Dear Mr. D[redacted]:
Please be advised I am legal counsel for Pat O'Brien Chevrolet in Medina and am in receipt of the above-captioned matter. For your review, please find attached correspondence to Mr. M[redacted] regarding his alleged problem with the vehicle. Since the pertinent information is contained in the attached correspondence to Mr. M[redacted], I will briefly restate Pat O'Brien Chevrolet's position.
Mr. M[redacted] purchased a high performance Porsche sports car and received a 3 month, 3,000 mile limited warranty. The limited warranty specifically excluded repairs to the clutch. Mr. M[redacted] was informed that the warranty did not cover the clutch on his vehicle and was not pleased with that information. It was recommended to Mr. M[redacted] that he read the 3 month, 3,000 mile limited warranty which provides the exclusions to the specific repair and/or go online to review the specific exclusions to the warranty. Pat O'Brien Chevrolet is neither the administrator of the warranty nor the provider of the warranty and, therefore, makes no recommendations as to what can be repaired pursuant to the terms of the warranty.
It is my understanding that Mr. M[redacted] removed the subject vehicle from the premises of Pat O'Brien Chevrolet and took it to another entity to be serviced. Pat O'Brien Chevrolet does not know the results of the service and/or whether or not that service entity called the warranty administrator to determine whether or not the service it performed, if any, was covered under the applicable warranty.
The terms of the limited warranty are clear, the clutch is not a covered repair.

Dear Mr. M[redacted]:
Please be advised I am legal counsel for Pat O'Brien Chevrolet in Norwalk. It has been brought to my attention that you have posted remarks on Facebook regarding your dissatisfaction regarding the repair coverage for the clutch on your 2006 Porsche. Pat O'Brien Chevrolet strives to have 100% customer satisfaction and is well over 90% regarding same. Further, Pat O'Brien Chevrolet respects your right to post your opinion regarding the service that you received, however, it does object to any false and/or defamatory information contained in your online postings.
The limited service contract that you received was a 3 month / 3,000 mile power train warranty only. If you read the warranty, it specifically excludes repairs to a clutch. Pat O'Brien Chevrolet would respectfully request that you correct or remove your false and defamatory online postings, including, but not limited to your Facebook and Google Plus posts, and provide true and honest information regarding the reason why the clutch repair was excluded under the service contract. Again, repair to the clutch is specifically excluded.
Accordingly, you are hereby direct to cease and desist all defamation of Pat O'Brien Chevrolet's character and reputation.
If you do not comply with this cease and desist demand within this time period, Pat O'Brien Chevrolet is entitled to seek monetary damages and equitable relief for your defamation. In the event you fail to meet this demand, please be advised that Pat O'Brien Chevrolet has asked us to communicate to you that it will pursue all available legal remedies, including seeking monetary damages, injunctive relief, and an order that you pay court costs and attorney's fees.

My complaint was about the customer service of the situation, not the warranty coverage. On all responses from Pat O'Brien or their attorney, they fail to address that. This leads to confirmation that my complaint is valid and true. Please have them RE-READ the complaint and they will see this is a customer service complaint, not a warranty complaint. I also decline to remove any of my public review post since they are factual and valid. Reader will not find one false or defamatory statement.

I talked to Mrs. G[redacted] and explained the miscommunication an the two vehicles she asked about and apologized for the miscommunication. We are trying to trade her out of her car for the service issues...

she has had, and also Chevy has offered a $3000 coupon towards the purchase of a new Chevy. Pat O'Brien Chevy has offered $2000 more trade in value for the vehicle than the vehicle is actually worth and to this date have been unsuccessful in the transaction. Pat O'Brien Chevy has no benefit to try to move to a more expensive vehicle and also explained that they could go to another dealership if they didn't want to deal with us. I explained to Mr. G[redacted] on 11-2-15 that the offer was still good but we needed to act soonon the transaction as the trade value and incentives could change. I told him 10 days to 2 weeks.

Numberous problems with our car, every time it was taken in, it was worse when we went to pick it up. Replaced liner twice and while our car there for service, it was wrecked by one of their employees and we found it on our own. I feel they were never going to tell us about the accident. We have been treated horribly and after many interactions with this business, my car was returned to us the other day and the back seat is not properly secured, the clamps are broken and it appears someone was welding or grinding next to my car....it has pit marks all over back driver side door. It amazes me that they feel it was ok to return our car to us like that, especially since the back seat is a safety issue!!! AWFUL DEALERSHIP!
