Palmer’s Towing and Recovery, L.L.C is contracted by the Management Company of [redacted] to monitor the complex.  Originally, we would check the property for vehicles which were deemed inoperative and tag for removal should...

the deficiencies not be corrected.  We also would respond to requests to remove vehicles when contacted by a Chesterfield Police Officer who patrols the complex as an off-duty job. 
After receiving numerous complaints from residents of illegal parking in driveways, the complex, after conferring with the Police Officer, enacted a “Parking by Permit Only” policy when parking in the driveways.  Palmer’s Towing and Recovery, L.L.C. supplied the permits to the office and they were distributed to the residents.  The policy stated where the permits were to be located on the vehicle (inside lower driver’s side windshield) so they could be easily seen. The policy also
advises vehicles in violation would be towed at the owner’s expense. This policy took effect July 1, 2013 after the complex gave the residents ample notice.
Since the policy was enacted, it is customary practice for Palmer’s Towing to randomly check the premises for vehicles in violation, sometimes at night or in the early morning hours.  Although decals are to be displayed in a certain location, we make every attempt to make sure a vehicle does not have a decal in an alternate location.  Since it can be dark when we are checking the complex, this is the reason the policy states a specific location for the decals. Again, we make every effort to ensure a vehicle does not have a pass prior to towing but some are put in places which are not visible, even using flashlights.
The vehicle in question was towed after two Palmer’s employees checked it for a pass.  After receiving a call in the morning,  during the daylight hours, employees were still unable to locate a pass on the vehicle.  It was not until later, when someone came to the lot to pick up the vehicle was a pass located, but only after she lifted up one of the windshield wipers.
Regarding her claim the Colonial Heights Police were called to Palmer’s Lot, this is true due to comments made on the phone which raised safety concerns for our employees.  Due to liability issues, Palmer’s Towing can only release vehicles to the registered owners or if we receive previous authorization in writing (e-mail, FAX, etc.), allowing release to a specified representative.  This was explained to the complainant yet when she arrived at the lot, she was neither the registered
owner nor did she have anything in writing authorizing release of the vehicle to her.  She promptly left leaving “an Aunt” and we had to wait for over an hour for her to return.  Upon her return, we still had to wait an additional half an hour to receive an e-mail from the registered owner allowing us to release the vehicle to her. 
Prior to her leaving the first time, she was informed our normal business hours were until 5:00 PM and if she was not back prior to that, they could be an additional charge of $45.00 for an after hours release.  Although we were there well after 5:00 PM, we waived the fee and did not charge her.
Palmer’s Towing & Recovery, L.L.C makes every attempt to ensure vehicles do not have a valid pass prior to towing from the complex.  Unfortunately, this pass was on a piece of glass obscured by a windshield wiper.  Had the pass been in the proper location, the vehicle would have never been towed.  Also, had we not had safety concerns for our employees, due to comments made on the phone, the Colonial Heights Police would have never been called. She had also been to the lot earlier during the day along with her daughter and caused issues. Lastly, prior to leaving the lot with the vehicle, the complainant was advised that she needed to place the parking decal in the correct location.  In front of a non-employee who was at the lot repairing some equipment, she stated she was not moving the pass and dared us to tow the vehicle again. 
Attached is the Policy handed out to all [redacted].  Also attached are the 2 photograph of the vehicle windshield. One shows the windshield wiper in the up position and where the pass is located making it all but impossible to locate at night even with a flashlight.

approximately 1AM on October 2015, the complainant called our business advising he had just returned to town and discovered his vehicle had been towed.  He was asked if he was the registered owner to which he advised he was.  He also advised he was working as an undercover police officer and he never knew when the criminals would be caught, this is why he had been gone so long.  He said he would contact us the next day.  At approximately 4PM that afternoon, he called advising he wanted to pick-up the vehicle but when told the price for towing and storage, he said he was going to contact the business who had the vehicle towed. 
The business called later that night/early morning informing us he was there wanting to get his vehicle.  They asked if there was anything we could do to assist him since he was working.  They were asked if he had identified himself as an undercover police officer and they confirmed he had - from NYC.  The complainant was metat the business and the local police met all parties.  The police were unable to determine the validity of him being an undercover officer.  They informed him to pay the towing and storage bill then lodge a complaint with the business who had the vehicle towed.  It was also determined at the time the complainant WAS NOT the registered owner of the vehicle.  He was informed only the registered owner can pick-up a vehicle and he said he would work on getting power of attorney. 
Palmer's Towing does not monitor parking lot of the business from where the vehicle was towed.  Until the S10 was towed, we have never towed anything from the lot.  This time, Cindy who is an employee of the business called and asked us to remove the vehicle.  The night we met the complainant and Police at the business, they said Cindy did work there but was out of the country on vacation. 
The Complainant arrived at our storage lot on Wednesday, October 21st, 2015 attempting to get items from the vehicle.  While he had a power of attorney with him, it was only valid if the owner had been declared disabled and he brought no proof of that.  He also did not bring the keys to the vehicle with him.  The local police once again responded to the lot, this time the officer was from NYC and was very familiar with NYPD.  He made some calls to NYPD/1PP and could not confirm the credentials - which he held until he could conclude an investigation.
In conclusion, the vehicle was not illegally towed.  We were contacted by Cindy of the business to remove the vehicle.  We do not monitor that lot and have never towed anything from it prior to this occasion.

Review: This company falsely towed my vehicle ( [redacted]-) without authorization or request from the parking lot location for which I had permission to use and now refuse to release my vehical to me unless I give them $1300.Desired Settlement: I want my vehical returned intact and without damage to its interior or exterior. I want compensation for the taxi, and all other charges I incurred as a result of their action deemed proper.

Review: On the morning of October 7/2014 My vehicle was parked in my drive with a parking permit in the windows this was done after 1 am in the morning. I had the sticker on a Glass picture frame so that when I have visitors their car would not be towed. They dragged my car left skid marks in the drive way after contacting Palmers Towing they said that the sticker was not properly place that it should of been place on the right side lower corner on driver seat. I received 2 sticker about a year ago and was told by management that the stick should be place were it is visible in the front window .This lady refuse to identify herself was very nasty and arrogant, after hanging up the phone several times she said it was not her job to search for the sticker ,then said it was dark and she did not see the sticker .I asked her you did not have a flash light She rudely responded that's not her job to do so and if I wanted my vehicle that I had to give her 150.00 .she is so trifling that she charged me 125.00 for tow and 25.00 for other also she called colonial height police and said she was threaten , then I return to pick up my vehicle and she kept me there and tried to swindle more money out of me This company is bogus money hungry and down right disgusting I will be taken her to court for robbing me destroying my day and a refund of 150.00 outrageous how do they sleep not a business I would ever patron also staring class action suit they when through [redacted] and pull other cars out on the driveway where decent people pay rentDesired Settlement: Full refund and for them to never come back on property
