Attached is the application and 2nd page is the “Contemplated Lease Contract”.  Paragraph 7 of the Application Agreement is where it states we can retain the application deposit if you withdraw.

Thank you for your help.

Sincerely,

Attention: Dispute Resolution Team

I talked to [redacted] when she cancelled and let her know that the deposit was not refundable since she was canceling her application.  She clearly signed the back of the application understanding the deposit is non-refundable if she cancels and is considered as “Liquidated Damages”.  When she leased the apartment [redacted] and [redacted]  said the deposit will be cashed once the application is approved.  They might have told her it was a refundable deposit if she fulfills her lease contract and there are no damages to the apartment home.

When she left on the day she cancelled, she was not happy with me at all because I told her there was nothing I could do because she sign the application agreeing to the terms of the Contemplated Lease Contract.

At this time we are not agreeing to refund the $400.00 application deposit.  [redacted] signed the application and agreed to the terms as stated in the Contemplated Lease Contract.

Please let me know if you require any additional information.

Sincerely,
