Please accept the following statement in defense of the claim by Mr*** *** whereby he is requesting an additional refund of payment for services rendered at the office of DrAnthony JBi*** DC Please note that a partial refund was issued to Mr*** in the amount of $on
12/29/based on the refund policy that Mr*** signed (see attached) Mr*** is not entitled to any additional refund.Claimant consulted with DrAnthony JB*** DC on 11/18/for bilateral numbness in the hands. DrB*** recommended a course of treatment utilizing MLS Laser, Electro-analgesia and Medical Massage. It was explained to patient that we do not guarantee results but that our office has had great success treating similar cases. Patient was provided recommended treatment plan consisting of Laser treatments and Electro-analgesia treatments to be administered 3x/week for weeks. Additionally medical massage treatments were to be administered at a frequency of approximately 2x/week. The total treatment plan cost with prepayment discount was $3402. The patient understood that there was no guarantee of success and decided to commence treatment. Patient paid $or approximately half of the treatment plan total on 11/18/and received his first treatment the same day Mr*** was seen in a timely manner and treated by DrMark V** *** DC and Eric D*** LMT between 11/18/and 11/25/ Mr*** stated on 11/24/that he was able to sleep without his right hand waking him up. He stated that he was starting to notice a decrease in symptoms since being treated. On 11/25/patient stated that he was able to sleep through the night (second night) without numbness in his right hand waking him up. The patient also stated that he noticed a decrease in numbness in his right hand since his first treatment in our office (office notes can be supplied if necessary).Patient cancelled all visits after 11/25/and called on 12/2/requesting a refund. He spoke with office manager on 12/2/at which time it was explained to him that his refund would be $after pro-rating to the per-visit fee according to the financial policy that he signed (see attached). The 15% customary administrative fee was not included in the initial calculation The office manager explained that the choice was his and that he could either leave his credit on account for future visits or receive a refund check based on the pro-rated calculations. Mr*** stated that according to him he should be getting more than half of his money returned. At that time Mr*** was volatile, rude and yelling indicating that he would rather leave his credit on account and come in 1x/year ‘just to make us miserable.’ He then disconnected the call.Subsequently on Monday December 28, 2015, Mr*** called the office and spoke with Mary Z*** According to Mary he was screaming at her and demanding his refund stating that it was late. Mary notified the office manager via an inter-office message which was received upon return to the office on Tuesday 12/29/2015. On that same day Mr*** called the office again demanding his refund and threatening to ‘take us to court’ if it was not in the mail that day and if it was not more than $ A refund check was processed and placed in the mail the following day on December 30, in the amount of $ Please note that upon calculating said refund an executive decision was made to waive the 15% administrative fee in an effort to avoid any further verbal harassment by the patient as such fee would negate any refund due Mr***Mr*** received treatment during the period from 11/18/through 11/25/and is responsible for the cost of said treatments rendered. He is certainly not eligible for a refund above the amount of credit on his account equal to $which has already been issued to Mr***

The first two treatments were administered by DrMark Van Volkenburg DCThe third treatment involves the patient either standing or sitting with feet on a vibrating platform. Please note that we do not use needles in any of our treatmentsThe three treatments which were administered on his initial visit cost a total of $220.When patient called to cancel his follow up treatments and indicate that he was going to return the supplements he was informed that the supplements are non-refundableWe are not able to return product to our inventory once it has left the office with a patient. your letter dated June 11,2015 regarding patient ID [redacted] who presented to our office on 2/11/15 for examination and consultation. The patient subsequently received treatment that same day including three separate services for a total of $220. Patient also received supplements for a retail cost of $712. The total services/product rendered was $932. Patient made a payment of $1000 and was scheduled to return for additional treatment as per the recommended treatment plan. Patient subsequently cancelled his follow up appointment and returned supplements although it was explained to him prior to returning the product that he would not be allowed a refund due to the fact the all nutritional supplements are non-refundable.Upon receipt of letter from patient's attorney we made an adjustment to patient's account by reducing the cost of the nutritional supplements to the wholesale cost rather than charging patient according to our standard policy of full retail. We can not return money for services rendered however we were able to provide a special consideration to patient and mailed him a $424 refund check as a good faith effort to provide special consideration given his unfortunate circumstance.If I can answer any additional questions please do not hesitate to call my direct line at###-###-####.Sincerely, Dr. Anthony J B[redacted] DC

Dear [redacted]ID [redacted]Answer to Dr. B[redacted], DC1- I did not subsequently received "3" treatments, it is false!!!!! Only one from his associates. Dr. Mark v[redacted] my left leg with small needle. 2. I was not told that I can not returned his supplements!3. I have cancelled my following up, because I fractured my left leg while I was at Saint Mary Hospital in Luistent.4. I have returned his vitamins wiht Niagara county, Mrs. C[redacted] to the front door of his office in front of his associate Dr. Mark. He saw me!5. My Niagara County Attorney in the letter, asking Dr. B[redacted] to return my most of $1000.00, only returned 424.00 he returned.In closing I hope Dr. B[redacted] respects Revdex.com's writing and my attorney Dr B[redacted], returned y money you owe me. Respectfully [redacted]
