Please be advised that we investigated [redacted] ’s complaint and respectfully disagree with her characterization of the manner in which her application for an apartment was processedWhen we reached [redacted] ’s application number, we made a good faith effort to reach out to her both telephonically and in writingOur efforts in reaching her were successful and we mutually scheduled an interview for July **, [redacted] was mostly cooperative during the applicant interview, until we requested information concerning her student status and income from educational pursuitsAs [redacted] applied for a federally-subsidized apartment, we are required by federal statute to confirm, among other things, the student’s eligibility for Section assistance (in accordance with CFR Part 5, Section 5.612) and verify any financial assistance received for education in excess of tuition and fees which, in accordance with CFR Part 5, Section 5.609(b)(9), is considered in the household income calculation and utilized to determine the household’s level of benefitsWe have determined that [redacted] is eligible for Section assistance under the HUD student status requirements, however, we have been unable to determine the presence of any educational incomeDuring the applicant interview, on multiple occasions, [redacted] repeatedly made clear that she is a full-time graduate student and provided documentation confirming such, however, this paperwork was deemed insufficient as it does not reflect in any manner the information necessary to make an income determination [redacted] ’s continuous references to her graduate studies is irrelevant for our purposes and does not qualify her for any exemptions from the educational income calculation requirementsHUD requires applicants to provide management with appropriate income documentationHowever, since the documentation provided by [redacted] to date has been insufficient, we were forced to verify the applicant’s educational income information directly with the source as authorized by HUDTo this end, we faxed a third-party verification form to [redacted] ’s educational institution on July **, Since we received no response, we left voicemail messages for the appropriate representative on August **, and August **, 2016, prior to the receipt of [redacted] ’s complaintUnfortunately, to date, our good-faith efforts to properly verify this information in accordance with HUD requirements have been unsuccessfulAgain, we will gladly accept appropriate documentation (generated by the school) from [redacted] confirming the amount of financial assistance she receives for education and her tuition/fee expensesOf course, we will exclude any loan pro ceeds (as claimed by [redacted] ) from the income calculation as required by HUD as long as it is clearly documented through the verification processIn addition, management will gladly review any and all calculations with [redacted] Reviewing income and rent calculations with applicants is a very common practice in our organization and we will extend the same courtesy to [redacted] However, please be advised that the estimated figures recently provided to [redacted] are only preliminary and were intended to provide her with an idea as to the dollar amount of the security deposit and tenant rent for which she would be responsibleSuch information benefits applicants as it enables them to prepare in advance for the moprocessPlease note that the amounts provided to [redacted] are subject to modification depending upon the outcome of our verification efforts with her educational institution and any changing income circumstancesFurther, we are hopeful that [redacted] will consider that we are an extremely busy office tasked with serving thousands of low-income applicants and residents on a daily basisUnfortunately, we are not always able to meet [redacted] ’s demands for immediate attention, however, should staff be preoccupied fulfilling other responsibilities at the time of her call, she should feel free to leave a message with the front desk and the applicable representative will return her call at the earliest opportunityAt this stage, we are simply preprocessing her application to ensure she is fully-prepared to promptly moto a subsidized apartment once offered (assuming she meets all of the HUD eligibility and screening requirements)Finally, [redacted] should know that our staff receives regular training on an ongoing basis regarding various advanced aspects of our affordable housing program, including HUD’s student status and educational income requirementsIn addition, company policy prohibits the sharing of information with unauthorized persons and our representative named in the complaint confirmed that no information was shared and no other individuals were present in her workspace during the meeting with [redacted] We are glad to process [redacted] ’s application for housing and look forward to having her as a tenant (again, assuming her eligibility for the program), however, we respectfully request her patience as we must comply with HUD’s verification requirements and, to date, continue to await the receipt of appropriate verification from her educational institutionOf course, we will accept appropriate documentation (generated by the school) from [redacted] reflecting the aforementioned, outstanding informationShe may also wish to speak directly to the school’s representative to encourage him to respond to our verification requestWe appreciate your intervention in this matter
