Regarding [redacted] ’s concern over the additional bill for work done on his in-ground pool:Bonding of the pool.—Aqua Leisure did the bonding work on the pool and the electrician merely needs to do the final hookup at the filterReference #of the Contract “in the event Aqua Leisure bonds the pool the Homeowner will be billed by the contractor” Additional stone---The manufacturer’s guideline for stone for that size pool is ton, but due to the yard conditions extra stone was required (an additional ton).Reference #of Contract“in the event that construction materials other than those specified in the Contract or those that exceed manufacturer’s specifications (gravel, drainage material, jackhammer or blasting, etc.) are needed to complete the construction the Homeowner will be billed accordingly”In order to resolve this matter and in the interest of good customer relations we have offered the [redacted] ’s an $discount on the additional materials and laborOnce payment is received we stand ready to complete the project

I am rejecting this response because: at no point during the purchase of the pool did we assure anyone at Aqua Leisure that the pad was levelMy wife was the one who submitted the order for the poolWhen asked by the salesperson, Tom, about the area where the pool would be placed, he asked her if the pad was level and she responded she believed it was but wasn't certainIn fact I forwarded a picture to her via text of the pad and the salesperson, Tom, indicated that it would be fine

*** *** has the correct pool, but is confused over the sizing of fiberglass swimming poolsAs per the attached literature -- Lengths , widths and depths may vary up to 3%Measurements are to the widest point on each side of the outside edge .The measurements are not water measurements but rather
outside edge of the fiberglass measurements which is consistent with industry standardsHis pool contract also clearly states that the dimensions are approximateThe manufacturer is *** *** Pools, which it states on the brochure of which he has received,Any merchandise owed to *** *** will be provided once he brings in the payment for the outstanding balance ($3016.17)This bill is delinquent since October 15,

The check was mailed today. Our bookkeeper was on maternity leave. Sorry for any inconvenience

The manufacturer has agreed to cover the claim under the warranty.The terms of the manufacturer's warranty are as follows:1. The warranty is prorated. Since the pool was purchased in 2014, the customer's portion on the proration (35%) for the pool wall is $500. 2. Labor is NOT included under...

The manufacturer’s guideline for stone for that size pool is 75 ton, but due to the yard conditions extra stone was required (an additional 104.28 ton).Reference #3 of Contract... “in the event that construction materials other than those specified in the Contract or those that exceed manufacturer’s specifications (gravel, drainage material, jackhammer or blasting, etc.) are needed to complete the construction the Homeowner will be billed accordingly”. In order to resolve this matter and in the interest of good customer relations we have offered the [redacted]’s an $850 discount on the additional materials and labor. Once payment is received we stand ready to complete the project.

[redacted] purchased an above ground swimming pool and requested we install it on a concrete pad. This is not an issue as long as the concrete pad is level. [redacted] assured us it was level. When we arrived at the yard the pad was out of level approx 5". The pool could not be installed at the...

location and [redacted] selected another location. Unfortunately that location needed a considerable amount of excavation and as per his contract there is an additional charge. We do not accept returns as all sales are final and there are no cash refunds. We stand willing and ready to perform [redacted]'s excavation and installation.Bil D[redacted]
