Ask [redacted] to provide me with proof of the cars being at his establishment and he can not provide that information. Instead he told be to go back to the Revdex.com and have them give me the money. At this point I will take this matter to court.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

I went to Advantage Toyota on September **, 2013 and spoke with Representative [redacted] to purchase 5 taxi cars (see exhibit I contract agreement and deposit). The price for each car was $43,194. I put a down payment deposit of $2,505 for each car (total of deposit $12,525) leaving me with a balance for each car $30,669 (the contract is $20 higher with a balance of $30,689). On November **, 2013 I received a call from [redacted] stating that two cars was ready to come to his location with two checks (Exhibit II and Exhibit III) in the amount of $7,500 total $15,000. When I got to the [redacted] at Advantage Toyota he told me to go to his friend [redacted] at [redacted] another dealer who has connecting with the bank that is financing my loan. I was to go [redacted] to pay the $15,000 and finance the reminding balance. [redacted] also stating that the two cars was at Midtown Auto Repair Shop getting painted. I did not trust him so I ask him to put it in writing where the cars were and if the cars was not there I can cancel the deal (Exhibit V).
I went to [redacted] at [redacted] to explain to explain what [redacted] I have discussed. I signed the contract for loan with [redacted] and went to the Midtown Auto Repair where [redacted] said the two cars were. When I got to the repair shop and ask where the cars were hand them the VIN information, I was told there was no car there for me. At that point I called [redacted] and [redacted] to cancel and not to deposit the two checks because there were no cars. This all happen on a Friday evening and on Saturday I confirmed with by bank that [redacted] cashed the check after I told him not to.
On Monday I went back for a refund and to confirm that everything was cancel with contract.I also had the police with me. I received a refund from [redacted] on December **, 2013 (exhibit VI) in the amount of $12,500 which was $25.00 dollars less than what I gave him for the deposit. At that point I was thinking that I will received the reminding balance back from [redacted] which was the two checks of $7,500 x 2= $15,000.00 (checks that was that was not supposed to be cash because I cancel the deal on November **, 2013 the same day he received the checks). On January **, 2014 (exhibit VII) there was a withdrawal twices in the amount of $898.48 x 2 = $1,796.96. I went to my bank who then sent me to [redacted] Bank who explained to me the money was for a loan and [redacted] received the money. I explain that the deal was supposes to be cancelled on November **, 2013 and that I never received the cars because they were not there so there should be no loan. [redacted] told that I need to get the money back from the [redacted].
I don’t agree with the business response because there were no car and that was confirmed on November **, 2013. In fact I went to another dealer to purchase the cars and get that I need in a timely manner with no problems. Both [redacted] and [redacted] has been giving me the run around from day one and never been truthful. [redacted] owns me $16,796.96 this amount includes the two checks told [redacted] not to cash in the amount of $7,500 x 2 = $15,000 and the amount that was taking out of account for the loan that I told him to cancel $898.48 x 2 =$1,796.96. If the deal was still on why would [redacted] return my money.
[redacted] stated the two cars were there for two months.
1.       Please provide me with the date of sale shipping date of the two cars.
2.       Explain which company was providing me with the car Advantage Toyota or [redacted].
3.       Provide documents that would support [redacted] paid off the loan.
4.       When will I get a refund from [redacted]?

Sincerely,
[redacted]

Review: I got a green taxi permit from the city, wheel chair accessible. I went to the [redacted] to buy the cars. The address is [redacted]. I made a deal with the salesman, [redacted], for the 5 cars. Each car is $43,194. Each car, I gave a deposit of $2,505 and so since I paid for 5 cars, the total is $12,525. I gave him this money September **, 2013. He said the car will be ready in one month but it wasnt. He called me and told me that 2 of the cars were ready, bring the down payment of $7,500 for each car and bring a void check. I agreed and he said go to another office, [redacted], and go to his friend, [redacted] said to give [redacted] the 2 checks and write the VIN number. I gave the void check to him. I called [redacted] and asked where the car is and [redacted] told me he would show me but he showed a car with different VIN number. [redacted] took the down payment when the car wasnt even in New York so I wanted my deposit back. But he didn't give it back. [redacted] gave me back $12,500. When I received the money, I went to the office for [redacted] and I talked to the [redacted] and [redacted]. I asked him where the rest of the money was. He said you gave it to [redacted] so you have to take from them. [redacted] Dealer Funding LLC address is [redacted]. The phone number is ###-###-####. I go there and I talk to [redacted], I told him that he needs to refund me too. [redacted] didn't refund me back. After 1 month, I saw that [redacted] bank took money from my account, the void check he deposited. I go to the bank and they told me that a dealer applied a loan on your name for 2 cars. I told the bank to stop the payment. I called [redacted] and asked him why he deposited the void check, why he hasnt given me my money back. He told me I'll get it back but he didnt give it back, a total of $16, 796.96. When I go to [redacted], he tells me to go to [redacted], and when I go to [redacted], he tells me to go to [redacted] and I still havent received my money.Desired Settlement: I think the fair resolution to my issue would to just get my money back.

To Whom this may concern:

I want to make clear that [redacted] did sign a contract with [redacted] Dealer Funding and I have proof of the binding agreement. [redacted] had his cars at our lot for 2 months without picking them up and we had to decide to payoff his loans. Due to the loss of money from our side we informed [redacted] that he could get a refund from us on a fair amount taking in consideration the losses we had when we payed off his loans to the bank. I have evidence of a signed contract and the process was explained clearly to the client upon signing the deal. It was sent to the bank as a normal contract is send and the charges were applied to the account as it is with all of our deals that customers sign. The client has been to my office and knows he can speak to me, I don't understand the need to file a compliant
