Despite the fact that we did not misrepresent anything we recognize that the blizzard of paperwork that comes with a vehicle purchase can sometimes create the very confusion the paperwork was implemented to reduce. In this case [redacted] signed a policy agreement that spells out a non-refundable premium and I have attached a copy of that signed agreement. I understand that [redacted] had been on the phone with his existing insurance company for some time on the day of the sale so perhaps the confusion came from that. Regardless of where the confusion originated, we simply tried to help him take ownership of his bike that day as he requested.Please let me know if this matter has not already been resolved.Very Respectfully, Lyndon A[redacted]

Review: I purchased a motorcycle and because of the time of night that the sale was final my insurance company was closed. The finance person at the dealership informed me that they could get me temporary insurance for I could get my tag. She also informed me that if I called first thing in the morning to cancel the insurance company would refund me as well as I could cancel because I would then be able to get my own insurance. The prices for the insurance she was pushing was very high but I needed to get the tag. I then did as she said and called to cancel and was informed that was false and also that I would need to pay an additional cost for cancelling.Desired Settlement: I want to get my money back because I only had the insurance for 6 hours.

Review: On or about August 20, 2011 I purchased a 2012 Harley Davidson Road King Motorcycle from the subject. The subjects agent, **. [redacted], suggested that I also purchase a prepaid maintenance package, His logic was that if I purchased the package I would first lock in any maintenance costs (which are substantial) at today's price and thus avoid annual price increases for maintenance. He also advised me that any unused funds from this trust account would be returned to me upon the sale of this vehicle. With the understanding that I would receive a refund for unused service I placed funds on deposit against future maintenance expenses. I would also add that this is my third transaction with this dealer so I had what I now know to be a misplaced sense of trust in this organization, it people and there services. When I notified the dealer that I wanted to terminate this account and receive a refund I spoke to [redacted] in the Financial Department. [redacted] declined to refund my unused trust funds and further refused to even give me the amount in the account. I then contacted the Dealer Owner, **. [redacted] had on previously sent letters to me that said if at any time you are not happy with our services and cannot provide a perfect score to Harley Davidson Corporate to contact either him or his assistant. Thus when I contacted **. [redacted], as he had asked, his response was I have no idea what our policy is but I will have my General Manager contact you today! HE DID NOT HAVE THE GENERAL MANAGER CONTACT ME on that day. Some 10 days later, after I spoke to **. [redacted] assistant who promised a return call the following day with a solution (I am still waiting for her call) I was contacted by an individual who said he was the General Manager for this dealership. He was rude, grossly unprofessional, I asked for a return of my money, he refused any and every possible solution then hung up the phone when I pressed the matter further.

Accordingly, it is my view that a lawful agent of this corporation made a verbal contract on the date of sale, and that this organization has in an unlawful way refused to provide an accounting of and return of my unused funds on deposit in this trust account. They are in breech of contract.Desired Settlement: I am asking for the return of my unused funds along with interest at 5% and a full accounting of all transactions to this account.

I am rejecting this response because: On Monday of this week I sent a Cashiers Check to Harley Davidson Financial Services to pay off the motorcycle in question. Thus the offer to put the money toward my loan is not an option. Secondly, I have no intention of using this organization for any future business transaction. I buy a new motorcycle every year to eighteen months but I will not be buying one from them again. Despite what has been represented in their correspondence, I doubt we would have ever gotten this far had I been a "Bully" I want a cash refund which I was promised by their representative. It should also be pointed out that this dealership on a selective basis has admitted to making past refunds ( in our last telephone conversation). In point of fact the author of their correspondence stated that at times we give refunds to service members' Well, I am a Disabled Veteran (and I will be happy to provide US Government provided identification to verify that fact). Why would they give a refund to one member of the service but not to a Disabled Veteran? That in fact is a violation of Federal Law, specifically the Americans with Disabilities Act. Also, attempting to charge a "Admin Fee" of $100 is unacceptable. It is a "USED CAR SALES TRICK, nothing more! I paid them cash, I have located my copy of the contract and according to it paid them $1399.00 for Prepaid Maintenance. I received a guarantee from their representative (who it turns out only worked there for less than 2 months) and now I want what I was promised, The return of my money. I will agree that I did have one service done and the amount stipulated my the dealership is correct. I would have included that in the original complaint but the dealership would not provide any information to me when it was requested, Their employee, [redacted] was evasive and unwilling to respond to even a simple question. In point of fact this organization has been devious from the very moment I suggested a refund was in order. Finally, the offer to pay off a balance owned to a third party or to provide store credit is nothing more than a smoke and mirrors attempt to not do what the verbal contract stipulated. Please remember that the salesmen was paid only on commission, I was a person that had already traded in one fairly new Harley Davidson on a New Vehicle and was proposing to purchased a third, it seems the sales professional was either not so professional or the dealership simply wants to hold on to money they are not entitled to. As the dealership indicated the salesmen though good, but why then was he only employed for such a short time, clearly there was a problem somewhere. Just as there is a problem now when the dealership is being asked to honor their commitment.

I am rejecting this response because:

Sadly, and again this offer is not acceptable. I am owed $1043.00 for the balance due in this matter. The argumentative tone, lies and general attitude stated in correspondence brings me to the only conclusion available. That is that this matter will have to be resolved in a Court of Law. I have detailed the facts, listened to the insulting correspondence from Patriot Harley Davidson and conclude they haves no real desire to dispose of this issue. Thus, unless I receive a check from Patriot in the amount of $1043, which is the amount owed within 14 days I will file a Warrant In Debt to collect. The check should be addressed to my office at [redacted]
