Parrish Lawn Care & Landscaping

In August, 2014 my fianc and I moved into a new home in Wake Forest, NC. We received printed advertisements offering lawn care services. We contact Mr. Parrish who came out and gave us a quote. At that time, we had a [redacted] lawn mower we used to mow the grass. We were unhappy with the lawn mowers performance , it was almost new but my fianc was hardly strong enough to pull the start cord. Mr. Parrish offered to mow our lawn 2x (a quoted value of $45/each service) in exchange for the lawn mower. We agreed. He mowed the lawn every (2) weeks and then without our consent or request continued to mow thru the fall even though we called and told him we no longer needed his services. In October, we received a bill for (2) services for $90. I called him and told him we had already told him to discontinue the service. After a discussion, we decided to pay the $90 with every expectation that this would be the end of it. He claims he never received a letter from us specifically instructing him to discontinue his services. I am attaching a copy of a check that was mailed to him that proves otherwise. The online check was erroneously sent to our home address so we mailed directly to Mr. Parrish (along with another notice (now verbal and written notice had been given) NOT to mow our grass anymore). You can see in the memo section of the check that in addition to an enclosed note, we wrote final payment for 2x visits AND SERV DISC (DISCONTINED). The check was accepted and paid. This should have closed any agreement he perceived to be in effect. . In early April, 2015 he claims that his service team showed up and mowed our lawn and now we owe him $45. The Company has been billing us every month for services we did not request nor do we believe he delivered. Neighbors (several are stay at home moms) could not vouch for him no one saw them mow the grass. WE WOULD NOT RECOMMEND HIM TO ANYONE! HE HAS HARRASED US AND TRIED TO INTIMIDATE US . Apparently his business relies on presumptive work that is, providing services without a consumer request or agreement. We are busy people and have little time to litigate such a frivolous claim but we hope to prevent others from falling victim to his unethical business practices. He needs to clear this invoice as not due. Otherwise, we will have no other recourse but to take him to small claims court for deceptive business practices and trespassing on private property.
