In response to your letter dated 6/30/2015, I will give you a brieftimeline of the case youhave assigned [redacted] [redacted] attended an auction held by us at the Fond du Lac County Fair Grounds onApril, 4th He registered, signed or buyer contract and was issued buyer numberHe made a purchase of an item number a GMC one ton dump truckSerial number [redacted] for the amount of$5,He wrote us a checknumber in that amount which was returned UNABLE TO LOCATE ACCOUNT,which I believe in the State of Wisconsin is a felonyUpon receiving notice from ourBank I do what I do for every returned check we receive, I make a phone call to let themknow I have not received payment because of the returned checkThis phone call wasalso followed up with a letter dated 4113/I receive a phone call from him stating hewould be in on 5/1/to pay for the item and clear up the matterHe did not showhowever on 5/2/I received a check number for the amount of $,andanother check number on 5/26/in the amount of $,on 9/0/notpayment in full as he said he wouldI then heard nothing from him and again sent\\-Titten correspondence dated 0/indicating I did not want to wait any longer forpayment and felt I had been mOE~ than fair to this point and would like the $3.025.00balance due, which included the $return check fee, and would be forced to takeother actions to get the balance conectedWith no response I turned the item over to acollection company Financial Recoveries Inc\vho was unable to make recovery as of theend of or early at which time I hired Attorney [redacted] D [redacted] Eventhough I felt I would most likely not see the balance and would not be able to collect thedebtBut~coincidence would have it I had virtually the same incident with another familymember that I was taking to small claims court to try to collect on a debt owed us[redacted] was being used as a witness by the family member in connection with thatcase and having made contact with him and by my attorney's advice I agreed to take$he offered to settle the matterWhich is a $1,loss not considering anyof the legal expenses I have occurred.I reluctantly agreed to as long as he agreed to never have contact with my auctioncompany againJune 26, I receive the cash payment in our office in the amount of$1,at which time I typed a receipt for that amount and delivered title to him at thattimeI have no knowledge of the titles condition since it has not been in my possessionsince that dateWe are given title by the municipality for each vehicle and act as theiragent on the sale of each vehicleUpon payment we fill the purchaser's name and priceon the title the municipality has provided, which is required by Wisconsin law and thenpass title to the purchaserI am not able to apply for a replacement title as Auctionassociates Incnor myself ever hold title to the itemI explained to [redacted] on thephone that if he needs to get a replacement title he would have to contact the previousowner as I am not legally able to do so since I was not the owner at which time he hungup on meI have done everything buy law that I am required to do and or able to doIam a bit confused, that now he needs a title ASAP since he has been in possession of thevehicle since its purchase and title since 2013?? Should anyone have a questions on atitle or an issue at our DMV of a vehicle which has been purchased at one of ourauctions, which normally happens within a week or so from the date of purchase, we getthem an answer of what is needed so they can get it registered for there use.As to [redacted] ***e's statement; in my opinion the only true statement in it is, he didpurchase the vehicle over six years ago, the rest is not true.Auction Associates Inc(A Registered Trademark) has been in the Auction business sinceand I purchase the business from my father in May of We have soldeverything from Bee Hives to Airplanes since We have been in the business forapproximately the last years specializing in the sale of County Municipal equipment inthe State of Wisconsin having sold item for most of the counties and thier departmentsincluding most of the Sherriff s department in Wisconsin along with hundreds of cities.This means we may handle as many as titles per year without issuesWe aremembers of the Wisconsin Auctioneers Association, served for years there as boardmember, President, Chairman of the Board and committee member and educational _presenter along with being a Lifetime member of the National Auctioneers AssociationIwas appointed December by then governor Jim Doyle to the Wisconsin AuctioneerLicensing Board and am now af!ing chairman of that boardAuction Associates Inchasand always will handle itself in a professional manner and abide by the laws of the Stateof WisconsinWe are Wisconsin Registered Auction Company Number and I amWisconsin Registered Auctioneer Number I also helped write the test question forthe Wisconsin Auctioneers License law which went into effect in 1995, and the updatedtest being used currently to obtain an Auctioneers License in Wisconsin.Please note in our logo our moto for years has been "THE FRIENDLY ONES" andwe do everything I believe we can to uphold that motoI am not aware of any complaintever being made against myself or our company in its years of existence, and considerthere has not been a valid one to this dateShould you need any references on how we dobusiness and how people are treated by us you are more than welcome to our client listand buyersI hope this answers any of your questions and hope your fact finding includebackground on the complainant as well as usI apologize for the lengthy reply but feelyou have not been provided not only the complete story but the truthShould you needany further information please feel free to contact me via any of the methods listedbelow.~~

purchase of an item number 210 a 1997 GMC 3500 one ton dump truckSerial number [redacted] for the amount of$5,800.00. He wrote us a checknumber 1213 in that amount which was returned UNABLE TO LOCATE ACCOUNT,which I believe in the State of Wisconsin is a felony. Upon receiving notice from ourBank I do what I do for every returned check we receive, I make a phone call to let themknow I have not received payment because of the returned check. This phone call wasalso followed up with a letter dated 4113/2009. I receive a phone call from him stating hewould be in on 5/1/2009 to pay for the item and clear up the matter. He did not showhowever on 5/2/2009 I received a check number 6115 for the amount of $1 ,300.00 andanother check number 6126 on 5/26/2009 in the amount of $1 ,500.00 on 9/1 0/2009 notpayment in full as he said he would. I then heard nothing from him and again sent\\-Titten correspondence dated 911 0/2009 indicating I did not want to wait any longer forpayment and felt I had been mOE~ than fair to this point and would like the $3.025.00balance due, which included the $25.00 return check fee, and would be forced to takeother actions to get the balance conected. June 26, 2013 I receive the cash payment in our office in the amount of$1,600.00 at which time I typed a receipt for that amount and delivered title to him at thattime. I have no knowledge of the titles condition since it has not been in my possessionsince that date.
