For one when I got the car I told him I had to have my uncle check the car he stated I can have my uncle check it out if anything is wrong he would give me my money back. When I got home the check engine light came on I called Mr*** he came to my house and plugged in the machine and turned off the check engine light it came back on a couple days later I got the car on 1-22-and I never told him I would repair the carI'm not gone to tell a lie I know nothing about cars I mean nothing that is why I told him I had to have my uncle check it out if I would have agreed to pay for repairs why would I tell him I wanted my uncle to check out the car and I would still have the car nowI made the mistake of leaving the paper in the car with the warranty checked on the as is or warranty sheet. He is lying about what I received back from him he paid me back $and kept $so if he was not wrong why is he lying saying he only gave me $He wrote a check for the amount so I'm sure if can be tracked from *** Motor (one of their personal checks with their company name on it)When I went for the refund he said he paid the taxes on the vehicle now he have all these other charges which don't add up to what was refunded to meI went to the police at the Coolidge Gastation and talked to a policeman and he said this is not the first time this has happened with Mr*** he always selling bad cars and he stated that he has been took to court for it beforeI feel as if Mr*** is ripping people off and I was of themI talked to a man at McKee muffler that told me he has towed a lot of cars back to *** Motor because the were lemons cars and the people didn't want them I will go today and see if I see the man and get a statementI signed papers and didn't really read them I but they looked like standard paperwork for vehicle purchase but I'm going to a lawyer today with my paperwork to see where it says that about the refund because I didn't see itI believe when buying a car from any car lot new or used car should not have problems in the first month cause for one if there is a problem the lot owner should inspect and fix major problems before selling a car to anyoneMr*** lying about what refund I received should let people know what kind of person he is I have not reason to lie

On 1/22/14, Ms. [redacted] came on our place of business with an intent to purchase a vehicle. She browsed the lot and identified 2003 Toyota Camry to purchase. She test drove the car, examined it to her satisfaction and decided to moue forward with the purchase. Ms. [redacted] agreed to pay $650 as down payment and financed $6249 at annual interest rate of 18%. Before the purchase was finalized, Ms. [redacted] was given an opportunity to read the purchase contract. Ms. [redacted] read and signed the contract indicating that she understood it in its entirety, which included refund policy, terms of contract, etc. Ms. [redacted] signed AS IS-SOLD without Warranty Disclaimer indicating that she was purchasing the car “as is“ and that no warranty included in the purchase. Further she agreed to make necessary repairs in an event she felt repairs were needed and required as evidenced by her signature on the contract. In addition, on page 2 of the contract there is a section on refund, which documents that refunds are only calculated for vehicle which is purchased in full on a partial basis, but fees and charges are exempt. Ms. [redacted] bought the vehicle on finance, thus refund was no applicable to her. Also, we Patel Motors have no refund policy, and all sales are final. Regardless of the fact that Patel Motors does not have refund policy for vehicles which are purchased on finance, we try to work with our customers who are not fully satisfied with their decision to purchase a car from us. When situation arise we try to offer a fair remedy for individualized solution. In Ms. [redacted]’s case, we did just that.
Ms. [redacted] had the vehicle in her possession for 15 days, which was half of a month before she decided to return it. She utilized Patel Motor’s vehicle for 15 consecutive days. Thus, the fairest solution for to offer was prorate the amount she was requesting back, which was $325. In addition there were fees of $15 for Temporary Tag, interest for 15 days in the amount of $50, and finance charge in the amount of $199, which totaled to $581, and was not refundable. Patel Motors offered to refund the balance of $61 to Ms. [redacted], but she was not happy with that amount. Ms. [redacted] appeared to be decent individual and since we rely on word of mouth advertisement, we decided to refund her more money that entitled.
Due to confidentiality, we are not sending you the contract as it has identifying and personal information about our customer. However, if need be and to further defend our case, we will make it available to you for your review.
