Although we sympathize with the customer we could not honor what we considered a fraudulent gift certificateIn July of we did purchase a restaurant from a man named *** ***, the agreement was to exchange gift cards outstanding for inventory that was left for usOur understanding was
that when he gave us a book containing numbers from numerical paper gift cards issued showing ones that were crossed out as redeemedThe total outstanding was about $So we agreedThen once we signed the purchase and sale agreement we were informed that he had also issued plastic gift cards and after accepting $38,worth in good faith we decided we would not honor anymore since they were not a part of the information turned over to us at closing and we were under no obligation to honor the plastic cards according to our AttorneyFurthermore we saw that after the closing Mr*** was handing out gift cards at the *** Dog track as wellThe gift card we have received was stamped on a gift certificate that we determined was most likely fraudulent

I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # ***I have received the response submitted to the Revdex.com from representatives of Pat’s Italian RestaurantI would like to address each part of said responseAccording to the statement submitted, the current owners stated the following: “in July of we did purchase a restaurant from a man named Pat ***”The current owners did not purchase “a restaurant” from “a man” named *** ***What they purchased was Pat ***’s Italian restaurant which was a fixture in Johnston Rhode IslandThey realized such since they purchased all “tangible personal property located on the premises including..recipes on the menu, menus etc” In other words, they purchased the restaurant in its entirety knowing Pat’s was a well-known establishment in the town which served a very loyal clienteleThey admit in their statement that the current owners purchased gift cards that were outstandingThis is further stated in the lawsuit brought by the current owners against *** *** in which they stated the fact that they “purchased gift certificates which are assumed by purchaser hereunder.” In that regard, when they purchased the business, by their own admission, they purchased the gift certificate obligationsI am again including the pertinent page from that lawsuitThe current owners admit there was a book given to them by *** *** which contained the numbers from the gift certificatesThis book also contained the numbers of the crossed out gift certificates which had already been redeemedThere were $10,worth of these certificates they statedIn addition, apparently there were also plastic gift cards which were outstandingSince my gift certificates were on paper, this portion of the argument has no bearing on my claimThe rest of the explanation offered by the owners make no sense at allThey claim *** *** was passing out plastic gift cards at *** Dog Track and my gift certificate appears to have been initially a gift card which now stamped on a gift certificateTo begin with, my gift certificate was purchased on Christmas Eve of The signature was a stamped signature of the owner *** ***However, if you look further, you will see the initials of the person who sold the certificate to me at the timeI am again including copies of the gift certificatesSecondly, this certificate was purchased three years prior to the sale of the restaurantClearly therefore, it was part of the initial agreement between *** *** and the current ownerIf there were $10,worth of these certificates which were agreed upon, this certificate should be honored as part of that agreement regardless of when it is presentedEach of these certificates has a number on itThese are very low numbers on the certificates which leads me to believe they were issued shortly after *** *** opened the new restaurant on Hartford AvenueThe restaurant had relocated from a previous site in Johnston and they probably printed new certificates with the current address on themIn any case, it should be easy to verify if these certificates were outstanding since the current owners say they were given a book with the list of all certificates that had been issued and used at the time of the saleFinally, when we visited the restaurant on the night in question, the manager at the time said she could not accept the certificate because the restaurant had not purchased the previous owner’s debt at the time of saleThis was, in fact not at all trueIn fact, the exact opposite was trueThey had purchased the debtWhy would a person give such an excuse for not honoring old gift certificates unless this was a standard answer used to renege on such commitments? This entire experience has been very upsetting to meI have the give certificates to my husband and sister as giftsI did not get them for free from *** *** at *** Dog TrackI did not stamp a gift card on a gift certificate to be used in a fraudulent mannerI took a gift certificate that I had given to my husband for a previous Christmas and used in after he unexpectedly passed awayA pleasant night of sharing memories turned into a very unpleasant experienceWhy would I go through all this trouble for $We spent over $that eveningI am doing so because it is very upsetting to me that wealthy companies can simply refuse to honor something because they feel they can get away with doing soPat’s Italian Restaurant has an obligation to honor these gift certificates, both legally and morally
