Review: The co.is billing me for work I did myself before they even entered my home.

They are also over billing me based on square footage.

My insurance co payed me based on 26561.45

[redacted] restoration inv is based on 34650.86

These numbers are a total for sf,lf, and sy.

They are over billing for 8089.41 sf,lf, and sy.

Approx. Over billing of $16,000.00

Total inv is for $24,500.00Desired Settlement: This has been going on since Dec of 2012.

I have made many attempts to resolve this.

I just want a adjusted inv. For approx. $8500.00 and I well send a check out right away.

Response to [redacted] Review:

On or around 10/**/2012 [redacted]’s home suffered property damage. On or around 11/*/2012, at the request of [redacted], PDR performed a damage assessment and estimate, with the authority of his insurance carrier covering the claim. The estimate was submitted to [redacted]’s carrier directly. [redacted]’s carrier approved a substantial portion of the estimate and PDR agreed to accept the reimbursement amount guaranteed by the carrier. After completion of the work, in breach of the work authorization contract signed by [redacted], [redacted] retained all funds issued by the carrier for the work PDR performed. Notwithstanding the instant complaint, the following remains PDR’s position:

· [redacted] has not made a single payment to [redacted] Restoration (PDR) to date for phase one of services completed to his satisfaction on 11/**/2012 (signed and dated certificate of completion/satisfaction on file) and has not paid PDR for phase two of services completed on 12/**/2012 (signed and dated certificate of completion/satisfaction on file)

· PDR submitted estimates for services performed to the customer’s insurance company along with all required signed certificates. The insurance carrier informed PDR the customer was paid $24,500.00 for work PDR completed to the customer’s satisfaction.

· [redacted] had concerns regarding the PDR estimate and needed further explanation and breakdown of how the Xactimate estimate (the software used to itemize covered items and the scope of work to be performed) was written (the estimating format can be confusing)

· On a conference call that included the insurance carrier adjuster, [redacted], [redacted] and PDR, PDR explained that the charges on the estimate only included work performed by PDR.

· The insurance carrier then reviewed all photos, estimates and documents, made adjustments to the PDR estimate which reduced the initial PDR estimate to $24,772.68 and asked PDR if we would be willing to accept $24,500.00 (the amount paid to [redacted] for the work we completed). PDR accepted these terms.

Prior to doing any work at the [redacted] residence [redacted] signed a [redacted] Restoration (PDR) Emergency Service Agreement which authorized PDR to proceed with restoration services. The agreement clearly states “PDR agrees to accept such payment for the services provided as per the customer's insurance company allowance. Should coverage be denied under the policy, the customer will be responsible for payment in full.”

As for the allegation PDR improperly billed based on measurement discrepancies:

The PDR estimate was written based on the measurements taken by a PDR estimator. As explained to [redacted] on more than one occasion, rather than dispute the propriety of the reduction made by [redacted]’s carrier, PDR agreed to accept the adjusted funds the carrier has approved to pay for the work we completed. It bears repeating however, that all line items on the estimate submitted to the carrier were performed by PDR.

PDR is currently in litigation with [redacted]. It should further be noted that the contract obligates [redacted] to pay for legal expenses PDR has incurred in the event payment is not made. To date, we have incurred Attorney fees that will have to be part of any settlement or resolution and are currently part of our pending lawsuit. We tried, unsuccessfully for months to resolve this matter with [redacted] and have now incurred fees merely to get him to the table again, only to have to explain the same things, namely that we have only charged for work we performed and that he has improperly retained ALL funds paid by his carrier.

PDR stands ready to support this response with any documents necessary and stands by its record of having serviced 1,000’s of homes, at least 150 of which were serviced during Hurricane Sandy.
