On August, XX XXXX Mr*** signed a BOLO membership the minimum term of months, Mr*** states he paid a membership "buy-out fee", this is something our company does not offer as the contract states, A copy of the contract was
provided at time of enrollment and always available upon requestOn 5/18/Mr*** did pay $which was applied to his monthly duesIn regards to voluntary reimbursement received from our facility directly, our records show no refunds processedIt wasn't until December 7th Mr*** came In to cancel his membership and did not cancel his add-onIf both members are not listed on the cancel form (as the form signed indicates) our facility does not know the second person wishes to be canceled; therefore we will continue to bill
A copy of Mr*** agreement as well as the signed cancel farm is attached, At this point we have relieved both memberships from their contractual obligations and will no longer be contacted by our facility

The response from Palm Springs Fitness is inaccurate and untruthful due to the following:
* I asked several times for a copy of my contact and was refused a copy - the staff told me it was locked up and would not offer a similar blank contract for me to reviewI asked for the contract to be mailed and even emailed and the contract was never received
* The "buy out" was Palm Springs language to end my obligation; I was told by palm springs fitness $was required to end my obligation and it was for two peopleThe amount shows and proves my intent
* Palm Springs Fitness does not mention I was being charged multiple times, where the last charge was 12/11/(see my timeline)the fact palm Springs fitness credited back each charge proves they understood my obligation was paid in full
* I never signed a cancellation form - this was all processed by Sergio over the phone, as $was charged over the phoneThe argument of stating two member names on a cancellation form falls short, as I did everything over the phone
* The fact is $was received to cancel my full obligation and trying to blame on a form that was never completed by me shows Palm Springs Fitness lacks integrity and made up fraudulent documents
* most importantly, I had to escalate this situation to the Revdex.com to rightfully have my obligation processed properly, even after many phone calls to Palm Springs Fitness to ask them to fix the situation and not once did Palm Springs Fitness apologize for the situation of being harassed by a contracted trainer or a sorry for the membership situationThis shows the character of Palm Springs Fitness, which is poor

I do believe this is a matter of miscommunicationIt is true that we keep contracts locked at all times due to sensitive information on themA request for copy can be made and provided by our back office within hoursDo to this incident; we have retrained our staff on how to handle this situation and apologizeAs I had said in the first response, we do not accept cancellations over the phone; however after further review I do believe this was an exception made for Mr***, and management did not properly follow procedureBoth memberships have been cancelled and Mr*** will no longer hear from our facilityOn behalf of Palm Springs Fitness Center I apologize for the inconvenience and grief this has caused Mr***

been the club policy for the years the facility has been openMs*** states in her complaint that our previous manager *** told her there is no cancellation to signHowever, *** had been correctly cancelling members of the facility for years and very aware of the club policyOur members are important to us and more often than not we have members that come in with the intent to cancel their membership and in an effort to accommodate them we offer them other options to keep them as loyal membersThis is generally appreciated as it keeps them at their low monthly dues and motivates them to get back into shapeIt is our belief that the same options may have been given to Ms*** when she came in to cancel on 3/17/Since *** is no longer here and Ms*** hasn't used the facility, in good faith we have decided to honor her request to cancel on 3/17/and remove all past due balance

semi-annual maintenance fee of $30.00. Mrs. [redacted] claims she did not agree to these changes and the initials were forged at a later date. We take the allegations serious and have asked her to bring in her copy of the contract numerous times so we could take care of this matter and she has ignored such request. Until she provides us with her copy we have no choice but to stand by our signed original agreement.
