I was out of town from Wednesday, September 10, 2014 and returned yesterday, September 16, 2014. Upon my return I found the attached letter form the Revdex.com with the complaint. The letter was dated September 3, 2014 but...
was not delivered to our office until after September 10, 2014. Therefore, I would appreciate your accepting and understanding my response being after the September 13, 2014.
I have read the complaint and wish to respond in specific detail, but I will quickly summarize:
Complainant was a one of several people who were on an apartment lease as co-lessees. All signers to the lease knew they were signing the lease as joint and several.
When we receive rent checks from residents we deposit them promptly and credit the specific apartment account. We received a check from Complainant's bank for rent and promptly deposited it. As there was a rent balance at the time we received the check, there was no reason not to deposit the check. We do not refund money for checks deposited when there is a rent balance.
Complainant said the check was sent after she moved out. She may have moved out, but she was still on the lease and responsible for rent as her lease was still in effect. Complainant had roommate problems and did not want to pay rent because she thought her roommates should pay rent. This is a roommate problem which we do not get involved with. It also may be a problem with [redacted] as [redacted] may have made a mistake sending the check. We cannot refund a check once it has been deposited and rent is owed.
