for. In California we must follow all escrow instructions and we did. We issued the funds to his contractor so that he can progress on the customer’s project.   However, the contractor used the money to purchase supplies and material for his project. The contractor did not use the money for permits and fees. In addition his contractor told Mr. [redacted] that he used the money for “set-up”. That is not what the money was allocated for and unfortunately his contractor told him that it was for “set-up”. We did not tell the contractor to use the funds for “set-up”   Mr. [redacted] feels as if the $4,000 paid to the contractor should have come from Pacific Valley Homes because we included set-up in his purchase price. We explained to Mr. [redacted] numerously that we do not have any control over how the contractors spend their money. In this case Mr. [redacted] wanted the contractor to begin working on his project right away and that was the best way for the contractor to do it. Mr. [redacted] did sign a contract with his contractor on 9/29/16. In that contract his contractor set-up up a payment plan where Mr. [redacted] would pay his contractor $10,200 upon delivery of home. Mr. [redacted] did not fulfill that requirement and therefore contractor had to use the funds differently to begin the project. Mr. [redacted] hired his contractor and arranged that payment plan for his project. We have no control over the contractor that he has hired or the terms and conditions they have arranged.   We have taken into account Mr. [redacted] concerns about the $4,000 being spent on “set-up” and not on permit and fees. Therefore we are accounting for those funds on our side and not deducting it from the customer’s loan amount. The $4,000 [redacted] be credited towards the set-up and the $4,000 for permit and fees is still available in his loan proceeds.   All of Mr. [redacted]’s funds are accounted for and strictly regulated and disbursed by his lender and the escrow company. We do have to request from escrow the release of the checks after the customer requests them. We do nothing more than follow the directions given to us by Lender, Escrow, and customer.   Mr. [redacted]’s desired settlement request to have us write the $4,000 was spent on the set-up of the home is not feasible. We cannot go back and re-write a check that has been issued. Mr. [redacted]’s lender can explain to him how all his funds have been spent and account for every penny that he has borrowed. We have tried to explain this to Mr. [redacted] but, Mr. [redacted] becomes irate and and vulgar. We have shared our concerns with his lender as he has become very difficult to work with and does not seem to understand the communication we have provided him. We have asked his lender to explain to him how his funds have been spent. We have been very transparent with Mr. [redacted] on our process and his loan costs. We would never jeopardize our integrity and reputation in any way shape or form. We go above and beyond for every customer and provide the best service we possibly can to every customer. We take pride in our commitment to go above and beyond in meeting every customer’s expectations.
