All of the transactions with King Trucking or [redacted] have been through Performance [redacted] a Kenworth Truck Dealer in [redacted]...

They are a distributor of our product and we have not sold direct to Mr. [redacted]. We have worked with him attempting to resolve his concerns with our product.
The first transmission was sold to Performance on 10/26/2015 this transmission ran a full year when Performance ordered another transmission on 10/26/2016. At this time we were not informed that this was replacing the first transmission a warranty claim had not been started.
The second transmission King Trucking immediately complained that it was running hot and vibrating under a load. We started a warranty claim on this transmission and sent a replacement unit.
On 11/09/2016 we were informed that transmission #2 was a replacement for transmission #1. At this point we started the warranty process on the original transmission. At this point neither one of the failed units had been returned to us.
As soon as the first unit was returned to our plant it was determined that engine coolant was in the transmission. This coolant contaminated the oil and caused a non warrant-able failure.
At this point transmission #3 was already in the truck. We contacted Performance Truck and informed them that coolant was discovered in the first failed transmission and would more than likely have the same result on the second unit that was in route to our plant and that they needed their customer to check his truck so the third unit would not fail.
Sure enough transmission # 2 tested positive for coolant. At this point we invoiced Performance Truck for the damages on the two failed units. We did not bill full price only for damages to repair the two transmissions.
On 01/19/2017 we met with King Trucking and Performance Truck. We did not know that King had not paid Performance for the damaged transmissions. King Trucking was complaining that the transmission in the truck was making a lot of noise. They also provided an oil analysis they had done on 11/20/2016. This report showed traces of coolant and high levels of Sodium and Potassium which is caused by coolant being in the oil.
Because King Trucking had experienced so much trouble we provided Performance Truck with another transmission and we paid the labor to install it. We were unaware that King Trucking had not paid for the failed units.
This the fourth transmission was installed by Performance and the truck was test drove twice before turning over to King Trucking. Performance stated that it worked fine.
After taking the Truck King Trucking complained that day that the transmission was not working as it should and they wanted us to purchase them another transmission. It was then we learned that King Trucking had not paid Performance for the two non warrant-able units.
We issued good will policy credits to Performance truck on the two non warranty failures. We feel that King Trucking should be taking some responsibility as these were non-unwarrantable failures.
In late April we received a certified letter from King Trucking asking for a full refund for all transmissions purchased and be reimbursed for their labor charges. After discussing this with Performance Truck we agreed to credit the original transmission back to Performance.
At this point King Trucking has a truck with a transmission in it that has been running since January of this year that they claim is not performing properly. They have been reimbursed for all transmission they purchased even though two of them were not failures because of Weller workmanship or materials. So, they have had transmissions with only paying 2 labor bills with no cost of transmissions since 10/26/15.
We feel Weller Truck has exceeded our stated warranty and tried with no success to satisfy King Trucking.
