Dear [redacted],
We received your letter, dated Friday, May 1, 2015, regarding a customer complaint, and wanted to respond and clarify the situation.
As a client-side energy consultant, with commercial and industrial clients, such as [redacted], in 20 North...

American states/provinces, Patriot Energy understands the importance of disclosure and transparency to its business. Before any document is signed, Account Executives disclose and explain all contracts and forms to the client. The client's signature indicates that the client has reviewed and agrees to the terms and conditions of all signed documents. All standard Patriot Energy client documents were executed on February 6, 2014 by the Vice President. As part of that package, the client initialed a “Product Summary” which describes the client's desired purchasing strategy (in this case, by purchasing a variable priced index-based product). The client’s specific Product Summary states that the rate would be based on index-based pricing, and would not be a fixed rate plan. In addition, the Product Summary displays a clear disclosure, in boldface type, that Patriot Energy does not guarantee that their plan will result in lower costs when compared to the utility's (i.e. PPL’s) supply price. There are benefits and risks associated with index-based plans, of which the client was fully informed. It was their desire to proceed with a variable index-based power purchasing strategy,
Transparency is a critical component of Patriot Energy's business. In this instance, Patriot Energy's Account Executive worked with the client to ensure that he was informed and satisfied with his energy procurement plan, The client makes the decision as to what type of product best suits their needs, and Patriot Energy finds what they want and signs the contract on their behalf. This particular client was well aware of the index-based rate, the benefits and risks associated with it, and specifically of the potential for a higher cost than what the utility was charging. On March 13, 2015, the client indicated to us via email that he wished to cancel the contract that was procured by Patriot Energy, and we sent a cancellation letter to the supplier that same day. We followed the instructions given to us by the client at each step of this process.
