Thank you for your telephone call today. We hate to disagree with Mr. [redacted], but we have inspected his floor and determined that the hump in the floor is a warranted item.  We have scheduled the repair to be made on Tuesday of next week.
Since inspecting Mr. [redacted] floor one month ago, Mr. [redacted] has reported two new warranty items. We will inspect these when we do the floor repair.

I went to Mr. and Mrs. [redacted] house on June 5, 2014.I did observe the hairline cracks that they have been talking about in their basement. They indicated to me that they thought the cracks were caused by the vibration of equipment. The site where we most recently worked on is in excess of 150' from their garage or residence to the side of their property. Therefore it is impossible that we did anything that could affect their foundation.  
My observations are as follow; There are some small hairline cracks in the foundation that have been previously repaired. There was no indication that these cracks were leaking. In fact it had rained the night before my visit in excess of 1" in the Roanoke and Botetourt areas, no leaks were observed. It was obvious to me they had had a lot of rain because Mr. [redacted] truck bed had a lot of water sitting in it.
The industry standard for foundations is that repairs are called for only if the crack is in excess of 1/4" in width. Otherwise such a crack is considered to be a settlement crack and is not a structural problem. The cracks in the [redacted] house only hairline cracks. I note that this house was built in the 1960's that means it is over 40 years old. I would expect in a house this old the foundation would have some hairline cracks in it.
It is of my opinion that we did not cause these hairline cracks and have not damaged their property. Therefore nothing on our part needs to be done.

Thank you for your correspondence of October 30. I have arranged with [redacted] to touch up the water marks on the interior of her home and check the insulation in her attic for water damage. We've called so several times since then and they never responded nor came.
To make a long story short, we have records and evidence that the Parsall & Zeigler General Contractors, lnc, did cause a lot of property damage such as Foundation walls and sewage line. The construction crew used the large vehicle Hammer drill to break rocks for several weeks on and off for several months caused our house to shake like a strong earthquake.  Per the letter from [redacted], he recommended an installation of helical piers to support the foundation.
I have records such as:

2. Photos of construction behind my house and my foundation walls damage in January 2007.

Review: I purchased a brand new townhome in 2012 with a 10 year warranty from Parsell & Zeigler. I closed on the townhome on August 31, 2012, and moved into the home in mid-September 2012. When I did not receive a copy of the "10 year warranty" promised, I requested it from the company. I was eventually provided with a copy of the warranty.

Since moving into my home on [redacted], I have experienced various significant leaks, the first water stains of which appeared on the interior wall of the laundry room on the main level in approximately October of 2012, shortly after I moved into the home. (It was my understanding the drain in the upstairs bathroom was tightened at that time.) When new water stains subsequently re-appeared, access panels were eventually installed (at my request) last year after multiple visits by various tradesmen. The definitive source of that continuing leak was never fully determined. Since that time, earlier this year water stains have appeared in the crevice of the outside wall of the laundry room on the back side of the house as well (which is not below the master suite upstairs bathtub).

In addition to the leak in the laundry room, significant water stains appeared in January of 2013 on the ceiling of the master suite upstairs bathroom. A roofer was sent to address the leak at that time, and I was advised the source was torn flashing which was reportedly repaired.

More recently (on September 27, 2015), water stains then appeared close to the same vicinity on the exterior wall of the master suite in the crevice between the wall and ceiling, and has now extended to the center of the wall. Parsell and [redacted]’s Construction Superintendent, [redacted], was notified of the new water stains in the master suite by email dated September 28, 2015 (before the water stains extended down into the center of the wall). A follow up email was sent to Mr. [redacted] on October 12, 2015. A certified letter was sent to [redacted], Director of the company, dated October 5, 2015 (when no response was forthcoming from Mr. [redacted] following my initial report of September 28). On the morning of October 13, 2015, a voicemail message was left at the company. To date, no response has been forthcoming and the leak remains unresolved. I, of course, have concerns about wet insulation and boards, and the possibility of mold in my attic.

