I never said we weren't taking responsibility nor did I say that we refused to do anything, all I requested was more information in order to handle properlySince that was not provided, I contacted *** who is *** ** *** at paradiseHis response was the following
Homeowner treated for fungus on his own which could have possibly interfered with our treatments
Overwatering was a constant issue
The homeowner also opted out of bimonthly treatments and was only treated quartly

I am rejecting this response because: The statement is no more than a refusal to meet their responsiblityThe tree that was installed was not in good condition and did not look like the same tree that we picked out at the nurseryWe did not plant the tree, Paradise Landscaping & Nursery employees didWe were advise by our *** (*** *** ***) to have them do the landscapingHe is familiar with this problem and has discussed it with the ***For almost a year they have been telling us that they would replace it if it diedNow that it has died they refuse to honor their warranty and statement concerning the treeThey knew we lived out of state, that is why we contracted with them to do the fertilizing and make sure the tree and shrubs they planted would liveWhy would they have not contacted us if the tree or shrubs were dying to advise of additional services that my be needed We had contacted and discussed this tree many time over the year and they never said anything concerning additional water or any other needs of the treeThey have never tried to contact us concerning their refusal to take care of the problem and have not returned phone calls when requestedPlease contract Mr *** if there is any question concerning what Paradise Landscaping & Nursery said, which he has knowledge.

The tree installed at [redacted] was not in poor condition when installed. This was a young tree and usually a young tree takes time to fill in and look full. This was the size tree homeowner chose. When a homeowner plants a tree and lives out of state, we can't be expected to watch over that...

tree for an entire year. It says in this letter that we were contracted to take care of the tee for a year. Please have them provide a copy of the contract that says those exact words. I have never heard of such a thing. Just because one of our employees is no long with us, does not mean we aren't willing to work with a homeowner on certain situations. In order to properly respond I just need more information please.

I am rejecting this response because: When I went to the office concerning the replacement of the tree I was told they had no information and I had to  contacted [redacted] concerning this issue. I contacted him several time and asked him if he would come to our home to view the tree. He never came to our home nor did he return my call concerning getting a replacement or being reimbursed.  I was never took that they needed more information. What information would they need. They planted the tree, they maintained the tree, they warranted the tree for a year and they were advise several time that the tree was not in good condition at the time it was planted and through out the next nine months.  I never had any treatment for fungus. The water system is only on once to two time per week as controlled by [redacted] but if overwatering was an issue why did they not contact us and advise.  We did not opt out of bimonthly treated we were told by the prior [redacted] that quarterly should be fine based on them letting us know if there were any problems. Their statements are not true and no more than an effort to not be responsible for the warranty and lack of maintaining the plants and tree they planted. As a community business I would hope they would take responsibilty concerning their warranty, which would show they are concerned about their customers.  I would request payment infull as stated before.

I'm sorry I didn't realize the complaint was still open and active. The homeowner and I have been working together to resolve this through the city. We talk almost daily to go over updates, as of right now we are still waiting on the city to issue the permit in order to resolve issues. On our end...

Update: Drainage work as been completed as of 07/28/15Pavers issue is still being worked on with the city, we submitted survey and they kicked it back. Survey company is fixing survey and then we will resubmit. Note: we have been in constant communication with the homeowner through all of this and continue to work at getting everything resolved. Unfortunately when working with the city and survey company things take a little time. We are doing all we can and will continue to. Thank you [redacted]
