Consumer response received VIA e-mail as follows: [redacted]I have read through parkview's response. It is very innacurate. We originally told them about the shingles several years back when this first occured. We paid a couple cintratractors on different occasions (which I have the receipts for) to repair the shingles that blew off.The very first contractor told us then that more shingles would continue to blow off because they were nailed incorrectly. This occurred several more times in different areas. I have had 2 other roofers from 2 other Companies( who I paid) repaired shingles in different spots. The rep they sent to my house was a sales rep and not only wouldn't go up on the roof, he admitted he wasnt qualified to access. All three Contractors said this would continue to keep happening because there is no seal due to incorrect nailing. Against mfg install guidelines.  I provided the report from one of the roofers to Parkview Parkview told me I had to contact the mfg and complete a warranty claims packet because they only carry a 1 year warranty unless they were I stalled incorrectly. I did so and provided the mfg with several shingle samples, pictures and all  information they requested. After completing there analysis, they concluded that it was very "evident " that the Installer did not follow the install Instructions privided by the mfg on every single bundle of shingles. I even followed up with the mfg by telephone to verify what I was reading. The rep I spoke with said there was no doubt these were installed incorrectly. Both photos and shingle samples scientifically verify that. I provided Parkview those findings over 3 weeks ago.

The issue that I am having is not an issue that needs to be addressed by arbitration.  The home was a new home that was purchased and the builder performed a walk through prior to closing.  Another walk through was performed at 90 days and then I was required to provide a list of times that have been identified during the first year of living.  This is what the builder has done on this home and every other new construction home.  By the builder doing this, they have implied that the home is under warranty.  At the 1 year walk through I provided the builder a list of items.  The builder addressed some but was told to contact the subcontractor directly.  The builder and the subcontractor hired an independent hardwood inspector to inspect the flooring issue.  The independent inspector found the floor to be defective.  The subcontractor sent the report to the manufacturer who deemed the floor to be defective.  The floor installed by the subcontractor on behalf of the builder is defective.  This is not an issue that needs to be handled by arbitration.  It is very clear that the floor is a defective floor per the independent inspector hired by the builder and subcontractor and that the manufacturer agreed with the report.  The builder needs to stand by the product that they sold and replace it!

E-mail response received from the consumer as follows:  I still haven't got a call to schedule, and haven't received the check yet. As soon as I get the call and they actually  repair the roof I will let you know.
