Complaint: ***
I am rejecting this response because: just as I have been stating -- I have not been negligent. I am the original owner of this car and have properly maintained my vehicle. It made sense to make this costly investment because, the car had been maintained. At close to 200,miles the original engine ran its course. Goss' Garage installed remanufactured engines from their supplier -(both failed). The Garage says, I caused this failure. I am not in agreement with this. This car was my only source of transportation to get back and forth to work, and to take my Mom to critical doctor's appointments. I gathered funds to make this transaction-- cash on hand, credit cards and borrowing. I am not wealthy. I do not have $to throw away. Since this incident has occurred, I've had to purchase another car, make carpayments, pay-back the credit card companies, and the money borrowed. I took care of this car just as I always had-- having the vehicle serviced, and getting an oil change at every 3,miles. When the car stopped running on the busy highway there were several hundred miles remaining before the next oil change. The car has a full array of warning lights on the panel - check oil being one of them -- this sensor never revealed itself. If there was something that I was supposed to do -- other than maintain the car, and obtain oil changes at every 3,miles (just as I always had done). The Garage should have made this none. I have attached the invoice, and all back up materials associated with this transaction.

In response to your query about *** ***'s additional information, I’m sorry to say that it is totally irrelevantTo maintain any automotive warranty it is the responsibility of the driver to perform certain steps to prevent damageIn this case it is the responsibility of the driver to make sure the engine has the proper amount of the correct type of oilIn this case all damage was easily avoidable through proper care as would be taught in basic driver training and in the owner's manualBut here basic driving skills were not employedFirst *** *** purchased the wrong type of oilHer oil change invoices state “High Mileage oil" which is designed for engines with higher mileage and internal wearHer engine did not have high mileage or internal wearThis could have caused rapid oil consumption leading to the engine failureThis could happen (unknown for sure because the engine was driven to failure) as a result of the modified and extra chemicals in high mileage oilsAmong other things these chemicals are designed to swell (tighten) loose, worn seals in older carsBut these chemicals do not know if engine seals are old or new and swell new seals the same as old sealsThis can make good seals overly tight which could cause premature wear and aboil lossHowever, even with the wrong oil in the car if the oil had been checked and topped off as outlined in the *** owner's manual and in basic driver education it would never have become so low as to cause engine damageAdditionally there is never a situation where it is okay to drive an engine to failure because that can automatically void a warranty, Legally it's known as mitigating damages and it is the responsibility of the driver to “mitigate damages.”
This is an unfortunate situation but one I have seen many times in my years as an automotive consultant to various Federal, State and Local consumer agenciesAs before I understand *** *** dissatisfaction with the situation but please understand that: For Goss' Garage to be liable for *** *** claims we had to do something wrong but we did notOur work was fine as proven by more than twelve thousand miles of service without a complaintOur written contractual warranty with *** *** has been fulfilled and long since expiredFurthermore, we were not the ones who installed the wrong oil in *** ***' carWe did not have access to *** ***' car so we did not have the ability to check her oil level as suggested in her owner's manualWe did not drive *** ***' car with low oil levelWe did not drive *** *** car making loud disturbing noisesWe did not drive *** ***' car to failureActually we did not in any manner or form participate in or cause the engine failure in *** *** car*** *** engine failure was caused solely by her or things she did or allowed to be done to her carThis is simply a case of lack of driver knowledge or driver error and or neglect/abuse and there are no vehicle warranties that cover these things

