Respond to Complaint,It is true we were hoping for end of May installAnd it is correct that I did not know that in Jefferson Co you would had to attend a soil class because they do not accept it from any other countyWe had to wait days to attend class because they only have it at certain timesSo because of that we did not get started until middle of JulyOnce we started we stayed on it but we have no control over the weatherThe customer has a very nice yard so there was only one way in and outSo if it is the least bit wet, there is no accessCustomer wanted to supply his own rock, so we had to wait a few days after the pool walls were set and bond beam was poured before we could backfillAgain rainAnd yes when I came to the job site I noticed one of the side walls had a slight bow in it and I had my guys fit it and in doing so the grout on the inside had minor damage which we also fixed(Rebar was only used as a brace, the liner would not go over it.)I also never asked for full amountWe have a draw schedule according to contract, that was what was suppose to be paidI have no ill feelings with the customer, I think he was just irritated because the pool was not finishedStarted in mid-July, this is end of August and the liner should be installed this weekend so he can begin swimming in itWith all the weather issues, permits and access, that's days not the usual 2-weeksAnd also it was true that I had some health issues, which was also beyond my control.I have never left a job unfinished and this one will be no differentSide note: I agree that communication is not my strongest point but I have installed hundreds of pools and so far I have had happy customers and I'm sure this one will be the same

I am writing in response to Paradise Pool owner response to the complaintHe stated that installers do not haul away dirt or do landscapingThey also do not backfillParadise Pool owner came by the house on 6/2/to inspect the pool after it was installed on 6/1/Paradise Pool owner only looked at the pool but did not have a checklist to see if we received everything that came with the poolI let Paradise Pool's owner know that half of the pool was already backfilled and wanted to know why the rest was notHe stated that if he backfills the pool it would void the warrantyAccording to the warranty that was not given to me at the time of the installation of the pool, it states, "the warranty is null and void if the design of the product is altered in any wayInstaliation below ground level or leaving the pool empty will void this warranty." The installation sheet for above ground pools clearly states the customer responsibilitiesNumber under Customer Responsibilities states that Trash/cardboard disposal is the customers responsibilityNumber under the same heading states that it is the customers responsibility to assemble the ladderI will attach a copy of the Installation sheet showing thatAlso we have given the customer a copy of the warranty paperwork twice nowThe customer still has not paid for the pool installation and owes a balance of $That was to be paid at the time of installation and now it is a month later and still unpaidWe have done all the work set out in the sales order and the installation sheet and now it is the customers responsibility to pay

As noted on the Sales Order under the agreement of sale that is given to the customer as their receipt of payment, it clearly states: Installers do NOT haul dirt away or do landscaping. Installation does NOT include backfilling. It also states:All items are covered under a manufacturer's warranty....

These are the only warranties that apply.The customer should not have purchased the pool and install if they did not agree to these terms.Upon talking to the customer,  after they complained about the pool NOT being backfilled, I told them that we do NOT backfill against a pool, which again is stated on the Agreement of sale portion on their sales order.Also, yes we have bilingual people that work for us. They speak both Spanish and English, and to each other they speak Spanish. If the customer has a problem with people speaking Spanish, that sounds like a personal issue. I went out to the customers house to address the complaint of no backfill, and after talking to them I told them I would backfill for them anyway, which is beyond the scope of work that is agreed upon on the sales order, but I told them my skidloader was on other jobs and as soon as I could get back there to backfill I would, again though, this is not in the normal scope of work that was agreed upon by their purchase and not something we usually do, and if I do they have to sign an agreement stating that they requested the backfill because it usually voids the pool warranty from the manufacturer and I will not be held responsible. However it is June 10th, in the middle of pool season, and I have many pools to install, and as I told them, I would get to it as soon as my loader was freed up, and then I will get to them. It is not keeping them from swimming in their pool, and I have completed all the work that was in their sales order agreed upon for an Above Ground pool installation, so since they are requesting extra work, as I stated to them, I will get to it as soon as possible. The amount of sand and lime is the same amount all installers require for pool installation, it is the proper amount based on the size pool the customer purchased. This does not mean that it is always completely used as every persons land is different and may require less, however, just like any other professional installer  The warranty that they say was not given to them comes in the box with the pool. If they did not get that we will gladly get a copy of it for them if they request it. They have been given everything that came with their pool package, the ladder and vacuum hose was given to them when realized that it wasn't with the original delivery.  They however have not paid in full. They have only paid  $2,535.00 of the total price of $3,069.43.  They still have a remaining balance of $534.43 that was supposed to be paid at the time of the installation and has not been paid yet. Again, I have completed all of my work to be done that was agreed upon in the sales order under the Agreement of Sale portion so they now owe the balance. I have attached a copy of their Sales Order with the portions circled that we are discussing in this letter.[redacted] Owner

