Summary of Situation:

1. Strong odor immediately after interior wash continued to get stronger each day. The odor was foul each time opened door. After 1 week it smelled as if there was some kind of deterioration/decomposition etc of the chemicals used.

2. After approximately 2 weeks took car back and they recleaned the interior.

3. Approximately 2 weeks after this second attempt the odor returned with about 30% of original strength.

4. Right now I have a lingering odor in the car.

5. Fernando and another man who misrepresented his position lied to me stating owner was female. The owners name is Dave once I started to request with urgency to speak to owner. It was not until I mentioned a small claims solution that they provided me owners name/number.

6. Fernando did not call Nissan day after New Year ie January 2nd 2019 as he said he would.

7. Dave (owner) 100% uncooperative to contact Nissan for estimates on correcting the issue.

8. I have been a loyal customer and have been LIED to (was told owner is female in an attempt to deflect the escalation) and the owner refuses to come to satisfactory solution.

9. I am in contact with legal professionals in an attempt to remedy the DIMINISHED VALUE brought on by what appears to be permanent odor as a result of Palomar Hand Car Wash & Detailing.

10. Apparently the majority of reviews during the time this incident first happened are 1 and 2 stars meaning it is quite possible this business has capitulated to the downside and WILL NO LONGER BE IN BUSINESS in the next 1-2yrs despite having been in operation for 25 yrs per Dave. Review the last 3 months review for yourself and you will see people stating shoddy service and cleaning not up to par. They may have lost out on $15-25 and I am now out potentially thousands to remedy the situation of DIMINISHED VALUE due to ODOR.

Review: I paid $110 for a mini-detailing on 3/9/14. I arrived around 2pm and was greeted by an employee who commented that my car looked brand new and recommended waxing and detailing to maintain the perfect condition. After a 2 hour wait, I returned to the Palomar Car Wash and tipped the gentleman doing the work $10. I started my car and noticed an 18" crack down my windshield. I immediately asked what happened and I was told they would have to get a manager. The manager came up and said that the crack was there when I arrived and went on to identify several other breaks in the windshield and then showed my damage to the paint on the hood, mirrors, doors, etc. None of this damage was there when I brought my car in - in fact, I had just been to Ford for regular maintenance that same week and the vehicle was inspected as being perfect (as noted by the first employee I encountered at the car wash). The manager went on to state that it was a sunny day and that was the reason that my windshield was broken?? I asked if they were insured and he refused to answer me. I gave him my contact information and requested that the owner contact me. No one ever returned my calls. I turned my car over to AAA Auto insurance and it took over 30 days of collision repair and total $5608.36 in repairs to fix the damages that they caused. AAA tried to get the owner to to pay my $500 deductible, but they refused to accept any liability nor refund the initial service that caused the damage. The business has no limit of liability posted or printed anywhere - only that they valuables should be removed from the car. They caused all damage to my otherwise perfect vehicle and caused me to have to have a rental car for a month and have my car's exterior repaired/replaced. They did not call me back and refused to cooperate with my insurance agent.Desired Settlement: I would like to be refunded $110 for the service that caused the damage and paid $500 to cover the deductible of the $5608.36 in repairs that they caused. I want $610.00 paid to me.

I am in receipt of your letter dated 4/12/14 regarding the damage to your vehicle and windshield. To begin with, I am sorry that you feel this event occurred at the wash but unfortunately I feel there is no possible way all this damage could have happened at my facility.

You mentioned in your letter that we have not been receptive to your claim but I must contend that is not correct. I had several (3) phone conversations with your insurance adjustor when you decided to turn this over to your insurance. The adjustor was very pleasant and contrary to your comments that "we refused to cooperate with your insurance agent", in all actuality, your adjustor agreed with me that all this was very improbable and that he had the obligation to contact me. I had an initial conversation with him when he was assigned the claim and he reached out to me. I suggested he email the photos of the damage to myself, which he did. Immediately after receiving the photos I contacted him to confirm our position. The third call was a day or so later when I contacted him again just to reiterate our position and to see if there was anything else I could do at that point. As for me not contacting yourself, I apologize for not making that call but on my initial conversation with your adjustor, he specifically asked if he could have you call me to discuss the matter and my response to him was "absolutely". Unfortunately, I never heard from you and this is the first since my conversation with him.

As for the damage to your vehicle [redacted], my facility is a 100% hand wash. There is zero machinery that touches any vehicle. If this damage were to somehow happen than in all likelihood it would have happened to the vehicle in front of yours and/or behind yours. Your's was the only complaint regarding this issue. As you can see from the photos, your vehicle has "rock chips" on the front of the hood as well as the rear view mirrors which happens in the normal course of driving. [redacted], we see this every day with the vehicles that come into my facility and that is why we are not accepting liability. You may not want to hear this but IF we were to damage a customers vehicle I WOULD 100% ACCEPT RESPONSIBILITY AND PAY FOR ANY REPAIRS. We have been in business for 20 years and have never had a situation like this.

At this point, I must confirm my position that these "rock chips" were pre-existing and could not have happened at the wash. As a goodwill gesture I am offering to refund you the cost of your "mini detail" ($110). This is by no means an admission that we did anything wrong but simply a business decision that I made in light of the events. If you would like to accept my offer I would ask you contact me and I will handle it myself.

In summary, I am extremely sorry you had to go through this aggravation and inconvenience but I also feel we are not in the wrong. Customer service is extremely important to us and want you to know that your complaint does not come on "deaf-ears". We do care but also have to protect our interests, as well.