On their website, Parsell & Zeigler boasts new townhomes with a "10 year RWC Warranty on all new homes!!" Since I have moved into my home, I have had six occurrences of significant water stains from various leaks, and two electrical issues which largely brings into question whether their employees and subcontractors are trained and certified in their trades. I thought that in purchasing a new home I would be avoiding such headaches. To the contrary, it seems as though I have had more problems with this new construction than I would have with an older construction.Desired Settlement: I would like Parsell and Zeigler to send a certified roofer and/or necessary tradesman to thoroughly look into the leak situation. The fresh new water stains are on my upstairs master bedroom ceiling and wall which, interestingly, is above the prior leak situation in the laundry room (the reason for which was never fully discovered). I want them to replace the insulation and wet boards (if necessary) in my attic above the master suite to alleviate the possibility of mold. I would at least like the courtesy of acknowledgement of the issue first, and then their plan of action. It has been more than two weeks since my most recent water stains were reported and three years since the initial issue in the laundry room.

For your reference, details of the offer I reviewed appear below.I am pleased to see that Mr. [redacted] provided a response to my complaint since my multiple telephone calls and emails have remained unreturned. While I understand his representation that my roof warranty expired over two years ago, this leak began shortly after I occupied my newly constructed home in 2012. As reflected in my complaint, I have been visited on several occasions in the past by tradesmen to investigate the leak(s). This particular leak has never been remedied and the source remains undetermined (or either undisclosed).

When the roofer (referenced by Mr. [redacted]) visited last week (after my complaint was filed), I pointed out some of the water stains in my laundry room on the main living level (those that were not painted over by Parsell & Zeigler, which began in 2012), along with the newer stains in the upstairs bedroom. He commented "it is probably the same leak." Unfortunately, I was not contacted in advance by the roofer, and was on my way to a prior engagement when he arrived so I was unable to consult with him afterward. Again, I received no response to my email inquiry into the source from Parsell & Zeigler. Earlier this week, I finally received an acknowledgement from them, by letter, indicating only that alterations had been made to my roof but did not disclose what alterations and, again, did not disclose the source of the problem.

While Parsell &Zeigler contend that the warranty on my roof expired in 2013 (after one year), I have never been notified of the source of the leak. Certain provisions of the warranty in question are covered for 10 years. Since this has been an ongoing problem for three years (since shortly after I occupied my home), I am still not convinced the problem has been remedied. In addition, since this problem has been ongoing, I am very concerned about possible damage and/or mold that may be in my attic.

Finally, Mr. [redacted] stated in his letter, "as a courtesy ... we contacted the homeowners' association for their repair." Since our development is still under construction, to my knowledge, Parsell & Zeigler, the General Contractor, remains the Board of our "Homeowners Association," and to my knowledge, Mr. [redacted] remains their General Manager. Parsell & Zeigler did send three gentlemen to my house last Wednesday. They touched the paint up in my laundry room on the main level and in my bedroom on the second level where water strains were still visible. One of the gentleman also went into my attic and reported to me that he did not see any problems. As we discussed, since this has been an ongoing problem which has reportedly been fixed on several occasions before, I would like to know specifically what the roofer discovered and repaired during his visit on October 16, 2015. Thank you for your correspondence of November 17. The roofer checked the whole roof and found nothing wrong with that part. He did find that a vent pipe needed to be re-caulked. He did that along with re-caulking the siding.

Review: Bedroom floor in master is uneven, lights in multiple rooms continious blows (electrical). Deck needs tighten plus planks damaged, hardwood flooring from hallway constantly squeaks from being lose. Roanoke County Building Inspector was contacted and sent representative out to inspect, they have notes if theyre assistance is needed ([redacted]) ext [redacted] (###-###-####) Im also going to notify my local Fire Dept to be on alert in case of electrical issues concerning lights.Desired Settlement: Repairing the issues
