I am writing on behalf of my year old motherIn February she gave Palmas Del Sol 4,good faith deposit for a homeUpon applying for a loan she was turned down as with her current home her debt ratio was too highWe told the woman at the office we would have to sell the house firstShe stated she would have to show the other house in the mean timeWe agreedMom sold her house last week and thinking since there was no contact the house was still availableWe were told no, house was sold and we forfeited the moneyShe informed us that we had to be turned down by three lending institutions to obtain a refundWhen confronted that we signed no such contract and were unaware she stated she had tried to call for three months and my voicemail was full (My Apple iPhone says different)
She then called back to state the company would credit us 2,if we bought a house thereShe told me the home owners of the house we wanted were given the balanceI then called the corpora

While we understand the Revdex.com is there to assist in any disputes between businesses and the public, we also understand the limitations of the organization in truly resolving this matter.Let me clarify a few points:1.  Complainant's ([redacted]) statement that a $4,500 deposit was made to...

purchase a home is not accurate - there was an earnest money deposit recorded at [redacted] Title Company for $4,000.  [redacted] provided a cashiers check on or near March 1, 2017 to [redacted] Title.2.  The complainant and [redacted] both signed an Offer to Purchase and Acceptance contract to purchase a home from residents in the community of Palmas del Sol (Not Palmas del Sol East as the Revdex.com has indicated.)  The dates of their signatures are February 20, 2017.  In the contract, Buyer had indicated that the purchase would consummate on or around March 21, 20173.  The contract was written with no conditions or contingencies of sale by the Buyers4.  The contract clearly indicates that "If the offer is not accepted (by the Sellers), earnest money shall be refunded in full.  If the offer is accepted, and Buyer does not complete the purchase as specified, earnest money shall be forfeited."5.  Seller accepted the written offer from Complainant and Ms. [redacted] on February 21, 20176.  The complainant and Ms. [redacted] did not complete the transaction by the specified date agreed upon by the Buyer and Seller7.  The Sellers were harmed in this transaction to the extent their house was taken off the market during a very robust Seller's market.  Had the complainant and Ms. [redacted] not offered and signed a contract to purchase the Seller's home, the Seller could have found another willing Buyer instead.8.  The complainant and Ms. [redacted] already own two other homes in a sister community of ours.  They are well aware of the rules and conditions of our Sales contract9.  Ms [redacted] is currently in escrow to sell her house (one of the two as described in #8).   As the Seller, she has signed and has agreed to the terms of our Offer to Purchase and Acceptance contract for the sale of her home.  This is the exact same contract that she is saying she has an issued with above.  It's just that she is now on the opposite side of the transaction and would want us to enforce all provisions of the contract should the Buyer of her home default as the Complainant and Ms. [redacted] had done.10.  I personally have attempted to reach out to Complainant by phone on three different occasions.  Each time I received her Voicemail and the message was that her mailbox was full and that I could not leave a message.  480 309-200711.  My salesperson has also attempted on many more occasions to reach the Complainant by phone with the same result that I had - she could not leave a message.12.  I also have a 6 page Manufactured Home Escrow Instructions from [redacted] Title & Trust in Tucson, AZ signed by the Sellers and the Complainant and Ms. L. Epley.  The date of the document is February 20, 2017.  Complainant and Ms. L. Epley both signed the agreement on 2/20/17.  This agreement clearly states:"Hereby employ [redacted] Title & Trust of Tucson to act as Escrow Agent in connection with a sale by Seller to Buyer upon the following terms and conditions which shall be complied with by said parties on or before March 20, 2017 or sooner thereafter . . ."13.  On or about May 1, 2017, [redacted] Title forfeited the deposit according to the terms of the signed escrow instructions and agreement.  [redacted] Title forfeited the Buyers' earnest money deposit since they failed to consummate the contract on or before the contracted and agreed upon sales date.14.  Complainant's statement that "Since we signed no contract, we were not in escrow" is completely inaccurate.  There in fact are two different legal and binding documents that Complainant and Ms. L Epley signed as demonstrated above.15.  Complainant is merely refusing to recognize that she entered in a legal contracts and now has decided that she does not want to comply by the terms of said contracts.   Age of the Complainant's mother is not in question.   We can demonstrate that the Seller was harmed by the Buyers' inability to complete the transaction on timely basis.16.  In a show of conciliation to the Buyers, I have authorized the sales agent to offer a credit of $2,000 towards the purchase of any other home in any of our 5 Arizona manufactured home communities.  We currently have 4 communities in Mesa, AZ and one in Apache Junction.   So far, Buyers have not responded to this that I am aware.We are confident in our legal position in this matter.  Because the Complainant is currently residing with her mother in one of our other communities, we are sensitive to her as a current resident whom we would like to keep on a long term basis.  But we cannot change the terms of any contract just because a party to contract changes his/her mind or cannot perform to the terms that they originally agreed upon, regardless of the ramifications or their actions or inactions.Thank youRon T[redacted]
