Co.install down pipe on car.Drove it off lot and it was jerking.I called shop & he said it was my transmission.On my way back to shop my car blew up.
I dropped my car off on Saturday, 2/1/20 and picked it up after hours on Monday 2/3/20. on Monday they called me to tell me that they needed to do additional things to my car and it was going to cost $315.00. I told them to go ahead and fix what they needed to. So when I started to drive the car off of the lot on Monday evening it started jerking really bad. I left a message on Monday night when I returned back to my military base. I then called again on Tuesday, where he proceeded to tell me that it was probably my transmission and they didn't touch that. I told him that I was going to bring it back to them on Wednesday (2/5/20), evening to look at. On my way back their on Wednesday evening around 5:30 my car blew up. So I had it towed to another performance shop to evaluate. That shop said that my car needed a whole new engine and would cost around $6,300.00. My car was fine until I took it to *** Performance Parts, LLC.

Desired Outcome

I had my car looked at by another performance shop and they advised me that I needed a whole new engine. I am seeking a new engine put in my car.

Customer brought a downpipe for his Hyundai Veloster Turbo that he purchased from a third party that he wanted installed on the vehicle. Our service writers informed the customer that an ECU calibration (Tune) is recommended when installing this type of up modification to a vehicle as it can affect the Air Fuel Ratio. We provided the customer with two companies names that can perform such a tune on this type of vehicle. Customer explained that several people online said the vehicle would be okay without an ECU calibration and that he can install this component on the vehicle. Customer asked us to install the component, so we proceeded with the work.

During removal of the factory downpipe, we found that the OEM studs in the turbo were severely rusted and the OEM nuts could not be removed from the turbo without being extracted. We brought the customer to the shop area to show him the studs and explain the options for fixing the problem. We offered him a free solution that would be a temporary fix, or we explained that we could remove the turbocharger from the vehicle, extract the studs, and install new ones for an additional $135 plus hardware / shop supply cost. Customer agreed to have us remove the turbo and perform the repair properly. This issue is a common problem on these vehicles due to the hardware used from the OE manufacturer.

After removing the turbocharger and properly performing the repair, we reinstalled the turbocharger on the vehicle, and completed the installation of the customer supplied downpipe. The technician servicing the vehicle took the vehicle for a test drive on our normal route, and noted that no Check Engine Lights were present and the vehicle drove correctly.

We contacted the customer informing him that the vehicle was ready for pickup. Customer arrived on Monday evening and picked up the vehicle. Later Monday night, the customer sent us a message stating that the vehicle was not driving properly and that "the RPM would increase, but the vehicle would not accelerate". We informed the customer that this sounds like it may be a transmission related issue, however, we did not perform any services on the transmission so it should be unrelated.

The customer contacted us the next day and informed us that the vehicle was hesitating and not running properly. I personally informed the customer that this is a clear sign that the vehicle needs an ECU calibration for the part that he supplied, and he quoted once again that people online said he did not need one. I told him that he could bring the vehicle back to us for us to inspect free of charge to help out, but a tune was needed for the vehicle to run properly.

The following day, the customer sent us a message that he was driving the vehicle back to our shop for us to look over. Apparently, on the way to the shop the engine had a failure and oil was spilling from the engine block. Engine oil can not simply pour from the side of the engine unless there is internal damage, which in this case would be related to the customer disregarding our advice, and not getting a proper tune for the aftermarket component he asked us to install. When a vehicle is not calibrated for the aftermarket components that are installed, combustion cycle detonation can occur and the engine can become damaged internally.

*** Performance Parts recommended to the customer on several occasions to have a tune performed when installing this component. The customer decided not to have a tune performed, and continued to drive the vehicle after there were signs that there was a problem. Also, please note that these detonations only occur when the driver of the vehicle accelerates the vehicle aggressively, and does not happen when the vehicle is driven normally. This is a sign that the customer was driving the vehicle hard, even when he acknowledged the vehicle was not running properly.

We are not responsible for the customer's decision on what aftermarket components they supplied, or if they decide to get an ECU calibration. The customer already had other modifications including a cold air intake which also requires an ECU calibration. By adding additional parts that increase air flow, and not having a proper tune to adjust fuel delivery, the vehicle can experience a "LEAN" condition which causes internal engine temperatures to rise, and can cause failures such as loss of compression, piston / connecting rod damage, short block damage, etc.

The customer's parents called our shop asking for an explanation of what work was performed and how the engine could potentially fail. We explained that their son did not get an ECU calibration, despite being advised that it was required, and that the vehicle can suffer from internal damage if not modified correctly. The mother explained that he is in the military and can not afford to purchase a new engine because he is still paying on the car, and that we should provide 50% coverage of the engine. I explained to her that we can not provide any coverage since her son provided the parts, was made aware of the tune requirement, and the chose not to have a tune performed on the vehicle by one of the shops we recommended. She explained that she will have to take us to court because her son can not afford an engine and requested a copy of our shop's waiver form that her customer signed, explaining our shop guidelines, charges and fees, as well as explaining that we are not responsible for any issues due to a customer not having the proper components to modify the vehicle correctly.

In this case, the customer supplied the parts, and we simply performed the installation. We are not responsible for what customer supplied parts can cause as an adverse affect on the customer's vehicle.

This is a false accusation and will be addressed as such.

I do not accept this response because there are several lies with in the response.

