First of all I did not assign this complaint to Palmetto, the Revdex.com did - likely because Palmetto and the [redacted] have the same phone number.
Secondly, all information listed in my complaint is factual and true.
Thirdly you have provided a lot of superfluous information. The facts of the case are as follows:
1) The status letter was completed and paid for in advance.
2) My wife was not provided the completed status letter, even though it had been purchased by the time she personally came to the HOA to pick it up
3) The status letter would not be provided by the HOA until a rush fee had been paid even though it was completed, ready to be picked up and ready to be used. It was purposely being withheld by the HOA secretary. The court will decide if this constitutes contract coercion.
Exhibit A is a copy of the status letter which is extremely confusing and intentionally difficult to interpret. My closing statement clearly lists each amount charged by the HOA for various fees totaling $1,238.00. These are excessive and inappropriate.
Exhibit B - the HOA assessment collection policy - does NOT list or define all the fees I was charged. This violates CO state law. Thank you for finally providing it. Even though the fee schedule was requested prior to the closing, the HOA refused to provide it. There is no defined 'HOA Document Retrieval Fee', 'HOA Online Document Fee' or 'HOA Rush Fee' listed in the HOA assessment collection policy.
