Initial Business Response /* (1000, 9, 2015/12/30) */
Customer was notified by mail that vehicle retail sales contract was being cancelled due to financing not being available. Customer was unable to provide proof of income that was acceptable to bank. Once customer arrived at dealership, dealer...

unsuccessfully attempted to secure other finance options. Customer was then informed that deal had to be unwound.

Customer did not want to leave vehicle until he received a refund for his down payment. This was acceptable to dealer until customer informed dealer that he had cancelled insurance on vehicle which is a violation of the sales contract and against California law. He was told that he would need to add insurance to drive vehicle off dealership.

At no time did Dealer make any verbal or physical threats to customer. It is unfortunate that Dealer had to unwound vehicle, but customer was unable to provide proof of income as required by bank.

Dealer has a sign posted that all refunds are provided by Company check that normally takes 3 days to process from our corporate office.

the document Kia sent to my residence said any money put down on vehicle will be available when vehicle is turned in. the insurance was cancelled that same moment we turned in the vehicle to Kia. The contract was never violated. Kia did not want to pay the fee to finance the vehicle through West lake per sales associate Cedar. Kia created a scene when they saw we wanted to leave until they gave us the money I put down as a down payment. Kia employees surrounded our vehicle and one demanded the keys and took my personal keys with them and did not want to give them back until I demanded for my property was returned. I have pictures of how kia blocked our vehicle and did not was us to leave the property. Kia employees were ready to assault me and my spouse if we did not turn in the keys. I should press charges against Kia of Palm springs for theft. They did not go by the legal document stating money will be returned when vehicle is returned.

We are writing in response to the complaint by [redacted] Case #XXXXXXXX.
A 2005 Cadillac was previously purchased by Kevin Lachapelle [redacted]'s husband. The vehicle had some repairs done and was successfully returned to husband [redacted] Customer was given a loaner vehicle each time the vehicle needed service. Mr. [redacted] has been given copies of all work performed on his vehicle. Smog was done and vehicle passed. 2nd Vehicle purchased was a 2015 Kia Soul and deal did not go through due to issues with funding bank determining that customer had provided fraudulent employment verification. Customer was advised to bring car back to dealership. Vehicle has since been returned and no further deals with the [redacted]/Lachapelle's are pending. We will not be compensating customer for providing false information to the bank and deal being denied based on that. We have also remedied all issues with 2005 Cadillac in our service department.