I hired Paradise Pools to install my above ground pool.VERY VERY SHADY BUNCH! Let me start by saying the ruined my yard with the bobcat they used, the obviously did not know how to use one. They did not install the pool correctly, they dug way to much, did not measure correctly, the pool sides were intalled uneven, they did not put enough sand under the pool as you can see the bars that run across the pool right through the liner at the bottom. My filter was installed wrong. Everthing was wrong. I have since had [redacted] come and inspect the pool as Paradise pools is a sub-contractor through [redacted].DO NOT USE PARADISE POOLS IF THEY APPEAR ON YOUR CONTRACTORS LIST,BEWARE! I have since had to hire another contractor to take the pool down and re-install. I have also had to have alot of yard work done to fix what they have done to the yard.Desired SettlementI would like Paradise Pools to accept responsibilty for ruining my yard and the installation of the poolBusiness' Initial Response It states in the contract between Paradise Pools and [redacted] that we are not responsible for anything that happens to the yard during installation. We state that for a reason since we are using heavy machinery. The person operating the bobcat has the appropriate license and plenty of experience. We dug extra around the pool for a reason. [redacted] asked us to add a retaining wall around her pool and also a patio. We have a signed invoice with all this information on it and even received a deposit. The day after she signed it she cancelled the check, which included the install payment, and told us not to show up. There was nothing wrong with the pool and when she was asked what specifically was wrong she replied "I don't know, it just is." We talked to the installer that was going to take it down and re-install it and he told us that she cancelled at the last minute on him so as of now she has not paid anyone for the installation at all and I would need proof to believe otherwise. We have never had a problem with any other customers and go above and beyond for every one of them, even [redacted]. She has no right to judge our employees and saying that they are a "shady bunch" is just her opinion and has no truth to it. I do not feel we owe her anything and would like to get paid for the work we did do so that we don't have to go to extreme measures to collect since we do have a signed contract. Consumer's Final Response (The consumer indicated he/she DID NOT accept the response from the business.)The contract states nothing of the bobcat it states dump truck on the lawn not bobcat.I did not discuss anything of a retaining wall until after the pool was up.I had to pay another contractor to build my yard back up to grade level pool was put up unsafe on side was sinking into the ground.The reason I stopped payment on the check was because I posted a picture on facebook someone seen who was in the picture and told me to have the pool checked out they used Paradise Pools and they did the same damage to their yard dug way too deep and all the bars are coming up through the ground from paradise pools putting the pool up incorrectly and not using enough sand.My pool did not have enough sand on the bottom on side was not straight.Another contractor took the pool down from it being not safe had to build the ground back up to grade and I had to get a new liner from it being stretched the wrong way.I have all the pictures to prove the pool was unsafe Paradise Pools did a awful jobBusiness' Final Response The building of the retaining wall was discussed during the digging of the pool before it even went up which is why it was dug like it was. We would not have done it otherwise. The hole that was dug was for a patio which she also wanted and even gave us a deposit for before cancelling the check. If there were any problems at all with the yard or pool she should have contacted us immediatly. It was her own choice to ignore us and pay someone else to do it, and thats if she even really did. The yard would have been in perfect condition when we were done but instead she cancelled our payment and we were not going to do any more work for free. Even after she did that we went and put the fences back up, free of charge, until someone could check it out. As I said before, there was nothing wrong with the pool and it most certainly was safe.The people that she told us said it was wrong do not even install pools. As for the person that commented on her facebook picture, even though its not any of her business, he caused his own damage to his pool and we still offered to helphim out. [redacted] did not even think anything was wrong until this certain customer fed her lies. I still feel that we do not owe her anything.