 Complaint: [redacted]
I am rejecting this response because:
I drove pass two business in Columbia, Maryland to have Mr. Goss perform services on my car.  Mr. Goss is well known.  I believed that I would get good service and be treated fairly.
I am a seasoned driver and have owned 14 cars since I started driving.  I have always maintained these vehicles paying close attention to required service intervals, getting oil changes at every 3,000 miles, and maintaining service records.  I have maintined all my vehicles in this fashion.  This includes the 2005 [redacted], which I purchased new and maintained deligently for more than 10 years.  I have relied on this vehicle heavily to get back and forth to work; and to take my elderly parent a cancer patient, back/forth to critical doctor's appointments.  After two bumper to bumper inspections (1 performed by Goss' Garage) -- it was determined that the car was in good shape & only needed an engine.  With close to 200,000 miles on the car the original engine had run its course.  I was more than willing to make the investment having properly maintained the car.  I pulled together various resources to have a remaufactured engine installed in [redacted]- a combination of cash and credit cards.  With the goal being to keep the car, and not have a car note.  The 2nd engine placed in the vehicle, was the 1st remanufactured installed by Goss.  It leaked the same day in my home garage.   Next day, I returned the car.  In about a week or so a 2nd remanufactured engine was installed.  On January 29, 2015, (a very cold day) the car shut down on a busy Maryland highway in rush hour traffic.  The 2nd remanufactured engine failed.  There were no warning signals activated on the dash when the car failed.  When I tried turning the key -- for a quick second a check engine light appeared.  The car never restarted.  Over the life of this car, it always displayed a full panel of sensors/warning lights.
When Goss's told me that I caused damage to my car, I was devastated.  I explained that I have've been maintaining the vehicle just as I have always done -- getting oil changes at 3,000 mile intervals.  In fact, at the time the 2nd engine stopped running there was another several hundred miles remaining, before the next oil service.  The Garage told me that there was nothing more they could do for me.  I contacted the engine supplier regarding the issue and the warranty.  The engine supplier advised that they first had to speak to the Garage, before the warranty could be exercised.  Several days passed.  When we finally spoke the supplier advised that the garage told them that I hadn't maintained the car-- so the warranty was voided.  I insisted with the Supplier, just as I had done with the Garage that I have maintained the car and gotten oil changes every 3,000 miles.  I have all my paper work to proove it.
Yes, I have complained to several consumer advocacy groups because its my right to do so.  It's important that I have a voice in this matter.  Consumer advocacy is the venue that consumers pursue when feel that they haven't been treated fairly in the market place.  If,  I  could have resolved this matter fairly with the garage or the engine supplier-- I wouldn't have taken this route.  I have spent over $7000.00 and now have a car not working sitting in my garage.  The offer that Mr. Goss recommended -- my purchasing another engine and their willingness to discount the labor didn't seem reasonable to me.  I feel like I have spent hard earned money and have not reaped the full benefit of dollars spent.  I have had many miserable days since this incident occurred.  Among other things, I have had to pull more financial resources together to purchase a car, now have car payments that I can not afford and a car sitting in my garage not working.  The entire situation has set me back financially and has left a very bad taste as to how I have been treated.
I stand-by what I have been saying-- I have always properly maintained my 2005 [redacted], paying close attention to service intervals and getting the oil changed every 3,000 miles.  When the Garage completed the work on my car, I was advised to stay on top of my oil changes.  I did exactly that, every 3,000 miles.  As a responsible person, and the required need to have reliable transportation to get back and forth to work; take my Mom to critical doctor's appointment, and given my financial situation -- I would not have done anything to jeapordize the investment made.  If, I the Garage had advised me to do anything more than staying on top of oil changes to maintain this car-- I would have done so.
Why would I cause myself grief and hardship.
Regards,

March 30, 2015To Whom It May Concern:
Please be advised that we are very sorry that [redacted] is disappointed with our service. However, we have not denied her anything. We installed a remanufactured engine in her 2005 [redacted], completed on May 1 2014 at 192,123 miles. That...

remanufactured engine came with a 3 year, 50,000 mile warranty from the remanufacturer. Like all warranties there were requirements for maintenance and care of that engine to keep the warranty in force. On January 29, 2015 her car was towed to my shop with a complaint that the engine had problems. Our first step in diagnosing such problems was to check the level of the oil and the condition of the oil in the engine crankcase. We were shocked to find that there was no oil showing on the dipstick. This led us to the next step which was to raise the car to look for a catastrophic leak. There were no oil leaks under her car So the oil was gone due to normal consumption. The engine was damaged due to a failure of driver or drivers to properly maintain the level of the oil in the engine.
We called the engine supplier and they asked us certain questions like all parts suppliers do to establish the validity of awarranty claim. Topmost of those questions was about oil level and condition. When we told them there was little to no oil in the engine and no leaks they said they were sorry but that voids their warranty on the engine. [redacted] was very unhappy and rightfully so because this is the second engine that has failed due to lack of maintaining oil level.
To date she has apparently complained to everyone who will listen about us but we have done nothing wrong. There were no problems with our work; we have no reason to unreasonably deny her warranty because we would get paid to replace the engine so it would be a plus for us.
We have supplied her with the contact information for the company so she could talk to them directly (they say she did call) and we have told her we would help her with a discount if she wanted to buy another engine through us. We also told her we would discount labor if she wanted to supply an engine for us to install.
Sincerely,Pat G
