On Friday evening I signed up and paid for a post-license class that started the following Monday morning. On Saturday morning I had an opportunity for a difference direction, career wise, and no longer needed to take this course. I called Saturday morning to try to cancel but the company is closed on Saturday and Sunday. On Monday morning at 10am I called and asked for my refund. They told me that because the class had started that morning and I did not give them 24 hours notice then I could only be refunded for a part of my payment. I argued that the timing of my sign-up, and the hours that they were open in which I COULD contact them were less than 24 hours total so there was no way that I could have given them 24 hours advanced notice. I had maybe 2-3 hours to have changed my mind on Friday. Given the impossibility for me to give them the 24 hours notice they wanted it is completely dishonest, and duplicitous for them to not grant me a full refund.Product_Or_Service: A post licensing Real Estate classDesired SettlementI want the rest of my refund. $75. We pride ourselves on being flexible regarding student registrations and rescheduling.All students agree to the terms of our Official School Bulletin when they register online for a course. The following is taken from that Bulletin in the section labeled "Refund/Withdrawal/Registration Change Policy"[redacted]If the school receives written notification from a student that they wish to withdraw from a course a minimum of one week prior to the first scheduled class date, the school will refund, in full, the tuition paid by the student for the scheduled course. If the school receives written notification from a student that they wish to withdraw from a course later than one week prior to the first scheduled class date but BEFORE the first day of class, the student shall have the option of transferring his or her registration over to a subsequent course with the school OR request a refund equal to one-­half the total tuition paid by the student for the course. Any student is entitled to this registration change ONE time per full tuition payment. Any subsequent changes will require the payment of a $75 administrative fee or the forfeiture of the full tuition at the sole discretion of the school director. There shall be no refunds whatsoever after the beginning of the scheduled course. A one-­time registration change after the scheduled beginning of class MAY be granted in times of emergency but this will be at the sole discretion of the school director and will require payment of a $75 administrative fee.[redacted]As is plainly explained in the above, this student would be entitled to receive no refund whatsoever as it was two hours after the beginning of the course when the school received any notification of her inability to attend. However, I did not want to see her lose her entire tuition so I refunded $135 of the $210 paid for the course. The student was also offered the option of transferring the tuition to another course at a later date with no penalty whatsoever.It should also be pointed out why we have such a policy. It is not uncommon for our courses to fill up and thus other students be denied admission due to no room in the class. This was the case with this particular course. This course was full and thus the spot held for this student prevented registration by other potential students.Furthermore, I find the contention that the student attempted to reach the school to be dubious as the school business office was indeed open all of Saturday from 8am until 5:30pm and Sunday from 9am until noon due to the high volume of classes and students this time of year. Someone would have been available during any of those times to take her call. The office voicemail box did not contain any messages from this student. Also, our email contact information is prominently displayed on the same website used for course registration and that box is monitored on nights and weekends. The student would have received a prompt response to email communication to that box.In short, we value our relationship with the public and with our students. This is the first complaint of any kind we have ever fielded regarding our refund practices, and I feel strongly that the student was treated in a fair and ethical manner by the school. [redacted]Director Pan School of Real EstateConsumer Response As I said, I called on Saturday and the voicemail message stated the office was open M-F only. No one answered the phone, there was no one available to help me, as I did try. According to Mr. [redacted], nyway as he states that the policy ihowever, it would haven't made a difference as no refund without a written notice a week in advance. What I don't understand, and find absolutely ridiculous, is that I did not have a week, or even 24 hours to fulfill that request as I signed up late Friday for a class that started Monday. I was NEVER able to fulfill that request and, according to the "policy", I had lost my entire tuition the moment I signed up because of the timing. Unlike people who signed up weeks before, who could have actually fulfilled the refund requirements policy, those who sign up with less than a week until class are not given the same opportunity to cancel. If that is how this company chooses to treat their students then that's their prerogative, but to hold people to a policy that they were never able to comply with seems criminal to me. I cannot make them give my my $75 back, and I'm really tired of dealing with them. I'm leaving it alone after this. They should be ashamed of themselves though, and I think prospective students should be warned about this unfair, and potentially illegal, policy. Final Business Response As stated previously, there is a written withdrawal/refund policy for all students who register for class. The student in this instance is focused on the fact that they somehow could not meet a deadline which was not and has not been imposed. If indeed the student did contact the school via telephone on Saturday, why not leave a voicemail message indicating they would be unable to attend and would call back on Monday requesting a refund? Furthermore, why not use one of the many available digital avenues to connect with us...our website (where the student registered) has our email address very prominently displayed under the "Contact" tab. We had no communication from the student until well after the course had begun.It is also incorrect for the student to state that they would have not gotten a refund at all had they given some notice. As it is, they already received a refund (without any protest or dispute on our end) of two thirds of the tuition they paid. We work hard to accommodate all students in a manner that treats them fairly. Even though the written policy calls for a no-show students to receive no refund at all, I don't recall ever actually imposing such a penalty with anyone simply because we want them to attend and to be satisfied.I will reiterate that the student in this case was offered the opportunity to move their registration to another offering of the same course completely free of charge OR have a refund minus a $75 administrative charge. Please keep in mind that we prepare materials and hold that seat for registered students so when they do not show up, there is a real cost associated with that.I feel it also fair to point out that any advance notice whatsoever would have resulted in this student getting a full refund. Had a voicemail been left or an email sent, we would have (and have before) refunded the tuition without reservation.As to the student's assertions that the policy is unfair and potentially illegal, I would simply state that all of those policies are approved by the North Carolina Real Estate Commission.