So to start things off they never told me that that a ECU calibration (Tune) was required to run a catless downpipe. I actually brought up the tuning to them. I asked if they made COBB access ports for my car, which is a flash tuning device that allows you to tune your car without needing a new ECU. I was told that no they did not and to actually tune my car I would have to get a new ECU that already had tuned settings. He then brought up of a company that made Tunes for my car and I told him I knew who they were as I follow there page on Instagram. Then I Brought up the other company that I knew made tunes for my car, which is *** Element is actually who I got the downpipe from. They are a company that specializes in making performance parts for cars like mine. So them bringing up the fact that they told me that I needed a tune to run the catless downpipe is a lie. We talked about tunes only because I brought it up and asked about it, and even then nothing was said about me needing a tune to run a catless downpipe. Had I have not brought up tunes this wouldn't even be in the conversation. Also let me make it aware that I talked to both *** and *** Element which are two companies that both specialize in making performance parts, as well as tuning, for cars like mine. Both of these companies said that I do not need a ECU calibration (Tune) to run a catless downpipe. They also said that plenty of other people with cars like mine are running catless downpipes with NO tune. Also was told they have never heard of a situation like this happening. As much as *** Performance keep saying they told me that I needed an ECU calibration (Tune), Which I do not, they never told me I needed one. I Also have message proof from the two companies that specialize in performance parts and tuning for cars like mine, that I DO NOT need a tune to run a catless downpipe.

The next thing that was a lie was the price to do the install the right way. I was told $135 originally. Then with the problems they ran into they said it would be another $80-$90 to put downpipe on the right way instead of the temporary fix, So I said sure do it the correct way. When I arrived to pick car up and pay for installation my total was $315, which was $90 more then what I was told. The original $135 + $90 to have it installed correctly would have came out to be $225. Instead I was charged $315.

Next in there response it says "The technician servicing the vehicle took the vehicle for a test drive on our normal route, and noted that no Check Engine Lights were present and the vehicle drove correctly". This is also a lie because when I arrived Monday night to pick up my vehicle they were still working on it. I have a witness that was there with me to pick up my car that can ensure I had to wait around for 30 minutes for them to finish up working on my car. So how can you test drive a car when you're still working on it? They also stated that they contacted me informing me that my car was ready for pick up, which is in fact another lie. I have call records that will show I called them four or five times to keep checking in on my car to see if it was ready for pick up. I kept being told to call back because they were not done with my car. The final time I called they said to head on over to the shop because they should be finishing up with my car. So they did not call me, I kept calling them to see if it was ready for pick up because they weren't even sure if it was going to be ready, so I kept being told to call back and check if it was gonna be done.

In there response they also said that I "continued to drive the vehicle after there were signs that there was a problem". After driving it home from the shop on Monday evening I parked the car, and left the car parked, until Wednesday evening when I went to drive the car back to *** Performance so they could look at it. I barely made it outside of Fort Bliss when my car blew up. like 40 minutes in total of driving it after I received the car back from *** Performance, the car blew up. It also says "these detonations only occur when the driver of the vehicle accelerates the vehicle aggressively, and does not happen when the vehicle is driven normally". My friend that was following me in his car to drop mine off at *** Performance can testify that I was not accelerating the vehicle quickly and that I was only going about 35mph when this occurred.

This Complaint is not a false accusation and is serious, and I would like help on what to do next. The Car was perfectly fine before *** Performance worked on it. Then immediately after picking the car up from them I could tell something was wrong as it did not run properly and did not sound right.

Although some companies may say a tune is required for this vehicle to use the aftermarket downpipe that the customer supplied, we informed him that we highly suggested a tune for any modifications. It appears that the customer does not recall us informing him of a tune recommendation when he brought the vehicle, after asking about the Cobb Accessport which does not exist for this vehicle. He also told his parents that he did not remember signing an "Authorization for Services" which we provided a copy of.

Most companies base their recommendations off of the assumption that vehicles are at sea level (Or close to sea level) when they sell modifications. El Paso is located at 3,500+ ft above sea level which drastically affects a vehicles performance and is the reasoning behind our recommendation of an ECU calibration. After the customer wrote us on Feb. 4th stating that the vehicle did not feel like it was operating correctly, we informed him that it is much safer to have an ECU calibration for upgraded parts, and explained the parameters that are affected by the aftermarket downpipe that he had provided.

Unfortunately since we do not have a history on this vehicle as it was the first time visiting the shop, and already had aftermarket parts installed, we have no way of knowing the vehicle's health at the time that we performed the installation.

As far as the pricing for the installation, we informed the customer that it was a $135 charge for installation. However, due to the severe rust which yielded in seized studs on the turbocharger, we brought him in to show him the condition of the studs and give him options as mentioned in our initial response. I personally explained to the customer that the proper way to complete the installation would be to remove the studs, tap the holes and install new studs, however this would cost "approx. double" what we had initially quoted. The customer agreed to this charge and the reasoning for the variation in pricing is because we had to source the studs which were charged to the customer, and because we charge a "shop supply fee" as noted on the authorization for services that he signed. There were no discrepancies in pricing when you take this into consideration.

When the customer noticed any type of problem, the vehicle should have been returned to the shop for inspection so we could advise if an ECU calibration was needed, or if there were other issues that caused this failure. However, despite informing later that night, he decided to take the vehicle to another shop after the engine failed.

Unfortunately we have not seen the vehicle since this incident, so we have no way of advising a proper method of repair. When customers choose to modify their vehicle for additional power beyond the original manufacturers parameters, we are not responsible for damage to the customers vehicle as this is a risk that is taken to gain additional horsepower. There is a reason why components such as this customer supplied downpipe, will void the vehicle manufacturers original warranty on the vehicle.
