The agreement that ** *** signed clearly states that there was a pre-existing peeling paint problemLatex was incorrectly applied by the
previous painter leaving us two options: either sand and strip the trim (which was the recommended solution by the estimator) or oil-prime the trim where it was peeling to try to lock down the peeling edgesSanding/stripping is a much larger project than oil-priming (it would have cost about double what was paid), and it's clear in the bid that we were hired to do the less expensive option of oil-priming the bare edgesThe words "sand" or "strip" do not appear anywhere in the final signed agreement.
My offer to fix future peeling at a deep discount (which only covers my expenses) is still good, and ** *** is welcome to take us up on itI can't perform the work for free or pay another contractor to do it like requested, however, when we noted the previous peeling and fulfilled our obligations to handle it how we were hired to

Paint Green was hired as professionals, to do a professional paint jobThe fact is, they did an unprofessional jobThere was peeling paint on the stair bannister prior to the start of Work, which Paint Green identified as latex on oil paintThat was clear evidence that oil paint had been used in the home, and it was Paint Green's responsibility to identify ALL AREAS where there was oil paint, and then deal with it in a professional manner, according to standard industry practicesPaint Green did not do this, nor did they ever discuss, or give me an alternate bid for doing a professional job of properly preparing the oil based paint surfaces. I received ONE bid from Paint Green Why would I, or any homeowner, agree and pay over $to have a paint job in my home done improperly?
Paint Green states that they are not responsible for a "pre-existing condition"I don't understand this statement, since the paint applied by Paint Green on the moldings peeled off AFTER the job was completed (and continues to peel today) . When something rubs against the surface of the moldings, or the doors open and close, the paint peels- see attachment. Paint would not peel off if the job was done correctly
Paint Green had several screw ups on this job, their screw ups resulted in the job taking several days longer than promised, there was property damage by Paint Green, they were behind schedule, and they cut corners at my expense by not properly identifying and preparing all the surfaces that had existing oil based paint areasWithout my knowledge, they simply put two coats of exterior latex paint over the interior oil based paint moldings, with the expectation that I would never know the differenceAfter the peeling paint became apparent, the professional painters that I consulted with ALL AGREED that Paint Green did not do a proper jobNow Paint Green wants me to pay them to return and do corrective work on a job that they did improperly? I will not pay them a penny to do corrective work, and I should not have to live with a paint job where the paint is peeling in less than one year of completion of the job
Item #of the contract clearly states "Prime where necessary"; Paint Green did not do this; nor did they follow the Terms and Conditions of the contract , which states " Work to be performed in a workmanlike manner according to standard industry practices"Paint Green did not follow standard industry practices in dealing with the oil based paint surfaces in my homeYou should also remind Paint Green that their contract has a four year warranty on workmanship, which they are also refusing to honor

The simple facts are:
- A pre-existing condition of latex paint peeling off of the oil was noted by the estimator on the bid
 
- The estimator gave the client two options to deal with the peeling and wrote the bid for the less expensive option that did not include removing the peeling latex (I agree this is not the best way to deal with peeling latex, but it is less expensive and is what the client chose)
 
- The screens that had some paint on them were either replaced or repaired to the client's satisfaction
 
- The stain that kept coming through all the different stain-blocking primers that we used on the ceiling was eventually contained after using an exotic primer. The customer was satisfied with the final work on the ceilings.
 
- PaintGreen did not ask for any additional money despite having to redo the work several times due to the nature of the stain
 
- Redoing the ceilings several times is why the job took longer than expected
 
What we've learned from this job is that we should not have given the client an option to go cheap. We should have insisted on removing all the latex by stripping or sanding, rather than just priming the edges of the peeling areas to glue them down. We may have lost the job because our bid would have been higher, but we would have avoided this situation where the client chose the less expensive, "band-aid", option and is now blaming us for the new areas it is peeling.
 
My sympathies go out to the client, and I am willing to perform the sanding, stripping, etc at a deeply discounted rate. I cannot do the more expensive job for free, though, just because the client now wishes he had chosen it at the beginning.
