MrG*** entered into a monitoring agreement with AAA Alarm & Security, Inc(AAA) on 09/30/Below is the language in the monitoring agreement about terms and notice requirementMONITORING SERVICE(a) Continuous Monitoring Service. AAA Alarm agrees to
provide continuous monitoring of the Security System at its central monitoring center and, in the event of an alarm, to endeavor to notify the persons named in the Emergency Data Form attached hereto and incorporated herein by reference. AAA Alarm may, in its discretion, provide the continuous monitoring service by means of the cable television system or by means of the telephone system, or both, from time to time during the term of this Agreement. Subscriber agrees to subscribe to the Monitoring Service for the INITIAL TERM OF TWO (2) YEARS. Subscriber’s agreement for Monitoring Service shall AUTOMATICALLY BE RENEWED FROM YEAR TO YEAR THEREAFTER UNLESS EITHER PARTY NOTIFIES THE OTHER PARTY OF TERMINATION, IN WRITING AT LEAST THIRTY (30) DAYS BEFORE EXPIRATION OF ANY TERM of the Monitoring Service Agreement The most recent one year renewal of MrGi*** agreement occurred on 10/01/MrG*** was invoiced and has paid for monitoring through 09/30/On July 25, MrG*** telephoned AAA to say that he had moved his monitoring to ADT SecurityMrG*** was asked to provide AAA with a written request to stop his monitoring (this written request well exceeded the day notice requirement in the monitoring agreement)He was also told that his monitoring agreement would not expire until 9/30/MrG*** asked for a refund and AAA refused, because the monitoring agreement was in force until 09/30/MrG*** has fulfilled his contractual obligation to AAA, just as AAA has fulfilled its contractual obligation to MrG***MrG*** is not due a refund

It was not stated in my agreement with AAA security that this was a lifetime contract. After being an on-time paying customer for 18 years it would be business wise of AAA Security to refund my paltry $50 in good faith as that was the cost for two months service not used.

Mr. G[redacted] had finally made an accurate statement; his agreement did not state it was a “lifetime” contract. Again, the contract had an initial term of two years, and renewed year-to-year thereafter. A copy of the signed contract has already been submitted. Please reread the contact and AAA’s previous response, detailing Mr. G[redacted] obligations under the contract. The contractual obligations of both, Mr. Gilbert and AAA have been fulfilled. There is no refund due to Mr. G[redacted] The security industry is no different than any of the thousands of industries that operate under contracts. Consider this scenario: A consumer entered into a lease for an automobile for two years. The lease expires on 09/30/17. The consumer has paid for the lease through 9/30/17. On 07/25/17 the consumer buys a new car and returns the leased car to the dealership. The dealership has no obligation to issue a refund, and will not do so. The car leasing industry operates, relies upon and enforces it contracts. This obvious outcome of this scenario is no different when applied to the security industry. Further, Mr. G[redacted] has been defaming AAA on the Internet and harassing its employees over the telephone since 7/25/17. Yesterday, 08/10/17 at 11:16 am, Mr. G[redacted] called our office, hostilely threatening damage to the business, if his $50.00 demand is not met. He [redacted] included multiple expletives and insults.  Again, this morning at 10:22 am, Mr. G[redacted]t called and threatened, “Keep my $50.00 and I will hurt your business.” AAA has fulfilled its contractual obligations to Mr. G[redacted], and is now being defamed on the Internet and its employees are weary of being bullied, harassed and threatened by Mr. Gilbert. The extent of Mr. G[redacted] vulgar behavior and libelous Internet posts are not known. The contract and its terms speak for themselves: no refund is due.
