???uary 29, 2016Dear Representative Revdex.com:In response to the complaint submitted on 1/19/and was assigned an ID of [redacted] , I have personally reviewed the complaint as well as have spoken to the customer regarding the issue with the installed concrete.In summary, [redacted] received an estimate to replace azoo sq ft area of concrete on her propertyThis included removal and hauling of old concrete, preparation of the patio area, and installation of new concreteA 4-inch concrete pad was removed and the area prepped accordinglyUpon installation, two control joints were placedControl joints are installed to minimize cracking in concrete slabs and floorsIt was explained to the customer that it is not possible to guarantee that concrete will not crack due to the nature of concrete hardening and numerous environmental factors that can influence the outcomeDespite placement of the control joints, this concrete slab sustained a crack elsewhere on the concrete slabThis is unpreventable and can occur at any time during the concrete's existence, whether that is one week, up to one year, or even ten years laterRepair of an existing crack will not prevent additional cracks from developing, and it is impossible to ensure a customer that their concrete will be crackfreeAs a mason who has installed countless concrete patios, driveways, sidewalks, this fact is always explained to customers before the concrete is installed [redacted] verbalized understanding of this, and although she accepted the terms, she is now unsatisfied based on an outcome that is unforeseeable and unpreventable.In order to resolve the issue of cracks in the concrete slab that was installed, there is no method of which to repair a crack that results maintains the aesthetics any more than leaving the crack aloneAdditionally, removing the concrete and installing new concrete does not eliminate the potential for cracking in any subsequent concrete that is installed.Therefore, in conclusion, without the ability to foretell the future, I am unable to resolve this issue to the customer's satisfaction and highly doubt that there is any mason is existence who can do so.Sincerely, Paul Johns

I am rejecting this response because: From date of concrete installation (10/20/15) to the date the crack appeared (1/17/16), the weather was exceptionally mildNo de-icing products, or any chemicals, or hot water or ice choppers or heavy objects were used on the concrete. I did not verbalize my acceptance of potential cracks, rather I reasonably, and in good faith expected the benefit of a crack-free concrete. The "contract" did not contain a "Contrary Intention", and I believe an "Implied Warranty" is relevant. Further, if my understanding of the term, control joint is correct, then one was placed - not two. Certainly, a flawed installation is not out of the question and perhaps, the crack can be repaired - adding a sealer that has color in it to maintain the aesthetics of the concrete. Cracked concrete, in such a short amount of time? Is the liability placed on the consumer who, in good faith and fair dealing expected a crack-free concrete. I would hope not. Finally, my situation is such that I can not take lightly the loss of $1500.00, in addition to the prospect of repairing the concrete again in the future. Thank you

A 4-inch concrete pad was removed and the area prepped accordingly. Upon installation, two control joints were placed. Control joints are installed to minimize cracking in concrete slabs and floors. It was explained to the customer that it is not possible to guarantee that concrete will not crack due to the nature of concrete hardening and numerous environmental factors that can influence the outcome. Despite placement of the control joints, this concrete slab sustained a crack elsewhere on the concrete slab. This is unpreventable and can occur at any time during the concrete's existence, whether that is one week, up to one year, or even ten years later. Repair of an existing crack will not prevent additional cracks from developing, and it is impossible to ensure a customer that their concrete will be crackfree.
