Dear Ms. [redacted] – Per my telephone message what I am attaching is a little more voluminous than I had mentioned in my earlier conversation with you. Therefore I am submitting it electronically.
 
In answer to [redacted]s complaint:
 
1.    Our contract does not state we...

have to provide a copy of all invoices but does state that we will provide a complete accounting of the sale (see attachments ** contract/agreement, ** letter/[redacted] response and ** accounting). We did however provide a complete customer by customer record of their purchases at the auction (see attachment ** accounting by bidder)
2.    Contract/agreement does not state that we are to provide compensation to the company having the auction for consignments to the auction (see attachment ** contract/agreement)
3.    In our opinion the consignments were not in conflict with any of the ** items in the auction ( see attachment ** consignments)
4.    As a part of the contract/agreement ** agreed to accept consignments to the auction therefore they have no claim for the cost of advertising other items in the auction (see attachment ** contract/agreement). In fact ** is in breach of our contract because they adamantly refused to allow one of our regular customers to consign to the auction. At our customers expense we diverted the consignment to another auction we were conducting 15 miles away.
5.    We are not in breach of comingling moneys because the Oregon statute specifically states “If an auctioneer or auction mart operator or consignee does not immediately pay moneys the auctioneer collected” he is then to put it into a trust account. We immediately paid our client within the 14 days stated in our contract/agreement.
6.    To the best of my knowledge nothing was stolen and if it was, per our standard policy, we pay our clients like ** in full for any stolen items.
7.    Since our original submission of the accounting and a check for $53,813.00 on June 1, 2015 (13 days after the auction) we have resent the check 2 additional times. I checked my checking account again this morning and it is still not cashed???
 
In conclusion if there are any other records you would like to see to resolve this issue we would be happy to comply. Also please advise if you would like us to mail all of the above.
